Here is an overview of the week's main developments, ending with a renewed call for your much needed and deeply appreciated solidarity and support. ::::Harkat released!:::: The Federal Court ordered Mohamed Harkat released from prison on Friday (decision: http://cas-ncr-nter03.cas-satj.gc.ca/rss/DES402Order.pdf). He is again at home under house arrest with his wife Sophie Harkat. Though he has never been charged with any crime, let alone convicted, Harkat has been forced to live under an extremely repressive control scheme since his release from prison in summer 2006. Last Tuesday, Harkat was arrested at his home in Ottawa, as he took a shower, on allegations that he violated some of those bail conditions. The move on the part of the government exposed just how deeply invasive the conditions are - not only into Harkat's life, but into the lives of his entire family. The arrest, it turned out, centered on the love-life of Harkat's mother-in-law, who was literally called into court to account for where she sleeps. Though any real concerns on the part of Stockwell Day's Canadian Border Services Agency (CBSA) could have been resolved through discussion with the family, the CBSA chose the high-profile, media-worthy method of arresting Harkat instead. The arrest, and attendant media storm, came just two days before the Supreme Court hearing into the destruction of evidence in the Charkaoui file, and as Parliament prepared to vote on the "new" security certificate law. The timing, as Harkat's lawyers pointed out, was interesting. Harkat will be in court again on Monday, 4 February for a pre-scheduled bail review, in which he will ask the court to allow him to stay at home alone. The Harkat committee is asking people to come out to support Mohamed and Sophie (at Supreme Court building at 301 Wellington St.; court starts at 9:30am (arrive early for security). Further details on the Harkat website: www.justiceforharkat.com. :::::Holding the secret service accountable: Rally and Supreme Court::::: On Thursday, 31 January, Montrealer Adil Charkaoui was in Supreme Court in Ottawa for a second time, this time asking the court to consider whether the destruction of evidence in his file by the Canadian Security and Intelligence Service (CSIS) reveals bias in the inquiry that the spy agency has carried out against him. Charkaoui, his lawyers, and the six organizations who intervened in favour of Charkaoui left the court with optimism. If the Court ruling is positive, the certificate against Charkaoui could be quashed. Since CSIS systematically destroys records of interviews, the ruling could have a direct impact on other security certificate cases and even more broadly. Outside the court, people from Montreal and Ottawa gathered in solidarity with the individuals and communities targeted by CSIS profiling and harassment. Latifa Radwan, the mother of Adil Charkaoui, explained once again that all she was asking for was equal treatment for the five security certificate detainees, and an end to the racism against Muslims and Arabs which made her, a Canadian citizen, feel like she wasn't really a citizen. Ahmad Jaballah, oldest son of Mahmoud Jaballah, questioned how members of the Liberal party, "the party of the Charter", can go against their own beliefs and vote for a piece of legislation which so clearly violates the fundamental rights described in that charter. Ahmad asked all MPs whether they can live with participating in the destruction of the lives and imprisonment of entire families, such as his own. Mona El Fouli, married to Mohammad Mahjoub, made clear that the security certificate doesn't just oppress non-citizens, but also citizens like herself and her children; she called on MPs and all others in Canada to stand up and oppose C-3. Hassan Almrei, detained since October 2001, has no family in Canada to speak for him. Bill Siksay, a member of Parliament who has visited Almrei several times in prison, spoke powerfully in support of Almrei, calling for him to be released or charged and noting that solitary confinement and indefinite detention are always wrong. Because he has no family to assume the role of prison guards in a house arrest situation, Almrei remains in Guantanamo Bay north in Kingston, where he is now the sole prisoner. If C-3 passes, he could well remain there - without charge, trial or sentence - for endless additional years. Meanwhile, in Parliament, people who understand nothing of the reality of Hassan, Latifa, Ahmad, Mona, Sophie and their families, were in the process of making a decision that will determine their futures. The NDP introduced a motion to delete every clause in the proposed bill. This was quickly side-stepped, and, after a couple of hours of discussion, it was agreed to vote on the committee report Monday afternoon. If it passes that vote, the bill will move to third reading, where it will again be debated and voted. This could happen as early as Tuesday, 5 February. If it passes at third reading, it will go on to Senate. Normally the bill would go through the same process in Senate - first and second reading, committee hearings, committee report and third reading before it becomes law. However, the government has apparently introduced a motion to fast-track the bill, in the hope of passing it before the Supreme Court ruling striking down the old law goes into effect on 23 February. With the support of the Liberals, this motion could pass. The students, members of the radical campus group GrassRoots Association for Student Power (GRASP?), smeared themselves in red paint and lay still for ten minutes in front of a Canadian Forces table at the Technology Career Fair. "I don't think its right for military recruiters to be here at all," said Dave Howden, one of the participants in the die-in. "They're misleading students that the army is all about an exciting career and travelling the world." The