Secondly, I want to introduce you to some of the writings of Kahntineta Horn, a citizen of the Mohawk nation, who is presently active in pursuing extremely important legal cases in both the United States and Canada. They touch on matters of fundamental constitutional and international law which is increasingly being violated by those in power. She like many others is concerned that the rule of law is being torn to shreds, being replaced by the rule of wealthy men. Following are a few of the essays I have received from her by e-mail over several months. ACTIONS BROUGHT BEFORE SUPREME COURT OF THE UNITED STATES AND THE FEDERAL COURT OF CANADA
Huge "scheme" is putting certain people at risk of being caught and criminally charged.
MNN. Exclusive. Dec. 19, 2004. Are Kanien'ke:haka being turned into Americans and Canadians without their knowledge or informed consent? Kanien'ke:haka people on all our territories should be very interested in two recent actions that have been taken in the Supreme Court of the United States and the Federal Court of Canada. The action was taken by two Kanien'ke:haka citizens.
The Supreme Court of the United States and the Federal Court of Canada is being asked to re-consider the international and constitutional law relationship between our Constitution the Kaianereh'ko:wa and the U.S. and Canadian Constitutions. This is being done as a still-sovereign "foreign state" because there simply are no words in the U.S. and Canadian Constitutions that allow the Federal, State and Provincial Governments to override Kanien'ke:haka sovereignty.
The only constitutional jurisdiction given by the U.S. Constitution and Canadian Constitution in relation to our territory governed by the Kaianereh'ko:wa is to seek our fully informed consent to change the perception of the existing governing law. No such Treaties exists in the United States or Canada.
Indigenous agents selected by the Federal, State and Provincial Governments have signed Treaties and agreements that are not worth the paper they're written on. All Kanion'ke:haka know this in our minds and in our hearts.
Nevertheless, some people continue to play the role of imposters as witness the recent "scheme". It is believed that a clique are styling themselves as "Akwesasne Mohawks" or "the community" in an attempt to redefine the Kanien:kehaka. This is being done outside the Kaienerekowa, which define us, in an attempt to create a new legal term.
They purport to trade our sovereignty and other rights for potential casinos and other financial enterprises directly connected to enriching their independent business endeavours. They have also allegedly purchased lands and assets for greater development and returns in the future.
Therefore, this action is an attempt to rescue our people from the genocide that has occurred which unconstitutionally ignores the meeting of the minds between the Kaianereh'ko:wa and the U.S. and Canadian Constitutions.
An opportunity has arisen. Justice Clarence Thomas of the U.S. Supreme Court on April 19, 2004, said, "The Court utterly fails to find any provision of the Constitution that gives Congress enumerated power to alter tribal sovereignty."
Those Indian governments constituted under Federal Laws, St. Regis Mohawk Tribe (SRMT), Mohawk Nation Council of Chiefs (MNCC) and the Mohawk Council of Akwesasne (MCA) are trying to divert the Indigenous sovereignty of the Kanion'ke:haka before we can capitalize upon the breakthrough represented by Justice Thomas' recent admission.
As a result of St. Regis v United States (2001) these entities have deliberately subjected themselves to Federal Law. This handful of purported representatives has no jurisdiction to surrender Kanion'ke:haka sovereignty or territory. Being Kanien'ke:haka we have a separate and distinct jurisdiction both nationally and internationlly, just as Canada, the United States and Mexico each have their jurisdictions. We have a right to internal autonomy just like any other nation. U.S. or Canadian Federal Laws cannot apply to Kanion'ke:haka territory any more than Mexican law can apply to the United States..
In occupied countries such as ours occupiers will set up and fund imposters who can be bought relatively cheaply. We too have been subjected to these strategies like others in the past centuries. A very select few get rich for a short time in exchange for the permanent loss of the lands and communal birthrights of their people. They use laws that are externally imposed and that are not initiated internally by their own people. They maintain control, secure and exploit said lands and its people.
The Kaianereh'ko:wa is our people's law.
Our sovereignty and our lands shall be defended according to the law that has been established by the international society of nations.
