Dear Friends and Supporters,

My husband, Mohamed Harkat, really needs your support.

As some of you may or may not already know, the public portion of Moe’s
security certificate hearing is going ahead, starting on Monday, Jan.
18th, 2010. Please pack the courtroom on Monday, January 18th, 2010 at
9:30am at the East courtroom of the Supreme Court of Canada building on
Wellington St. in Ottawa, and say NO to secret trials in Canada and the
continued use of secret evidence!

The public portion of the "hearing" is going ahead this January and a
decision will later be made on the "reasonableness" of the security
certificate against Moe. PLEASE PACK THE COURTROOM ON THE FIRST DAY and
attend on other days.

This is the final step for us. Please show your support by attending for
an hour or as long as you can.

Many of you have been there through the years, but we're not done yet!  We
would not have been able to do it without your continued support,
generosity and kindness. We are very fortunate to have such great
supporters who believe in fundamental justice.

 ADDITIONAL BACKGROUND AND HOW YOU CAN HELP

The past 7 years have been a roller coaster of emotions and a complete
nightmare. Moe was arrested on Dec. 10th, 2002 under a Security
Certificate, spent 43 months in jail without charge or access to the
evidence, and was later released on bail in June of 2006 under the
toughest conditions in Canadian history. We were both full time prisoners
in our own home (with surveillance cameras and GPS) and I a full time
jailer/guard to my husband. Those conditions were recently significantly
lifted after the government changed its tune and said that Moe was "no
longer" a big threat.

The first certificate against Moe was found "reasonable" in March of 2005,
but after lots of coordinated pressure from various individuals, groups
and organizations we later won a Supreme Court of Canada challenge in Feb.
2007 and got a second chance – and a second (unwanted) certificate.

After the Supreme Court of Canada ruled, the Harper government passed a
new bill with the addition of Special Advocates. Since the new process has
been in place, two security certificates have been quashed. While this is
good news, evidence continues to be kept secret, violating the rights of
detainees to a fair hearing. We hope to be third in line!

The past few months have been filled with significant events that have
raised questions for the court:

 -raid at our home (16 officers and 3 sniffing dogs) used for intelligence
gathering and risk assessment instead of to monitor conditions of
detention; CBSA took solicitor-client material during the raid

 -informant failed lie detector test prior to Moe's arrest

 -CSIS untruthful to the court about the credibility of the informant

 -Federal Court did not have all the "evidence" in front of them

 -Bail significantly lightened after new surprising risk assessment from CSIS

 -solicitor client calls were listened to by CSIS

We hope this year, starting off a new decade, will be the one in which my
husband can clear his name! We hope justice will prevail and that the
truth will come out. We will not stop until Moe clears his name of all
allegations and the certificate is quashed and behind us. We will not stop
until Security Certificates are abolished once and for all!

 In order for this to happen, we still need your support.
