    Global Fund Partnerships Forum - Addis Ababa

The Global fund has placed a call for nominations for participants for the
Global Fund's first Partnership Forum in Addis Ababa, Ethiopia on 7th – 8th
May 2015

The 2015 Partnership Forum provides a unique opportunity for the Global
Fund to reach out to a wide range of stakeholders for consultation and
inputs as it develops its 2017 – 2021 Strategy. The Addis Ababa Partnership
Forum will bring together 130 participants from countries in West, East,
Central and Southern Africa. The Partnership Forum will include key Global
Fund stakeholders - including civil society and community-representatives.

                Board delegations differ on choice of Global Funds
Partnership Forum.

The Global Fund to fight AIDS TB and Malaria saw its 33rd Board
Pre-Meetings begin with different opinions on the choice of Addis Ababa for
the venue of the 1st Partnership Forum 2015.

While the Communities and Civil Society Delegations to the Global Fund
Board strongly objected to the selection of Addis Ababa as location for the
first Partnership Forum citing Ethiopia’s legal environment that is
extremely restrictive to key populations and potentially very harmful for
PF participants, the African constituencies of West and Central Africa and
East and Southern Africa, made a strong case for Addis Ababa as a location
for the Partnership Forum saying that Ethiopia is the political
headquarters of Africa and that they had already planned a pre-meeting
partnership forum ahead of the one that will be held on 7 – 8 May 2015.
They also said that diplomacy rather than sanctions must carry the day.

According to the Ethiopian Criminal code, “same sex homosexual acts" are
punishable by imprisonment of 10 years or more. *“The Global Fund
Secretariat acknowledges the fact that the Partnership Forum's location in
Addis Ababa poses potential security concerns for key populations in their
call for applications for participants, however, they do not provide any
further guidance on how to guarantee the safety of participants from key
populations. To organize an additional meeting in a different location,
specifically for those populations that would not be able to enter Ethiopia
safely, would not be acceptable.*” Said the delegation members.

In addition to the main concerns around the principle, the decision to hold
a Partnership Forum (part of the constitutional governance of the Global
Fund) in Addis Ababa and the process thus far go against spirit and
commitments of the Global Fund Strategy in Relation to Sexual Orientation
and Gender Identities (SOGI). Action 19 in SOGI stipulates that the Global
Fund commits to meeting with government and civil society representatives
before it holds Board Meetings in any country where sex between consenting
adults of the same gender is criminalized. Such processes have not been put
in place.
                ICW speaks to the Kenya's Presidential “all in” directive.


On the 23 February 2015, as part of his admirable commitment to the global
“All-In” platform to End Adolescent AIDS the president of Kenya gave a
directive to all County Commissioners to work with County Directors of
Education and Medical Services to collect up-to-date data on children and
other people living with HIV for the purposes of improving delivery of
comprehensive services. The data matrix included with the directive
indicated that the names of children living with HIV, guardians and
caregivers living with HIV, as well as all women living with HIV, including
expectant and breastfeeding mothers, should be collected. It further linked
the names of persons from each of these groups to their home area or
school.

Whilst we commend the president of Kenya for his commitment to end the
epidemic through efforts to overcome the challenges of HIV and AIDS among
adolescents, this directive may result in the violation of the fundamental
human rights of individuals to confidentiality and privacy, and will have
serious consequences for people living with HIV and the HIV response in
Kenya. *“We are deeply concerned that these instructions will result in the
violation of the fundamental human rights of individuals to confidentiality
and privacy, and will have serious consequences for people living with HIV
and the HIV response in Kenya. The mass collection and disclosure of
confidential medical information will undermine important public health
goals. We are apprehensive that the measure will in fact deter people from
seeking HIV treatment and care services, thus frustrating efforts to
encourage voluntary HIV testing and treatment. We are also concerned that
the effort will disproportionately impact women living with HIV, placing
them at increased risk of stigma, discrimination and violence.”* Read part
of a letter to the president from The International Community of Women
Living with HIV (ICW) and the Global Network of People Living with HIV
(GNP+)

In an advisory dated 11 March 2015 the National Empowerment Network of
People Living with HIV and AIDS in Kenya (NEPHAK) and the Kenya Legal and
Ethical Issues Network on HIV and AIDS (KELIN), leading HIV organizations
in Kenya, had articulated that the proposed data collection measures are
also contrary to Kenyan Law, specifically: the provisions of Article 31 of
the Constitution of Kenya 2010; sections 20, 21, 22 and 23 of the HIV and
AIDS Prevention and Control Act 2006; section 19 of the Children’s Act; and
the relevant International Treaties to which Kenya is a party, by virtue of
Article 2(6) of the Constitution of Kenya.

They organizations urged the president to work with networks of people
living with HIV to find alternative rights-based approaches to implement
this laudable commitment under the All-In Campaign.
                United Kingdom announces £5 million for the most
inadequately served populations through the Robbert Carr Civil Society
Networks Fund.

The UK Parliamentary Under Secretary of State for International Development
announced on the 19th of March a commitment of GBP 5 million (USD 7,428,450
/ EUR 6,924,000) over a three year period to the Robert Carr civil society
Networks Fund. This substantial contribution gives support to international
civil society networks that address HIV service needs and human rights of
populations that are most affected by the HIV epidemic.

The Robert Carr civil society Networks Fund (RCNF) is a unique cooperation
between civil society and donors. Through a pooled funding mechanism the
RCNF aims to secure a strong and predictable flow of resources toward
international civil society networks. This wouldn’t be possible without the
support of donors who take the lead such as the Department for
International Development of the United Kingdom (DfID).