A response has been received on the motion in question from the Supreme Court of the United States.

W ho is Deskahe?
Is the United Nations Facilitating the Extinction of Indigenous People?
MNN. Dec. 12, 2004. In 1998 I went to the United Nations in New York City and I wasn't impressed. UN officials representing the dominant societies lined up their people to tell us what to do. They controlled the meeting, set the agenda and decided what and how many questions would be asked. The questions that were asked were never answered.
Did you know that Canada was a leader in excluding all Indigenous Peoples from participating in international venues as equal members of the human family?
In 1924 Canada placed Indigenous societies throughout the world on the path to genocide and extinction. Canada's strategy continues to perpetuate this tragedy on Indigenous societies worldwide.
There is no reason Indigenous people should be treated any different from anyone else. International law states quite clearly that all humans are equal. But Canada's Indian policy is based on legislation passed when the people they called "Indians" were formally defined under Canadian law as "non persons" (see eg. Section, Indian Act, 1906).
We Haudenosaunee are independent allies of the British. We never agreed to become British subjects or Canadian citizens. But Canadian officials assumed that we were subjects or wards of the Crown. They mismanaged our trust funds and allotted our lands without our consent. They ignored all our attempts to hold Canadian public officials accountable.
In 1922 we petitioned the Supreme Court to decide the legality of Canada's actions. We were refused a hearing on the advice of Duncan Campbell Scott, the head honcho in the Department of Indian Affairs. We petitioned the British Crown. They refused us a hearing. Again they relied solely on Scott's advice.
In 1924 Deskaheh, was sent by the Iroquois Confederacy of Six Nations at Grand River to Geneva. His aim was to apply for membership in the League of Nations? The Six Nations wanted an accounting of the trust funds and a review of our status by a neutral independent third party. Our request was supported by the Netherlands, Estonia, Persia, Ireland and Panama.
Acting again on Scott's advice, Britain used diplomatic pressure to get them to withdraw their support. The Haudenosaunee complaints were never subjected to legal review. Once it was clear that the Department of Indian Affairs could act with impunity, it got an Order-in-council to depose the traditional government at Six Nations and replace it with an Indian Act Council. Only about 26 votes were cast in the election that replaced the 32 member Council. All modern standards of legitimacy were violated. But Canada continues to pretend that the government it imposed on the people of the Six Nations is legitimate.
Because Scott and his cronies were able to mobilize the British Empire to suppress justice, the international community accepted the claim that Deskahe was no longer the legitimate representative of the people at Six Nations.
The modern exclusion of Indigenous peoples from the United Nations is based on this precedent which violated the principles of modern International law. Like many other Indigenous peoples, the Haudenosaunee were denied recognition even though the change in our status was not affected by the support of a clear majority of people. Our current official status as Canadians was not freely chosen. It was imposed on us by a colonial regime.
Scott's gang successfully claimed that Six Nations was an internal domestic Canadian concern. This closed the door on our ever getting any neutral adjudication of our issues. Nations throughout the world adopted this same stance. We Indigenous people everywhere were put at the mercy of these nations to this day. Canada's action created, in effect, a Department of Indian Affairs within the United Nations to colonize the Indigenous people worldwide.
Indigenous people everywhere are denied basic human rights and are targets of genocide. We cannot officially appeal for help outside the state that has been imposed on us and denies us human rights. Today Canada lobbies vigorously to deny us a voice at the United Nations.

Why do White People Want to Play "Indian"?
MNN. Dec. 26, 2004. Indian imposters are part of our scene. From the fake Mohawks who hosted the Boston Tea Party, to Grey Owl, to Oscar de Corti, to Charlie Smoke, to all those grey-haired academics prowling around the "Indigenous" scene who have suddenly discovered an "Indian" ancestor - we just never know when another one is going to pop out of the wood pile.
Ya gotta wonder.
