*There's a public health emergency in Canada's federal prison system. *In
prison, the reported prevalence of HIV and hepatitis C are approximately 10
and 30 times the estimated prevalence in the general population. This isn't
a surprise; it's been known for years and it's a situation similar to that
observed in prisons in other countries. Why is this the case?

A majority of people entering the federal prison system have a history of
problematic substance use, often paired with complex mental health issues -
which already means a higher risk of having acquired HIV or hepatitis C
before going to prison. Our laws overwhelmingly emphasize criminalizing
drugs and the people who use them - rather than treating problematic drug
use as a health concern, and addressing the underlying conditions in
people's lives that give rise to this drug use. Then, our laws further
exacerbate this public health crisis in the prison system by denying people
inside access to sterile injection equipment that is available outside
(although with still inadequate coverage in many communities). A
significant number of the people who were using on the outside continue to
do so in prison. Simply put, drug-free prisons are a destructive fantasy,
much like the failed "war on drugs" as a whole. And because of a lack of
available sterile injection equipment, it is common for prisoners to share
whatever equipment is available, with a higher risk of transmission of
blood-borne infections.

*While broader reform of our drug policy is essential, there is a way to
help address at least one aspect of this ongoing crisis: providing people

have been introduced in more than 60 prisons worldwide, including in
countries such as Luxembourg, Moldova, Germany, Romania, Spain and
Switzerland. The research and evaluation of existing PNSPs is clear and
consistent: the evidence shows that they are effective in decreasing
syringe-sharing amongst people who inject drugs in prison. They are
feasible and affordable across a wide range of prison settings, and are
recommended by UN agencies and medical professionals in Canada. Most
importantly, *there is no valid reason not to have them in Canada,* so it's
time to rethink our current approach to drugs in prison

Yet our repeated calls for the CSC to introduce these important harm
reduction services into our federal prisons continue to be ignored. *So a
former prisoner, community partners and the Canadian HIV/AIDS Legal Network
launched a lawsuit against the Government of Canada* over its failure to
protect prisoners' right to health and prevent the spread of HIV and
hepatitis C in the country's federal prisons. With this lawsuit, we hope to
compel correctional authorities to make PNSPs available in Canada's federal

Prisoners are entitled to human rights, including the right to health.
Under Canadian and international law, prisoners should benefit from a level
of health care equivalent to what is available to all Canadians. We must

vie des gens, qui donnent lieu à cette consommation. De surcroît, nos lois
exacerbent cette crise de santé publique, dans le système carcéral, en
refusant aux personnes détenues l'accès à du matériel stérile d'injection
qui est accessible hors des prisons (bien que la couverture de ces
programmes, dans plusieurs communautés, soit encore inadéquate). Un nombre
considérable de personnes qui consommaient des drogues avant
l'incarcération continuent de le faire en prison. Simplement dit, le projet
de prisons sans drogues est un fantasme destructeur, tout comme l'ensemble

Nos demandes répétées au SCC, afin qu'il introduise ces importants services
de réduction des méfaits dans nos prisons fédérales, demeurent toutefois
ignorées l'une après l'autre. *C'est pourquoi un ancien détenu ainsi que
des partenaires communautaires et le Réseau juridique canadien VIH/sida ont
intenté une poursuite en cour contre le Gouvernement du Canada* pour son
échec à protéger le droit à la santé des détenus et à prévenir la
transmission du VIH et de l'hépatite C dans les établissements
correctionnels fédéraux du pays. Par cette action en justice, nous espérons
contraindre les autorités correctionnelles à mettre en œuvre des PSP dans
