VIOLATION OF CONSTITUTIONAL LAW AND INTERNATIONAL LAW REGARDING THEFT OF
KANIENKEHAKA (MOHAWK) TERRITORY
Ganienkeh and Akwesasne Mohawk Territories. Feb. 1, 2005. This is regarding
the extinguishment of Mohawk sovereignty and lands taking place today in
Albany. The news releases erroneously continue to refer to the three
municipal governments, "St. Regis Mohawk Council", the "Mohawk Nation
Council of Chiefs" and the "Mohawk Council of Akwesasne" as being
"sovereign".
They have no aspect of sovereignty. To the contrary they are sub-governments
of the United States federal government organized under and "subject to"
those federal laws.
They are municipal governments with social service responsibilities typical
to that form of government, namely, garbage collection, sewer and water,
sometimes policing. Their delegated duties are village or community
concerns.
This is profoundly contrasted with the concept of Indigenous sovereignty
which is vested solely in the Indigenous government organized under and
subject to the Indigenous constitution, the Kaianerekowa, backed up by both
the founding international law document Sublimis Deus, 1535, and the
Constitution of the United States of America, 1789.
The extinguishment of Indigenous sovereignty by these "federal Indian"
municipal government agencies is of genocidal consequence, in addition to
being unconstitutional.
Genocide - never again!
Constitutional law is the supreme law of the land. In order to commit the
fraud, based upon lesser federal law, New York State and the federal
government are disregarding the Kaianerekowa of the sovereign people, the
Mohawk Nation, the Longhouse People. They are also disregarding the U.S.
Constitution of the sovereign people of the U.S. Nation.
The Indigenous Longhouse labours under a positive legal obligation under the
Indigenous constitution, the Kaianerekowa, to prevent the unconstitutional
repeal of the Kaianerekowa by these traitors in order to make themselves
money as municipal agents of the federal government.
They are in the process of committing treason. It is the Longhouse's
constitutional duty to save these people from themselves. The Kanienkehaka
must defend Indigenous sovereignty against this final act of fraudulent
extinguishment. The land belongs to the citizens of the Mohawk Nation
Just like those Europeans - Scots, Irish, English, French, etc.- who come to
the United States and Canada, once they alienated themselves from their
original homelands, they become Americans or Canadians. Therefore, they no
longer have any say in the affairs of the country they left. This is the
same with Mohawk citizenship or any Indigenous person who alienates
themselves from their own nation.
We wish to tell the public that this signing of the so-called land claims
settlement to extinguish all traditional right and jurisdictions of the
Mohawk to New York State is a complete fraud. The federal government and New
York State have put in imposters to represent our people, people who have
abandoned their own governments and their own people and who are working as
U.S. and Canadian agents. We don't mind them being municipal employees under
federal law for the purpose of picking up the garbage and other municipal
functions, but no municipal government anywhere in the world can surrender
national sovereignty.
It is legally impossible under the rule of law for a municipal level
government to denationalize a nation. They are repealing the Kaianerekowa
and the US constitution simply by agreeing among themselves and the federal
and state bureaucrats to freeze out the constitutional law. They just simply
won't look at it. That is their modus operandi.
Their unconstitutional blindness to the law and to the rule of law has a
genocidal consequence upon this sovereign Mohawk people. It is the duty and
jurisdiction of the Mohawk national and international government under the
Kaianerekowa, with the support of the U.S. Constitution and the Supreme
Court of the United States to uphold the rule of law. We must stop this
attack upon our constitutional integrity by the federal, state and Indian
bureaucrats and their henchmen in the legal establishment who profit grandly
from the theft of our Indigenous country. This is a pure act of genocide by
taking this route to fraudulently extinguish our rights and title to our
lands.