Why would anyone want to pass themselves off as an "Indian"? Do they aspire to our standard of living sat the bottom of their barrel? Do they pine for the experience of being denied a political voice, or losing their land to theft and pollution? Is it the police harassment, the racial profiling or the endemic sleaziness of the sexual innuendos we endure that they envy? Or do they feel some kind of existential angst because their family missed out on the horrific residential school genocide?
We've all met someone who isn't what they say they are, or who claims to have a grandmother or grandfather who's "part Indian".
Philip J. Deloria thinks they are seeking a connection with the primal purity they imagine we know. "Indians are associated with the land, and nature, and reality and authenticity. Indians are the people who possess the ultimate meanings and the ultimate truths on what America is about." This is often the white perception.
One Indigenous man said, "They love our skin colour, but they hate our guts!" We evoke both love and hate from these people. "Everywhere we turn, there is something named after us - as if we are all dead and gone, relics of the past".
When it comes right down to it, all you have to do to become an "Indian" is to check a box on the census form. Of course, that won't get you the right to live on a reservation or open a casino. The colonizers keep tight control over what they call legal "Indians". It's been up to the BIA in the U.S. and the DIA in Canada to define who is, or is not, an "Indian".
If you play ball according to their rules, you too can become an Indian. In Canada, for example, any woman who married an "Indian" man could became a full fledged "Indian" with all the rights and benefits. But an Indigenous woman who married a white man instantly lost her claim to status. According to their rules, she had to move out of her community and couldn't come back even if she got divorced.
When the United Nations found this violated equality rights under the International Covenant on Civil and Political Rights, the colonizers changed their laws. But they still don't let us decide who we are.
It is now possible for kids raised on a reserve to lose their "Indian" status and their right to live in their community even if their ancestors have been there in every generation since Europeans invented "Prisons of Grass". Meanwhile, band registries have been inflated with the names of all sorts of strangers who claim benefits on the grounds of some sort of genealogical link.
Then there are those who pretend to be Indians for a cause. The "crying Indian" was a fake. The guy in all those "Keep America Beautiful" ads during the 1970's was an Italian American named Oscar de Corti. Why did they have to pick him to represent us? Did they think he looked more real than the "real thing"?
That was the deal with Gray Owl. Europeans lapped up everything he had to say. He knew what they wanted, 'cause he was one of them. He told them everything they wanted to hear. But they didn't care about what we had to say. The Ojibway of Temagami use to ask , "How could anyone mistake him for an Indian?" But no one was listening.
Grey Owl's second wife, Anahareo, turned out to be another wannabee Indian. She had some Mohawk blood and she was seeking her roots - but she was doing it through a fake Indian! At least she had some genuine ancestry that she wanted to find out about.
But you have to wonder why films about people like Grey Owl are big at the box office. Real indigenous people like Tecumseh and Deskaheh are ignored.
And you don't have to go to Hollywood to rake it in for being a fake Indian.
Brooke Edwards called herself "Medicine Eagle" and ran Indian culture camps in Montana. She charged $1500 per person for a two-week session. The Crow Indians said she totally misrepresented and abused their spiritual traditions. But who was listening?
Cultists, con artists, hucksters, charlatans, "plastic medicine people" - They grow rich while real Indians starve to death.
Real Indians stay out of sight and out of mind. There doesn't seem to be any limit to what people will try. Get a load of that "Rent an Indian" ad on the net:
"Are you embarrassed by the lack of racial diversity at your social events? Just rent an Indian and you too can appeal to be multi-cultural in the eyes of your friends"
All without having to give up your white privilege!!
The American Indian Movement tried to end the activities of the plastic medicine men. But they got nowhere. So maybe we should just laugh at these people...unless they are competing for Indian scholarships at Harvard.
What's a little hucksterism anyways? Marketing is made in the U.S.A. So what if all the plastic gewgaws they sell misrepresent our cultures? We could always try selling little priest dolls with vials of holy water and fake communion wafers. But would they sell?
Not on your life.
As Vine Deloria, says "White people in this country are so alienated from their own lives and so hungry for some sort of real life that they grasp at any straw to save themselves".
