Subject: [six_nations_info] Update on Six Nations political prisoner Trevor
     Miller

*please forward widely*

Monday, December 11

At his bail review hearing today, Six Nations political prisoner Trevor
Miller was again denied bail, and has been remanded to the Hamilton
detention center until the date of his next hearing, which is not until
January 8.

The judge presiding over his bail hearing, was none other than the
notorious David Marshall, the same judge who owns large tracts of land
on Six Nations land and who has been biased against Six Nations in
earlier court hearings. (Marshall was the judge who issued the earlier
injunction against the reclamation site which led to the OPP raid. He
also repeatedly called for the OPP to enforce his decision to clear the
people of Six Nations from the reclamation site until his ruling was
overturned by a higher court.)

Appearing before the judge, Trevor stated that he was not a Canadian
citizen, but a Mohawk and a member of the Six Nations and argued that
the court had no jurisdiction over him. He asked to be allowed to leave
with his people and maintained that he was being held against the terms
of the two row wampum. Stuart Myiow of the Traditional Mohawk Council
then requested that Miller be released to the traditional Council which
will guarantee his appearance at all forthcoming court hearings. (There
is precedent for this as the Traditional Mohawk Council has intervened
in previous court hearings and had prisoners released to them.)

Judge Marshall claimed that he did not have the jurisdiction under
Canadian law to release Miller and that Miller must be treated the same
as everyone else. He advised Miller and his supporters that if they
disagreed with him their only recourse was to appeal his decision.

Over 40 supporters were present at the courthouse and they were firm in
expressing their support for Miller. Press interviews were held on the
steps of the courthouse, and a video of Stuart Myiow and Janie Jamieson
speaking to the press will be soon made available on the Autonomy and
Solidarity web site in the next 24 hours (check out http://auto_sol.tao.ca).

Community Friends, a group supporting the reclamation site and calling
for the release of Trevor Miller is organizing a protest outside of the
Hamilton detention center this Thursday from 5 p.m. to 6:30 p.m. At 6:30
p.m. that night we will march from the jail to Solidarity House (at 779
Barton St East) where a hot meal will be served and where we will hold a
public meeting of Community Friends (at 7 p.m.) to discuss how we can
continue to build a broad based campaign to support Trevor Miller, the
reclamation site and the people of Six Nations.

(The following link provides a map to the meeting location:

)

Finally, a group of Trevor's supporters including his friends and
families, are calling for a protest outside of the Attorney General's
office in Toronto on Monday, December 18. More details will be
forthcoming in the next few days...

Funds are urgently needed to pay for the legal costs
incurred by Trevor and his family in fighting these charges. Please make
checks payable to "Gertrude Miller" and mail them to P.O. Box
221, Ohsweken, N0A 1M0.
