[Viva] When don't you have a duty to disclose and when do you?

Hey Denise and all,
I would love you to see the collage women did on this theme at the HIV U.
It is in Victoria at Charlene's right now but we will display it at the Poz
Gathering this year. We watched the film "Positive Women; Exposing
Injustice" and it brought up lots of feelings and reactions. Many
interesting comments came up. Most importantly is how this can potentially
increase the risk of violence against women. We are not criminals. We
would never want to infect anyone. Mixed feelings because there is anger
towards the person that infected us. Like Wendy said, we are just one
vindictive lover away from prison. One of the women said something that I
thought was interesting.... she thought at least here in Canada we are
having this discussion and challenging the law whereas in most countries if
you are HIV+ and have undisclosed sex it is a crime and that is that.
Personally I think that it is a public health issue not an issue for the
courts. Canada should be setting an example by having science inform the
laws around criminalization. I also think that until the laws reflect this,
the safest thing is for poz women to take potential sexual partners to a
doc or nurse to discuss safer sex (and to have on record that you have
disclosed) but it sort of takes the spontaneity/ romance out of it .....
not very realistic!
Look forward to reading your article Denise. Please send us the link when
it is done.
Thanks,
Margarite
