and Jails -- for Goodman v. Georgia and United States v. Georgia, U.S.

Issue in the Supreme Court

The U.S. Supreme Court has taken another case challenging the
constitutionality of Title II of the Americans with Disabilities Act
(ADA).  At issue is whether Congress has the constitutional authority to
require states to pay money damages for violations of Title II of the ADA
in their prisons.  A negative ruling might suggest that Congress did not
have the power to enact many of the core provisions of Title II, including
the community integration provisions.

The plaintiff in this case is an inmate with paraplegia who uses a
wheelchair for mobility.  He alleges that the state has violated the ADA
by holding him for more than 23 hours a day in a cell that is so narrow he
cannot turn his wheelchair; by excluding him from counseling, classes, and
religious services because of his disability; and by failing to make
toilet and bathing facilities accessible.

Since the decision in Tennessee v. Lane, which narrowly held that
individuals could sue states for money damages for denial of access to
courthouses, the federal appellate courts have been split over whether
individuals can sue the state for money damages in other contexts under
Title II of the ADA.

Information Needed - Disability Discrimination in Prisons and Jails

Brief writers in the case are seeking information on disability
discrimination in prisons and jails.  This information may relate to
individuals with physical disabilities, mental illness, or developmental
disabilities.  Discrimination against prisoners with disabilities may
involve, for example, denial of access to prison programs, denial of
adequate medical or mental health services, failure to make prisons and
jails physically accessible, punishing prisoners with disabilities more
severely than other prisoners, or the criminalization of individuals with
mental disabilities (e.g., individuals with mental disabilities imprisoned
for conduct resulting from failures of public service systems).

Brief writers seek especially:

I. Published reports -- by government agencies, public interest groups,
journalists, or others --  detailing disability discrimination in prisons
and jails at the state and local level.  Self-evaluations performed by
the state might have such information.

II. Information about lawsuits brought to challenge disability
discrimination in prisons and jails in your jurisdiction, favorable
results in such lawsuits (by judgment or settlement - in an officially
citable form if possible), and the number of complaints public or advocacy
agencies have received about disability discrimination in prisons and
jails.

III. "Horror stories" about disability discrimination in prisons and jails
- stories that would shock judges or lay people.  It would be best if
these are described in judicial opinions, pleadings, or published reports
or articles that could be cited.

IV. Court decisions describing disability discrimination in prisons and
jails.

V. Information about situations in which  individuals with mental
disabilities have ended up in prison due to a lack of mental health or
mental retardation services (i.e., the criminalization of people with
mental disabilities).

Pennsylvania Animal Advocates, Your Help is Needed Again-Protect Your Right to Help Animals!

The Issue
In March, the Pennsylvania State House of Representatives passed H.B. 213, legislation that creates the crime of "eco-terrorism." As written, this bill has the potential to be used against activists participating in peaceful protests or undercover investigations. The HSUS opposes violence and intimidation and these activities are not consistent with our mission of animal protection, however, H.B. 213 is too broad. We need your help to defeat it.

For example, a person protesting conditions at a pet store who inadvertently protests on private property, could be charged as an "ecoterrorist."  A protester on a public highway who picked up a wounded bird from a pigeon shoot could be charged with theft (a property crime) and therefore, under this bill, could also be deemed an "ecoterrorist."  Further, this bill could make it a felony to take part in peaceful demonstrations that may be deemed "intimidating" if a property crime is committed. Actions that may be included under this broad language could be peaceful demonstrations, and people who assist in caring for wounded animals could be labeled as "terrorists." Please take action today on this harmful legislation.

What You Can Do
Please call and email your state Senator, Robert Wonderling, today and urge Senator Wonderling to strongly oppose H.B. 213. This bill is far too vague, could impede investigations, and label peaceful protest and minor trespass as terrorist activities. Such crimes do not make a person a terrorist

Over 300 telecommunication workers and trade unionists arrested

Government starts military crackdown as it announces unilateral date 
for privatisation of Pakistan Telecommunications

Over the weekend the number of telecommunication workers taken into 
custody by the police has risen to over three hundred. Paramilitary 
police forces have raided the homes of union leaders and arrested the 
relatives of union leaders. Police raided the house of one employee 
who died recently. Despite being told this police arrested his son 
who has nothing to do with the industry. This is reminiscent of the 
tactics of the US army who take relatives as hostages when they raid 
houses in Iraq.

These brutal action follows the unilateral Government announcement of 
the restart of the privatisation process on 18 June and the 
deployment of the Signal Corps (a section of the military) to take 
over the running of the telephone exchanges. The restart of the 
privatisation process is in complete disregard for the agreement 
signed by the government which lead to a suspension of the strike on 
Friday 4 June where they promised the indefinite halt of 
privatisation.

In effect this is a lock out of the workforce since all workers from 
grades 1-16 in the industry are barred from entering the 
telecommunications depots.

