Hi Sofiah and Mick,

Some time back Scottish PSC conducted a highly successful campaign to stop Veolia getting the Edinburgh waste contract.  Here is another Dump Veolia opportunity that you might like to take up.  Veolia currently has contracts for a number of Lots in the APUC (Advanced Procurement for Universities and Colleges) framework contract for providing waste management services to all the universities and colleges in Scotland.  For each Lot a number of companies have the contract.  The “contract” puts them on the list of companies that the Colleges etc. can invite to tender to provide waste services in a “mini-competition”, a less onerous process for the colleges than going through a full tender process.  The Lots are primarily geographical, though the services to be provided differ a bit between Lots too.  The Lots for which Veolia has been awarded a place on the framework contract list of companies that can be invited to take part in mini-competitions are:

  Highlands and Morayshire

  Islands

  Aberdeen and Grampian

  Angus, Dundee and Perth

  Lothian and Borders

  Fife

  Sterlingshire

  Greater Glasgow

  Glasgow City

  West of Scotland

  South of Scotland

The framework contract was awarded by APUC Ltd (Advanced Procurement for Universities and Colleges) based in Edinburgh, see http://www.apuc-scot.ac.uk/home.htm.   The framework contract ends and will be replaced about the end of 2014, possibly as early as 31-7-14, so this gives a suitable period for campaigning.  There is an option to extend for 12 months. The usual condition is that an extension can be refused without reason given, so the campaign should be for no extension and Veolia excluded from the replacement contract. 



The campaign could be aimed directly at APUC, but also at the colleges and universities above that can use the contract for their mini-competitions, with the possibility of mobilising staff and students.  The colleges etc. could be asked to both exclude Veolia from their mini-competitions and to pressure APUC to exclude Veolia from the replacement framework contract.  There would be the possibility of generating widespread publicity about Veolia’s support for Israel’s illegal settlements as an example of corporate complicity in the occupation and Israel’s violation of international law.



A campaign only targeting APUC would be straight forward.  Targeting the colleges/universities as well would markedly increase the impact but would require a lot more coordination effort.  Hopefully you already have contacts with staff or student organisations in some of the institutions that you could try and mobilise.

A campaign on this would have been better started earlier, but still worth having a go.  The contract ends on 31-3-13, but the current contract was only awarded about three weeks before the start date, so the replacement contract is unlikely to have been awarded yet.  Like most authorities Sterling requires a declaration that the bidder has not committed grave misconduct, but interestingly another condition of participation is that (6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.  You could point out that if Veolia has bid for the replacement contract, under this clause it ought not to be selected on the grounds that it has presumably falsely declared that it has not committed grave misconduct.



www.dumpveolia.org.uk gives current information on the UK campaign, particularly the “legal arguments” section.  I have attached an up-to-date model letter requesting exclusion of Veolia from a contract.  It would be great if Scottish PSC felt able to take up either or both of these opportunities.
