On the 19th November 2004, on Palm Island a community just off the east
coast of Townsville, Queensland, Australia an Aboriginal man by the name
of Cameron Doomagee was arrested for singing a song on a street in the
Palm Island Community, just over an hour and half later he was dead in the
police cell.
The arresting police were removed from the Island community.
Since then the Island community have been placed in a state of emergency
and over two hundred police were sent to the Island to clam the community
after the Coroner released the report on the autopsy of the deceased found
that the death was an accident.
Witnesses on Palm Island say other wise and now they fear for their lives.
The Palm Island community have now been isolated from the rest of
Australia and the press are giving misleading reports in regard to the
circumstances surrounding the death and the riots that prevailed after the
findings from the autopsy was released.
It was reported that the Queensland government and the Queensland Police
Force ordered for the Palm Island community to be air raided by two
military jets that were called off at the last minute.
The Aboriginal Australian People require justice and the handling of the
situation is getting out of hand. There are ten members of the Aboriginal
community on Palm Islanders that are currently in custody now and they are
being charged with attempted murder. The Aboriginal community of Australia
wants the officer that was responsible for the death of Cameron Doomagee
to be charged with murder.
Since the Royal commission into Aboriginal Deaths in Custody the
incarceration rate of Aboriginal Australia has escalated. The reason being
is that the outcome of the commission had no convictions and the message
that the police and prison guards is that they can get away with human
rights violations on Aboriginal Australians.
This breaches the Commonwealth Constitution Act 1901 (UK & commonwealth)
These discretionary powers breach Covering Clause 5 of The Commonwealth of
Australia Constitution Act 1901(UK and Commonwealth) in that CC5 states
This Act, and all laws made by the parliament of the commonwealth under
the constitution, shall be binding on the courts, judges, any People of
every state any of every part of the commonwealth.
Discretionary powers that the Commonwealth Government, the Federal and
State Police Forces, government departments, psychiatrists including the
Commonwealth Ombudsmens Office have given themselves is not only
discriminatory but is illegal.
Discretionary powers are illusionary self-appointed laws that perpetuate
corruption in every sector of society and are contrary to a law that is
binding and have been used against Aboriginal Australia since 1770.
It portrays one law for some classes and other law for others whilst
perpetuating the illusion of freedom, democracy, free trade and free
speech and implementing the capital system and class structures
The rule of natural law & Spirituality as practiced by the First Nations
of Aboriginal Australia, since the first sunrise unchanged, is above the
corruption that discretionary power foster. Wadjularbinna Elder of the
NIHRCA
The Discretionary Powers breaches the United Nations Declaration of Human
Rights and one of its uses is to incarcerate Aboriginal Peoples at a
higher rate than non-indigenous peoples. The Police forces are currently
the main offenders in using their discretionary powers on civilians, in
particular Aboriginal Australians.
So called freedom and democracy is a primitive illusion.
Wadjularbinna 2004
This is now a state of emergency for our Peoples and we are being isolated
from the rest of Australia. The witnesses are in danger and the police
have locked up Aboriginal People. They are in fear of their lives. Not one
Aboriginal leader has visited the Island and the National Indigenous Human
Rights Congress Australia is allowed to go to the island.
We need international press here as the Australian Press are not covering
it and they are only reporting what the police and the Minister of Police
Judy Spence wants them to.
For the Australian government to want to blow up an Island of Indigenous
Australians is attempted genocide. Why have they got our people now locked
up for attempted murder.
This is a cry for help for our Peoples. Michael Dodson and those that are
supposed to monitor human rights for our peoples are not doing a thing.
This is a Nation that is Screaming out for help. The Crown, commonwealth,
and the governments in Australia must be stopped. This is an International
outrage.
I hope that you can assist us in anyway. We require United Nations
repertoires immediately we do not trust the Australian government,
commonwealth and crown, they are killing us.