However, the mood of the workers is even more solid than before. They 
have refused to accept improvements in pay and conditions which the 
managing director of Pakistan Telecommunications Company Ltd (PTCL) 
offered in the last couple of days. The value of the new package went 
up from Rs3.5 billion to Rs 5 billion but workers refused to be 
budged on agreeing to these enticements to accept privatisation.

One of the union leaders Haji Khan Bhatti said at a press conference 
in Karachi gave the government 24 hours to release all those arrested 
and to withdraw the restarted privatisation process. Another union 
leader Malik Maqbool said that the striking workers would shut down 
the telecommunications system from 15 June. He warned companies not 
to participate in the bidding process and said that if the process 
went ahead then the telecommunication workers would take action 
against this happening.

In Quetta, Balochistan, telecommunication workers have already taken 
action against the fibre optic link which is the backbone for much of 
the system in the province. 

It is vital that the government and management are flooded with 
letters of protest. There are signs of some frictions within the 
state in Pakistan over the question of the strike. An ex-Prime 
Minister of Pakistan has opposed the privatisation process in 
Parliament and the leader of the MMA (Muttahida Majlis-e-Amal - an 
alliance of Islamic parties in Pakistan) has said that if his party 
is elected at the next elections they will renationalise all 
industries privatised by Musharraf.

Letters of protest will widen divisions between the Privatisation 
Commission of the government who are most in favour of restarting the 
privatisation process immediately and the Ministry of the Interior 
who have shown signs of holding back in an all out attack on the 
telecommunications workers. These letters could also have an effect 
in holding back the government from making vicious attacks against 
the telecommunication workers.


Protests should demand:

- Release all telecommunications workers and trade unionists leaders 
taken into custody. Stop the crackdown now. No more arrests 

- For the immediate withdrawal of all paramilitary and police forces 
from in and around PTCL premises 

- Honour the 4 June agreement - No to the privatisation of PTCL 

- Full support to PTCL workers fighting privatisation

Subject: Maroccan Trotskyist in hungerstrike - request for help

Dear comrades,

At the university of Fes in Morocco 193 students are in hungerstrike now against privatisation of their universities. The hungerstrike and the protests are organised by the illegal National Union of Students in Morocco that is mainly build by members of maoist and trotskiyst organisations. The slogan of the hungerstrike is: "We are communists. We love life. But we are prepared to die for it!

Under pressure of the world bank the monarchist dictatorship wants to privatise the universities till 2009. Stipendiums are cut and students should pay money for their studies. The state even organised a special police for the universities, that collaborates with the secret service. 

With strikes and boycotts the students fight against the university reform. They boycotted the exams twice between December and March. In Fes this struggle goes on. Because of these protests eight students are in prison now with fines between four months and three years and they were heavily beaten by police. These students in prison are in hungerstrike, too, for beeing accepted as political prisoners with some privileges as free literature and visits without controll.

There are more social struggles in Marocco as well. Last week the state attacked a demonstration of people in the Rif area , who lost their houses in an erarthquake last year. The army throw pepper gas  from helicopters and shot with rubber amunition on the people, among them many children and women. The demonstration was for new houses and against the corrupt state, that has stolen most of the money for the earthquake victims. The alliance of houseless is organised by left wing people. The leader of this alliance was kidnappend by secret service before the demonstration. A trial will be May 26th.

In South Morocco, there were huge demonstrations against the privatisation of the health-sector. Among these demonstrations the Trotskyists had a leading role.

This Trotskyist movement has some links to the USFI, but they seem not to be an official section yet. Inside the supporters of Struggle there seem to be some criticism in the USFI-politics in Brazil and elsewere.

National Geographic Channel aired its new 60 minute movie "Dare to Explore" "Expeditions from the Edge: Iditarod" in May and will air it again. This film is monstrous hype carefully constructed to turn animal abusing Iditarod mushers into romanticized heroes. 

Less than one minute of air time was devoted to the terrible suffering the dogs endure in the Iditarod. At least six scenes dealt with mushers suffering frostbite in minus 49 degree to minus 99 degree wind chill. Although dogs get frostbite of the penis, flanks and other areas, this was never mentioned. The film didn't mention that many dogs suffer from bleeding ulcers, lung damage, ruptured disks, broken bones, paralysis, anemia, or various viral diseases, or that many dogs have died in the race.

Iditarod mushers were portrayed as daring adventurers and dog lovers. In an interview, Rick Swenson said, "I don't think that most people care any more about their children than we care about our dogs." Swenson was once banned from the Iditarod for killing his dog by making him run through waist-deep water and ice. The Iditarod later reinstated Swenson and made him a director.

Please tell National Geographic Channel, the film's sponsors and producers to stop showing this film and air one devoted to telling the truth about this horrific race.

Orlando Sentinel sports columnist George Diaz said the race is "an illegal sweatshop for dogs." USA Today business columnist Bruce Horovitz said the race is a "public-relations minefield."

At least 126 dogs have died in the Iditarod, including four who died in 2005 race. There is no official count of dog deaths available for the race's early years. And no one knows how many dogs die in training or after the race each year.

