I'll always remember sitting near him at a table full of Canadians at a
conference in Oaxaca Mexico.

Challenging Wrongs. Advancing Rights. Transforming Lives.
This month has been a busy time at the Legal Network, but we could not
possibly begin to talk work without acknowledging the heartbreaking loss of
our beloved colleague and friend, Ron Rosenes. He was, and remains, a force
for good and champion for people living with HIV, in Canada and beyond.
We know it is an incredibly difficult time for so many in our world. Our
work continues at a time of great human suffering, and affronts to human
rights from many corners. We hope this message finds you in gentle care,
for yourself and others, at a time of great collective grief; we feel it,
too.
We also hope you’ll read on to hear more about recent court decisions
affecting our work and get a glimpse at an upcoming campaign. The HIV Legal
Network remains committed to human rights for all, and hope you’ll join us
to keep rights within reach.

Late last month, we were devastated to learn of the passing of former Legal
Network Board chair Ron Rosenes. Ron was a dedicated and passionate
advocate for human rights as well as a long-time HIV survivor. He was
active in so many organizations and his influence on the landscape of
2SLGBTQ+ rights, HIV advocacy, and health equity cannot be overestimated.
We are so grateful to Ron for his years of friendship to the Legal Network
and we will miss him beyond measure. Our full statement on his passing can

*Difficult news on recent court cases in Canada and Jamaica*
On October 27th, the Supreme Court of Jamaica released its decision

on the latest hurdle to Maurice Tomlison’s challenge to that country’s
*Offences
Against the Person Act*, which criminalizes same-sex intimacy. The
Government of Jamaica made a procedural argument: that the court did not
have the authority to inquire into the constitutionality of these laws. And
sadly, the court determined that the so-called “savings clause” in the
Jamaican Constitution did in fact prevent it from conducting such an
inquiry. This means that this challenge, which we have supported for almost
a decade, has hit a wall. These laws will continue to penalize LGBTQ+
Jamaicans at a time when similar laws are being struck down around the
world. We will now work with partners and other committed advocates as we
consider next steps, despite this difficult setback. You can read our full

from the Ontario Superior Court in the challenge to the *Protection of
Communities and Exploited Persons Act*, in which the court found that the
laws criminalizing sex work did not violate Canada’s *Charter*. On October
13th, the Canadian Alliance for Sex Work Law Reform, of which the Legal
Network is a member, officially filed our notice of appeal signaling our
intent to continue to challenge the same sex work offences and taking the
next steps toward seeing these laws struck down. We will keep you updated
as the case continues, and we will not give up the fight.

*Introducing the Rights Action Network*
This is a difficult time for people around the world as conflict and abuses
multiply. While this is the time of year that we would usually launch our
end-of-year fundraising campaign, we are deeply aware that a traditional
appeal for money would feel inappropriate – both to our supporters and to
us. While we have no choice but to fundraise if we want to continue our
work, we’re taking a slightly different tack this year. Keep your eyes on
your inbox next week as we launch the Rights Action Network, which we hope
many of you will join. More details will come with the official launch and
we’re very excited to share this new initiative with you.

P.S. HIV & AIDS Legal Clinic Ontario (HALCO), the HIV Legal Network,
African Caribbean Council on HIV/AIDS in Ontario (ACCHO), Africans in
Partnership Against AIDS (APAA) and Black Coalition for AIDS Prevention
(Black CAP) have collaborated to create new “Know Your Rights” resources on
HIV criminalization that are specifically designed for African, Caribbean,
and Black communities. These resources will provide information about the
current state of the law related to HIV criminalization in Canada in an
accessible and culturally sensitive manner.
We are currently seeking artists from the African, Caribbean, and Black
communities to assist us with the design of these resources (either with
previously created work or new pieces, depending on available resources).
We are looking for design approaches that represent the varied and diverse
cultures within these communities, or a designer who is able to convey this
through the design and layout of the resource.
If you have art that you would like to have considered for this project,
please let us know. Please also share this with widely with your contacts.
Compensation is available.
