OTTAWA - A B.C. mining company has won a major legal battle in its bid to re-open a mine near Atlin, with the Supreme Court of Canada ruling the provincial government had consulted adequately with local First Nations in approving the project. In a landmark ruling, Canada's top court ruled Thursday that governments have a legal but limited duty to consult First Nations about the use of land, even where it involves unproven aboriginal claims.
