cutbacks to affordable housing both in Vancouver and Toronto.
We'll hear from a representative from Tent City, the growing squat
beside Science World on False Creek.
We'll also hear from a representative from OCAP regarding their new
action entitled "Less Talk, More Squat" planned for November 8th,
where they will take another building for housing two days before the
municipal election there.

Amigos de Cuba will be holding a film night on the life of Che

between the US and Cuba
THE CUBAN STORY

Discussion following the film lead by Maensy Sanchez, Cuban
American peace activist and artist.
Cuban Story takes an astonishing look at the Cuban Revolution--from
the inside. Writer-producer Victor Pahlen and film star Errol Flynn
owned a business in Cuba when the Revolution broke out in the early
1950's.
Realizing they had an amazing opportunity on their hands, they
stayed, hung out with the Revolutionary troops, and filmed right
through Castro's ascent. The film is fascinating as an insider's look at
the Revolution, but also as a record of the times in many unintended
ways: the narration refers to Castro's "girl soldiers," and we get a rare
glimpse of a clean-shaven Castro. The filmmakers were in Cuba to
witness and film the cruelties of Batista's reign, and thus take a
decidedly pro-Castro stance. Pahlen and Flynn follow the Revolution
beyond the end of the fighting as Castro reopens the university and
tries to right some of Batista's wrongs. American viewers are rarely
able to see such a pro-Castro piece and may find it alternately
infuriating and thought-provoking.

time limits.

Breaking News!
On October 8, 2003, The Pennsylvania supreme court ruled against
Mumia's habeas corpus appeal. They affirmed the PCRA (Post
Conviction Relief Act)Court "...properly concluded it was without
jurisdiction to address the merits of his [Mumia's] claims, and dismissal
without a hearing was appropriate" and that "...the appellant is not
entitled to habeas corpus relief..."

October 2003 an Update on Mumia Abu-Jamal
Dispatches From Death Row, 3-5 minute radio essays by Mumia Abu-
Jamal recorded, produced and distributed by Prison Radio and aired
on over 75 radio stations. He a featured commentator on Free Speech
Radio News.
Prison Conditions: Mumia is on death row in a high security control
unit at the State Correctional Institute at Greene in Waynesburg PA.
He has been incarcerated for 22 years. He is held in solitary
confinement in a six by nine-foot cell. He is allowed to exercise outside
his cell for only five hours per week. He is allowed one two-hour visit
per week. Mumia recently received more access to the phone, now he
gets three 15min calls per week.
Health Crisis: Mumia has had disturbing episodes where his feet and
ankles are dangerously swollen, deeply discolored and sore. After this
latest crisis, he has not yet been seen by a physician, he is requesting
outside medical attention At the moment, the swelling in his ankle has
subsided and his coloring is better. IFFMAJ www.mumia.org are
requesting that people call the prison and demand that Mumia be
allowed to see an outside physician to diagnose and determine
appropriate treatment.
Legal Overview: Regarding Mumia's 1st degree murder conviction and
sentence of death: Mumia's first and only federal habeas corpus
appeal was decided on Dec. 18th 2001 by district court Judge William
Yohn. In that decision, his death sentence was overturned. And his
conviction was up held. Death row inmates now only get one federal
habeas corpus appeal, per the 1996 anti terrorism and effective death
penalty act signed by Clinton. The Philadelphia DA appealed the
reversal of Mumia's death sentence. The Court granted the DA's
motion to keep Mumia on death row. According to legal experts, there
is a 40% chance the 3rd circuit appeals court will issue an order simply
reimposing death. If the court affirms the reversal of death, the DA
could elect to let Mumia do life in prison without possibility of parole.
(Currently in PA there is no parole). It is more likely that the
Philadelphia DA will elect to conduct a trial on the sentencing phrase
and put Mumia on trial, the only question in that proceeding will be
whether he will be sentenced to life or death.
Federal Court: Both sides have filed appeals of the Yohn decision.
These appeals are before a three-judge panel of the 3rd Circuit. Yohn
certified for appeal only one legal issue, and it involves jury selection,
the relevant Supreme Court precedent is "Batson". This is a very
significant issue if heard fairly should result in a new trial being
ordered. Mumia's Federal Habeas appeal is now moving forward in
light of the PA Supreme Court decision on Oct. 8th to deny his current
state court appeal.
State Court: On October 8th the Pennsylvania Supreme Court denied
Mumia's appeal requesting a new PCRA evidentiary hearing.
Of Note: On October 4th, Mumia received an honorary citizenship of
Paris France in a ceremony at city hall in Paris.

We have a new Liberal government in Queen's Park and a new
Mayor will be in City Hall in November. The politicians are talking about
the need for 'change' in this city and province. But OCAP knows very
well that for the poor and homeless, we will only get change if we are
prepared to fight for it. The Tory legacy still stains our everyday lives - it
must be removed. Immediate problems call for immediate solutions.
All over the east end of Toronto, poor communities are under
attack. Developers, upscale home buyers and municipal planners are
laying the groundwork to drive out those who have lived in the area for
years and create a playground for yuppies.
On November 8th , two days before the Toronto municipal
elections, OCAP will be resisting this drive by taking housing for the
homeless. Once we have claimed a building, we will demand of the
Mayor and other members of the new Council that they meet with us to
negotiate around the following:
1. The building we take over must be opened as housing. Its
residents must be left in possession of the property, with heat, lighting,
and water made available.
2. Social housing units must be created in the east end, to
house all people living in the neighbourhood's homeless shelters.
3. Using its zoning powers, the City must protect existing low
income housing stock and freeze the creation of condos until adequate
housing for poor people has been created.
4. A major drive to inspect existing rental housing in the area
must be undertaken to ensure adequate repair and maintence, and to
protect the housing that already exists.
The low income residents of central Toronto's east end have a
right to be housed. This right takes priority over lakeshore condos,
yuppie 'quality of life' and developers' profits. We intend to cut through
the fake talk and empty promises with serious action to defend a poor
community under attack.
If you want to help build the housing action, we are hosting a
meeting of all individuals and groups interested in standing with us for
housing on November 8th . Join us on Wednesday October 22nd at
6pm in our office at 10 Britain St.
And above all, come out on that day and take a stand for justice
and the right to housing.
