Please come and support us in the courthouse! Bring your feather (any -
eagle, crow or gull) to Court. Our side has the morning to present our
case. Then it will be the City of Ottawa and the developers' turn.
Four individuals who appealed the City of Ottawa’s rezoning of Chaudière
and Albert Islands to the Ontario Municipal Board (OMB) will return to
court on Feb. 24, 2016 with a motion for leave to appeal the OMB’s
dismissal of their original appeals.

WHERE: Ontario Divisional Court, Motions Court. 160 Elgin Street. Room not
yet assigned. Ask at information desk on day of hearing. Case is called
Cardinal vs. Windmill, motion for leave to appeal OMB decision.

WHEN: 10 a.m. All spectators must pass through a security screening before
entering the courtroom.
The four appellants who are contesting the OMB’s dismissal of their
original appeals are: Douglas Cardinal, Romola Thumbadoo, Richard Jackman,
and Larry McDermott. A fifth appellant in the original OMB hearing,
Lindsay Lambert, has successfully convinced the Office of the Ontario
Ombudsman to investigate irregularities in the OMB’s dismissal of the
original appeals, and will not be part of this motion to appeal.

The OMB’s dismissal of the rezoning appeals was handed down November 17,
2015, even though the original OMB case did not go to a full hearing. It
was confined to a “pre-hearing” format, which was not documented in any
formal way. No transcript of the proceedings exists.

In launching an appeal of the OMB dismissal, grounds for doing so are
limited to “matters of law,” not to evidence that was presented during the
hearing. Based on this requirement, the appellants’ lawyer, Michael
Swinwood, will set out several grounds for the appeal. These arguments are
grounded in

- the Charter of Rights and Freedoms, which is part of Canada’s
Constitution, and especially related to the rights of Indigenous peoples,
and
- the United Nations Declaration on the Rights of Indigenous Peoples
(UNDRIP).

Background regarding City of Ottawa’s rezoning of islands violates
Indigenous sacred site:

During the OMB pre-hearings (June and August 2015), the chair of the
hearing refused to hear constitutional arguments based on land rights of
Indigenous people to the sacred site that includes Chaudière and Albert
Islands.

Although it is commonly accepted that large tracts of Ontario, and all
Crown land in the City of Ottawa, are on unceded Algonquin territory, the
OMB chair refused to entertain arguments that the rezoning of Chaudière
and Albert Islands by the City of Ottawa represents:

- an abrogation of Indigenous rights under Canada’s constitution, and
- an unwillingness to apply UNDRIP clauses that relate to inherent rights
of Indigenous peoples as set out in: Article 25: Indigenous peoples have
the right to maintain and strengthen their distinctive spiritual
relationship with their traditionally owned or otherwise occupied and used
lands, territories, waters and coastal seas and other resources and to
uphold their responsibilities to future generations in this regard.

Article 32 (1): Indigenous peoples have the right to determine and develop
priorities and strategies for the development or use of their lands or
territories and other resources.

Article 32 (2): States shall consult and cooperate in good faith with the
Indigenous peoples concerned through their own representative institutions
in order to obtain their free and informed consent prior to the approval
of any project affecting their lands or territories and other resources,
particularly in connection with the development, utilization or
exploitation of mineral, water or other resources.

Marlene Carter, a First Nations woman (from Onion Lake Cree Nation, SK)
has been held in seclusion at the Brockville Mental Health Centre Forensic
Treatment Unit since autumn of last year. We are demanding she be released
from seclusion!

On Feb 11, we held the Rally for Marlene Carter: End the Use of Seclusion!
at the Brockville Mental Health Centre, and raised awareness about
Marlene's plight. But Marlene is STILL in seclusion. So we are moving up
the chain of command, and this rally will be at The Royal Mental Health
Centre. Why? Because George Weber works there. He is President and CEO of
the Royal Ottawa Health Care Group, and the Brockville Mental Health
Centre where Marlene is being held in seclusion is part of this Group.
Weber calls the shots on how and where Marlene is treated while she is in
Ontario. So we will march to The Royal and rally there on 26 Feb!

If you can't attend the rally, here's another way you can help: write a
letter to George Weber. And CC The Honourable Ralph Goodale, Minister of
Public Safety and Emergency Preparedness, since Correctional Services
Canada falls under his Ministry. Note part of Minister Goodale’s Mandate
is: “Work with the Minister of Justice and the Minister of Indigenous and
Northern Affairs to address gaps in services to Indigenous Peoples and
those with mental illness throughout the criminal justice system.” (link:
http://bit.ly/20FemCm) The abuse of Marlene, a mentally ill indigenous
woman, is certainly a gap in service within the criminal justice system!
So Goodale and the Minister of Justice (Jody Wilson-Raybould) and the
Minister of Indigenous and Northern Affairs (Carolyn Bennett ) are on the
hook to address this situation, and should also be CC'ed.

BACKGROUND

Marlene has been subjected to seclusion before. This time she has been in
for about 3 and a half months! Also called isolation or solitary
confinement, what this means is she is alone in a tiny room with only a
bed and sink/toilet, no phone, TV, radio, or internet, no access to the
healing of the outdoors, and no shower (only given a cloth to bathe with).
Every moment she is subjected to this torture it reduces her chances to
heal her mental health! We must get her out of this inhumane and cruel
situation. Please help get the word out so we can get her out of
seculsion!

Beats Beat The Police

Join us on March 15 for a feast and spoken word and hip-hop concert!

We will also be commemorating the work being done to end police brutality
and to celebrate the people, groups and movements working for a world
without the violence of policing.

It will also be a launch for issue 25 of "The Abolitionist". This issue is
on POLICING. The Abolitionist is written mostly by prisoners, former
prisoners, and community advocates, and is a paper that discusses and
analyzes the prison industrial complex, in order to figure out what it
will take for us to realize a world without cages.

King Kimbit

Born as Thu Anh Nguyen in the nation’s capital, King Kimbit takes great
pride in her roots and heritage while recognizing that her home is here in
Ottawa, on unceded Algonquin territory. King Kimbit is the daughter of a
Vietnamese school teacher and a Vietnamese artist, both of whom escaped
Viet Nam by boat after the war. With her inherited artistic abilities,
King Kimbit has made a name for herself as a spoken word artist across the
country as well as in the United States. In 2012, King Kimbit was crowned
Champion of Urban Legends Poetry Slam as the first woman to have won the
series, and with that, went on to compete with the Urban Legends team in
the Canadian Festival of Spoken Word (the national level completion for
team poetry slam). In the same year, she was part of the Ottawa Youth
Poetry Slam project, who won provincials. Since then, King has been
featured in the Ottawa Versefest Women’s Showcase, and various shows
around the city. King Kimbit has also featured at the Union of North
American Vietnamese Students Association's Tenth Annual Conference in
Anaheim, CA and the 11th conference in Dallas, TX. King Kimbit is
passionate about working with youth and has facilitated poetry workshops
for youth in Ottawa, Vancouver, and Washington, DC. Aside from poetry,
King Kimbit also expresses her art through music. King Kimbit has been
singing since she was able to speak and grew up performing at events for
the Vietnamese community in Ottawa.