The problem is that real Indigenous people rarely make the grade for non-Indian experts. How many times has someone said to me, "How can you be an Indian when you have green eyes?'..as if they had a monopoly on any kind of albinism.I answer in one word: "Colonialism".
That shuts them up for a moment, but it doesn't solve the problem.
Janet McCloud points out that even Indians sell our ceremonies for a fee. "This is just another theft from us." She said. "Some of these people spend about 15 minutes with an elder. Then they become official representatives of various Indian people. It's absolutely disgusting".
As McCloud says, Indians like Sun Bear, who markets our heritage are a serious threat.
They may even be as dangerous as the fake chiefs who signed away our land in fake treaties. Some even create new tribes composed mostly of Euroamericans. Anyone who is undermining our culture is complicit in the genocide we are trying to overcome.
And what would white folk say if we started dressing up as priests, setting up our own churches and circulating collection plates? Look what happened to AIMer, Russell Means when he went to a school halloween party with his son. He painted his face white and dressed up as a "white man". Indians chortle at the thought, but the people at the party were embarrassed and confused. They did not know how to react.
People are scared if they can't use familiar categories to label things the way they see them. So the fake Indian business thrives. It is based on the search for roots by a rootless people. It feeds on a 500 year old guilt complex.
The colonizers sense that Indigenous philosophy makes more sense than theirs. We have earthbound problems that require earthbound answers. They want to pray to some unseen holy entity for direction and they aren't getting any. "Poor little lambs who have lost their way". Maybe we can't make them see that the answer is in themselves. But we can all do our bit to stop encouraging these plastic medicine people.

PUBLIC RIDICULE AS A FORM OF CONTROL
IN AN INDIGENOUS COMMUNITY
MNN. Jan. 2, 2004. It is well known that native people can be controlled if they are ridiculed in front of their peers. It violates the basic principle of native culture, that of equality. If a person lashes out or insults another, the target reacts by either wanting to fight or flee to avoid a fight. Why? It reflected the communal society that developed over a long period. Everyone was equal and had their own individual strengths which they used for the good of the people. They showed utmost respect to each other. When there was a breach, it was a serious violation of not only the target but a threat to the rest of the group. Those who fit into this way of conserving the integrity of the group survived and those who did not were ostracized.
A public insult or ridicule in front of peers can cause someone to become so angry that they can go blank and react instaneously. They can either strike or leave to avoid a confrontation. To the unaware person, this can be seen as completely irrational.
Many years ago when I was about 23 years old, I had to go to a very important meeting to stand up to people who were usurping our rights. They were sharp and swift. They knew how to control Indigenous people through the use of public ridicule. The meeting was in Garden River, a reserve near Sault Ste. Marie, Ontario. I had heard that the meeting was going to be stacked so that there would be a strong adversarial atmosphere there. I did not want to go. I knew the issues. No one else was available. The elders pressured me. I reluctantly agreed to go.
I knew I could not face them. I was told they were going to shout insults at me, stamp their feet whenever I stood up, to make me cry, which I knew I surely would. The leader of the opposition was an Indigenous lawyer. He knew I was young, from the rez and inexperienced in dealing with being insulted in front of other Indigenous people. The lawyer had gained power by getting others to publicly attack his enemies.
My friends and relatives in Kahnawake were scared for me. We talked about how to handle this situation. Finally, we came up with an idea.. a training session made just for me. I would stand up in front of them, they would hurl insults at me to make me mad, confused and lose control of myself. For the first three days, I could not handle it even though I knew it was only a mock run. I would get mad and tears would come to my eyes at their cruelty. Gradually on the fourth day, even though I was mad, I started to keep my composure better. I even managed to keep some control over my train of thought. By the seventh day I could look them in the eye and take any insults they could deliver.
When I went to Garden River I was still shaking inside with anger and fear. They were going to do what I expected. I stood up and they yelled at me. At first they got to me. But I remembered my training and held onto myself. They yelled, "whore", "Indian slut" and other degrading epithets. The leader got so angry at me for not falling apart that he gritted his teeth and said, "You are the most horrible Indian on the face of the earth", "you are an insult to our people", and other terrible insults. I tried not to lose face. It was an incredible violation by an older person who wanted to destroy a young Indigenous person.
