Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a
speedy and public trial, by an impartial jury of the state and district
wherein the crime shall have been committed, which district shall have
been previously ascertained by law, and to be informed of the nature and
cause of the accusation; to be confronted with the witnesses against
him; to have compulsory process for obtaining witnesses in his favor,
and to have the assistance of counsel for his defense.

Within forty years of ratifying the Federal Bill of Rights, the practice
of plea-bargaining had become common in violation of the 5th and 6th
Amendments.  Under plea-bargaining, a person is denied a speedy and
public trial by impartial jury and compelled to witness against himself
to lesser charges without confrontation of witnesses or access to
favorable witnesses, all without due process of law and often upon the
advice of counsel.  This is done merely to minimize the workload and
expenses of the court.  If a person should insist upon exercising his
right to a trial, such a right will be turned into a punishment of
harsher sentencing if the person should be found guilty.  Exercising the
right to not testify in the trial also weighs against the person rather
than for him.  The courts have therefore effectively nullified the 5th
and 6th Amendments for any innocent persons unable to afford the
competent legal counsel to be found not guilty.