On average, 53 percent of the dogs who start the race do not make it across the finish line. According to a report published in the American Journal of Respiratory and Critical Care Medicine, of those who do cross, 81 percent have lung damage. A report published in the Journal of Veterinary Internal Medicine said that 61 percent of the dogs who finish the Iditarod have ulcers versus zero percent pre-race.

Tom Classen, retired Air Force colonel and Alaskan resident for over 40
years, tells us that the dogs are beaten into submission:

"They've had the hell beaten out of them." "You don't just whisper into their ears, 'OK, stand there until I tell you to run like the devil.' They understand one thing: a beating. These dogs are beaten into submission the same way elephants are trained for a circus. The mushers will deny it. And you know what? They are all lying." -USA Today, March 3, 2000 in Jon Saraceno's column

Mushers believe in "culling" or killing unwanted dogs, including puppies. Many dogs who are permanently disabled in the Iditarod, or who are unwanted for any reason, including those who have outlived their usefulness are killed with a shot to the head, dragged or clubbed to death. "Dogs are clubbed with baseball bats and if they don't pull are dragged to death in harnesses....." wrote Alaskan Mike Cranford in an article for Alaska's Bush Blade Newspaper (March, 2000).

Jon Saraceno wrote in his March 3, 2000 column in USA Today, "He [Colonel
Tom Classen] confirmed dog beatings and far worse. Like starving dogs to maintain their most advantageous racing weight. Skinning them to make mittens. Or dragging them to their death."

Please stop supporting and promoting this barbaric race. Tell people the truth about the cruelties the dogs endure.

Land-grabbing has become a national epidemic in Bangladesh. These land-grabbers are a powerful syndicate that have the money, muscle plus a lawless and utterly corrupt environment in Bangladesh, with all the right connections from administration to judicial and law-enforcing agencies that allow them to operate freely without any problem. They operate almost always in collusion with powerful politicians. Our property in 20 Zakir Hossain Road, Khulshi, Chittagong, Bangladesh, lived and owned by my family, with all the legal documents, payments of taxes and utility bills, for the last 47 years did not deter them from grabbing it. It is like a small investment for them with a chance of a phenomenal return on investment. They don't lose, but individual victims like us do. They also target vulnerable people like my parents - both in their mid-70s, and children living overseas. 

        All our pleas, including my trip to Bangladesh, and meeting with government agencies did not do anything to alleviate our suffering. Every passing day is worse than the day before. My aging parents who thus far were able to display a remarkable degree of fortitude, hoping that the system would rectify and come to their relief, have been broken down both mentally and physically. My mother had a 3 by-pass surgery a year ago. It is taking a devastating toll on our fundamental belief in goodness of human kind, of law and order, justice and fairness. 

        I am told that your collective and individual voice may make some difference. And Allah knows the best. So, if you feel that you ought to do something, here is a petition that I wrote, which you could sign and fax to Bangladesh Prime Minister's office. You are welcome to write your own. But my previous experiences tell me that not too many are willing to spend time in writing a note, so attached below is a sample draft.

MICHAEL FABRICANT (Con: Licfield, UK)

Mr. Fabricant is the Newchurch guinea pig breeders' MP. There is one
fundamental reason why Mr. Fabricant needs to be contacted: he has stated
in interview that he overtly disapproves of using animals to test
cosmetics. An obvious polite communication to him should then ask why has
he not been outspoken about the fact this family have bred hundreds and
thousands of animals specifically for that purpose for decades.

JANET DEAN (Lab: Burton, UK)

Sadly, Janet Dean MP is not the breeders' MP due to some logistical quirk
of fate but her thoughts and comments on this issue are important due to
the locality of her constituency. It is ligitimate that she is politely
made aware of our many objections to factory farming animals for
experimentation. It is particulary important in this case because Mrs.
Dean was overt in her disgust for fox hunting and voted for the ban. She
has supported EDM`s on welfare of greyhounds, banning snares,Japanese
dolphin hunts, primates in research, game birds, slaugher of companion
animals for food in China and lots more.

Since both MPs obviously have a firm grasp of the issues concerning
cruelty and animal sentience it remains shocking they would endorse the
mass production of animal life to test make-ups and shampoos - just one of
the many ways the Newchurch breeders factory farm the guinea pigs for
profit. There are some pointers below. Please contact them politely today.

In your communications please remind both MPs that this family of
Newchurch have:

Destroyed thousands of extremely sentient guinea pigs with their bare
hands because they were below money-making standards.
Caused the death of thousands more guinea pigs through their enforced
confinement and through malnutrition and neurosis.
Sent hundreds of thousands to be aimlessly killed in universities and
laboratories for wholly unscientific 'medical research'.
Their security guards have left several peaceful protesters needing
hospital treatment (including facial injuries and serious head wounds).
Proudly profited from an industry which has been directly responsible for
the deaths of thousands of human beings.
Sent hundreds of thousands more guinea pigs to be killed for indefensible
weapons research, product testing and cosmetic testing abroad (this
practice is already under the auspices of a UK voluntary ban because of
its contentious and immoral nature.)