Finally, 80 year old Chief Dick Pine of Garden River, who had been standing at the back of the room, walked up to the front of the hall. He banged his fist on the table in front of my antagonist so hard he broke his watch. Chief Pine, shaking, yelled, "No one will treat anyone like this on my land!" The lawyer got so scared he turned white. Chief Pine was surprised at his own reaction and that I was able to keep standing through it all.
I had to find out more about this cultural phenomena. It was known. Our people developed a way of dealing with it. When we have a meeting, especially over a contentious issue, we do a ceremony called the "Small Condolence". Because we are aware of our volatility, this ceremony sets down the ground rules which the participants will follow in order to resolve an issue. The ceremony goes as follows: a piece of soft doeskin is used to wipe the eyes of each person so that they may see issues clearly; they take an eagle feather and wipe it around the ears so that they may listen and hear what is being said; and they take a glass of clear water and drink it so that their words will be as clear as the water, without sharp edges. Then the deliberations begin. The War Chief makes sure that each person follows the principles of the Small Condolence.
There are many native people who will walk away from a situation in order to avoid an uncomfortable confrontation or to save face. Unless a native person is aware of this situation, they have a hard time standing there and taking it. Indigenous students should be told about it. Maybe three or four Indigenous persons could be put together to coach each other through these situations. It reflects the old hunting or war party system when 4 people form a gang to train each other in the skills of hunting, usually two older and two younger.
If schools want to successfully train Indigenous students, it may help if they were aware that the higher the students go the more pressure they face as they rise to higher levels of competition. This is when they will find themselves in situations of hostility, aggression, being yelled at and being insulted. If they understand why they may react negatively or angrily, then they won't leave. We do need these professionally trained people. Of course, these institutions could also use the ridicule method to get rid of our Indigenous students too.
Our young people are reacting as normal warriors, fight or flight. In such situations today in schools, they cannot respond normally as an Indian, to fight back or leave the situation. Once they understand what's going on, they will be able to deal with it. They will find a way.

INDIGENOUS PERSONS WHO BETRAY THEIR PEOPLE
MNN. Jan. 2, 2005. They've always been there, but today there are more of them and they are unafraid because they are protected by the oppressors as long as they are useful to them and do their bidding.
But why are they more committed than ever before to work against their people and harm them, no matter how much their own people beg them to stop? During the past 15 years or so, there has been a greater emergence and escalation of the problem of Indigenous individuals who betray their own people on behalf of the enemy.
The reasons these individuals carry out such treachery looks like a desire for material wealth or power. But is that the only reason why they abandon their principles and cross over to the join the army of the opponents?
They appear to no longer see that they have permanently enslaved themselves to tyrants and have abandoned the only people they once could trust, the only people who loved them in healthy ways.
Despite the faces these disloyal persons put on, they too are victims of racism the same as the rest of the Indigenous people. The problem facing Indigenous people is how to deal with them because they are harmful.
How can they be identified and how can the information be shared to stop them from harming or dividing their people?
Perhaps there should be a meeting of many people from many cultures and races to discuss this phenomena and to develop a strategy which can be widely publicized.
What did the ancestors do to their spies and traitors? In some Indigenous cultures, those who knowingly worked against their people and ended up harming them were considered as having alienated themselves. They had to forfeit all birthrights and claims on their nation and territory. One writer stated that the charge against these persons is treason and the penalty was death. Today we cannot and will not carry out such a punishment.
There needs to be a full and open discussion of this.

REPOSSESSION NOTICE: Getting it All Back

Hear Ye! Hear Ye!!
Be it known to all citizens of the United States of America and Canada,
Effective immediately:
In light of your failure to live up to the original agreements with the Indigenous nations, and in light of the persistent violations of your own constitutions, we hereby give notice and declare that we are repossessing our lands and resources.
This repossession will continue in effect unless we decide to renegotiate the agreements under which you have been living here with us.