recruiters stood watch during the action and did not talk with any of the protesters. In an interview after the die-in, Lt. Serge Abergel spoke politely of the protesters but defended his presence at the career fair. "It was polite, peaceful, no bad things to say about it," Abergel said, adding, "We are simply giving information about employment opportunities for over 107 different trades, not just infantry. We are not imposing that people join the military, nor have quotas to reach." Bystanders trying to make their way around the protesters said they were impressed by the die-in, but were not opposed to on-campus military recruitment. Other GRASP? members handed out flyers that challenged Canada's role in the Afghanistan occupation and argued against students enlisting to finance postsecondary education. Lt. Sean Frankham, who was also recruiting at the fair, defended serving in the army to pay for school. "That's how I got through school," Frankham said. "And there was never any problem with that." About 20 students attended the gathering, which fostered ideas on ways to eliminate military presence and influence at McGill. Focusing on government investment in the military and recruitment on campus, Vidal and Higgins presented results of research they completed on the relationship between universities and the military. Vidal, who opposes Canada's involvement in the Afghanistan occupation, asserted that government investments directed to the military should instead be used to pay for student tuition fees. "I don't want my tax dollars to go towards things I disapprove of, like people being killed in Afghanistan," Vidal said. The discussion proceeded to dissect how recruitment processes work, what kind of people they attract, and why. Students in the rank force must spend their summers at school, and attend a postsecondary institution for an additional five years after completing their enrolment. Higgins focused his presentation on changes that should be made to improve transparency in McGill's research policies, suggesting that the University make its harm evaluations publicly accessible and oppose confidentiality agreements with corporations. Apparently they have decided to fast-track in Senate. So this makes this appeal URGENT! THURSDAY AND FRIDAY: Saturate the Senate with Secret Trials Speaking Requests Be one of 500 organizations, individuals, unions and faith-groups across Canada requesting an appearance before the Senate committee scheduled to discuss new secret trials legislation WHO: You, an organization or an individual, concerned that there is new "security certificate" legislation that will continue the scheme of secret hearings, two-tier justice, indefinite detention without charge, draconian house arrest, and deportation to torture. WHAT: Write a letter and email it or fax it as soon as possible to the Clerk of the Committee, requesting to appear and stating why you want to speak to the Senate about the security certificate process. (details below) WHEN: Right now! Time is short! Apparently Senate plans to hold second reading vote tomorrow (Thursday), and, if it passes, refer it to the committee for hearings on Monday afternoon! So to be heard, you would have to apply immediately. Given the rather tight time-frame, hasty applications should be understood! WHERE: Hearings take place in Ottawa, but if your application is accepted, the government will cover your travel and accommodation costs. (The hearings are public, so if you are in the Ottawa area, attending them would be another way of showing public interest, even if your application isn't accepted.) WHY: A major role of the Senate (on paper, anyway) is to provide "sober, second thought" on the work done by the House of Commons. It was a full eight months after the Supreme Court ruled security certificates unconstitutional that the Harper minority government introduced a new bill that, save for some fancy-sounding window dressing, is the same as the old one. The House committee "examining" the new legislation, called C-3, sent it back to the House of Commons with less than three weeks of study, and almost no understanding of the dire human rights implications of passing this bill. The House of Commons obligingly passed the bill with hardly a debate on February 6. Now the Senate is being pressured to pass the bill before February 23, when the old law will expire: one week to not only have first, second, and third readings of the bill, but to also hold public hearings on it. Hardly an opportunity for sober second thoughts! There is in fact no legal obligation for a new law to be in place by February 23, and having the law expire would be a good thing. It could actually help to call the government's bluff: if they really have a case, why don't they do what the detainees have always requested, which is charge them and provide them a fair, open, public trial? If the government, with all of its resources and "intelligence" cannot even mount a case under criminal law, as they would have to for everyone else in the country, then it is clear that these men and their families should be allowed the freedom that was taken from them so many years ago. Although it is very unlikely that everyone who applies will be asked to speak, all letters received by the Clerk are translated and given to all Committee members, so it will be an important opportunity for them to see the breadth of popular concern. In addition, if this final push can delay the bill, the old law will run out, hopefully forcing the government to charge the detainees or free them. The camp was the creation of an autonomous space to voice solidarity with all those detained and opened a forum for collective discussions. Moreover, our actions in front of the Laval Immigration Detention Center where initiated in solidarity with movements fighting similar walls; from the US-Mexico border to Palestine.
