Dear Margarite,
Today is International Women’s Day — a day when we celebrate the
achievements of women and girls and reflect on the work still to be done to
truly fulfill our human rights. This includes the freedom for all women to
live without fear of violence or discrimination.
The fact is that too many women still face gender-based violence on a daily
basis, an issue that is even more pronounced for Indigenous and other
racialized women, women who use drugs, women who identify as sex workers,
and women living with HIV. This is why we recently engaged in a
consultation with researchers and service providers in the field — and,
most importantly, people with lived experience — to learn more about the
realities of gender-based violence in this context. We heard moving stories
about how HIV criminalization can have a disproportionate effect on women,
who may fear violence if they disclose their status but face criminal
charges if they don’t, even being unjustly registered as sex offenders if
they are convicted of HIV non-disclosure. We also heard about the numerous
gaps in legal resources and social supports that contribute to women’s
vulnerability to violence — gaps that are magnified for Indigenous and
Black women and women living in poverty.
“We need to consider people's ability to disclose; there is such a great
risk of violence in disclosure.” (Montreal, service provider)
“Our advocacy and response cannot just look at a specific sexual situation
or one narrow encounter, but the broader context of marginalization,
poverty, vulnerability, and sexual assault.” (Toronto, feminist legal
advocate)
We will be using the findings of this consultation to create a new resource
aimed at policymakers who have the power to do better for women living with
and at risk of gender-based violence. You can also watch our 2015
documentary, *Consent*

to understand more about this issue.
We have also previously shared with you our *Gendering the Scene* report

which details the ways in which women are not served by the available harm
reduction services, and the *Perils of Protection* report, which describes
how laws claimed to “protect” sex workers actually do great harm. A
constellation of laws and policies must change in order for women to truly
realize their human rights — and we commit ourselves to working to change th
em.
So, on this International Women’s Day, we honour all women, and we will
continue our work to uphold their human rights in all the spheres in which
we work.
In solidarity,
The HIV Legal Network
P.S. If you would like to help us in this work, please give today! We know we
can get there, but we need your support.