The authority to implement this repossession is being exercised in accord with international law. You are reminded that you must respect our sovereignty and our jurisdiction in Turtle Island - the land you call North America.
You are furthermore reminded that the United States, Canada, multi-national corporations, the military and the media (CNN and Fox, in particular) are, and always have been, nullities under our law.
Traditional law is now the only law in effect. The environment, and the rights of future generations are our priority.
The Congress of Indigenous Women and the Council of Chiefs will resume all governing duties everywhere, over all colonially imposed states, provinces and territories, except Los Angeles, which has been damaged beyond repair. They will work hand in hand with the Council of Elders to reinvigorate traditional functions and systems of government.
The following guidelines will assist your rehabilitation:
1. Indian-time will go into effect immediately. If you do not understand Indian-time, just wait around for a while and somebody will eventually come along and explain it to you.
2. The White House will now be used as the Elders' Center. The hill occupied by the colonial Parliament in Ottawa will resume its traditional function as a meeting place for the Council of Chiefs. The Congress of Indigenous Women will take over Congress in Washington, D.C.
3. All governors mansions, prime minister's residences, presidential palaces and other colonial habitations will be turned over to the homeless.
4. The official status of all Indigenous languages is reaffirmed. European languages will remain the official languages of Europe. In order to facilitate their repatriation, Europeans will no longer be allowed to stray from their original homelands. The continents, towns, cities, businesses, streets, etc., will be renamed by the Indigenous people of the region.
5. Healing centres will be established to treat all of the non-Indigenous people who have become addicted to domination and other abusive relationships. Once these sickos stop abusing, their victims will soon recover their health.
6. Educational study groups will be established to help people learn the meanings of concepts like "constitution", "rule of law", "sovereignty", "peace", "equality", "tolerance", "respect", "honesty", "mutuality" and "repossession".
7. All borders established by the colonists will be erased. The names of the original Indigenous nations will be reinstated and clan membership will be recognized. Indigenous peoples will be allowed free passage throughout North, Central and South America.
8. All hierarchies will be leveled. There will be no aristocracy, no super rich people. Everyone has to work for their own sustenance. Self-sufficient communities will replace globalization.
9. Traditional clothing will no longer be called "costumes" or "regalia".
10. The positions of police, prosecuters, judges, social workers, tax collectors and dog catchers will all be abolished. Old technologies will be revived. Note that everyone will not live in teepees. Some will live in longhouses, wigwams, hogans, etc.
11. All hunting and fishing rights will be based on need of the family or community. All sports hunting and fishing will be banned. Those caught sport fishing and hunting will be deported to the unclaimed county of Los Angeles. Zoos will be closed down and the animals will be set free and helped, if necessary, to return to their natural habitat.
12. Hollywood will be required to hire Indigenous actors for Indigenous parts - NOT just to play bad guys or spiritual leaders. They will also be allowed to play whites, Jews, Italians, Asians, Africans and Middle Eastern people.
13. American/Indigenous/Indian names, nations or images for any sports team will be discontinued. No other race of people will be degraded in such a way. i.e.new team names may not include names like the "St. Louis Spicks", "Washington Wops", "Georgia Gooks", "Denver Danes". (With the exception of the "Fightin' Irish.") Animal names may be used as they won't be so offended.
14. Indigenous names and images may not be used on merchandising and replacements may not include disrespectful terms like Jeep Chicano, or Mazda African.
15. July 4th, Canada Day, Columbus Day and all White hero worship days will no longer be celebrated. Halloween will be a national holiday. Anyone of Indigenous descent will have the summer off with pay, in order to go visiting relatives or to follow the pow wow trail. Statues of the murderous colonizers will be torn down and replaced by monuments to the more than 100 million Indigenous people who were murdered in the biggest on-going holocaust in all humanity.
16. Fry bread and beaver tails will be called fry bread and beavertails and not considered unhealthy. Indigenous medicines and practices will be introduced into hospitals.
17. All non-native peoples will be required to attend training seminars to learn the appropriate manner of "lip signaling."
