De prime abord, ce ?d?bat? ne reconna?t pas le fait que le Qu?bec et le Canada sont des entit?s ?tablies sur des terres vol?es aux Autochtones, et ce que ces entit?s se sont d?velopp?es ? travers la d?possession et le g?nocide de ces peuples, qui ont ?t? forc?s de ? s'accomoder ? au processus de colonisation. La Commission Bouchard-Taylor a ?t? mise en place dans un intense climat de x?nophobie, avec en toile de fond une campagne ?lectorale en qu?te de boucs ?missaires. La Commission a servi de plateforme incontest?e pour l'expression du racisme, de l'islamophobie et de l'anti-s?mitisme. Des politiciens ? l'opportunisme aigu ainsi que les m?dias de masse ont jou? sur les peurs et les pr?jug?s et ont manipul? de fausses controverses au sujet des pratiques religieuses et des diff?rences culturelles, dans le but de de cr?er un climat d'hyst?rie g?n?ralis?e, qui au fond est bas? sur peu ou pas de substance. ? l'int?rieur m?me de sa structure, ce ? d?bat ? a cr?? une dichotomie fondamentale entre le ? nous ? et le ? eux ?, le ? nous ? ?tant d?fini comme la population blanche de descendance europ?enne, et le ? eux ? s'appliquant ? diff?rents groupes d'immigrants racialis?s. Ce suppos? d?bat a permis l'expression publique et admise d'un sectarisme b?at, dirig? contre les communaut?s immigrantes et religieuses, tout en faisant usage de caricatures simplistes pour les r?duire ? des blocs homog?nes, monolithiques et fig?s. Nous rejetons ce portrait ? la fois simpliste et insultant de nos communaut?s, tout en r?affirmant la diversit? de nos cultures et de nos traditions, ainsi que de nos multiples identit?s ? l'int?rieur de celles-ci. D'une mani?re tr?s insidieuse, ceux qui s'identifient comme progressistes et comme f?ministes ont utilis? la Commission afin de promouvoir leur propre forme - plus sophistiqu?e - de racisme. Un racisme qui ignore les diff?rentes formes d'oppression ? l'int?rieur des soci?t?s occidentales et qui consid?re immanquablement le Qu?bec comme ?tant de facto une soci?t? ? pluraliste, d?mocratique et ?galitaire ? Alors qu'une rh?torique islamophobe et sexiste est utilis?e pour justifier la guerre ? l'?chelle mondiale, comme dans le cas de l'occupation militaire de l'Afghanistan, le Qu?bec a emprunt? une rh?torique semblable, centr?e autour de ce qui est sch?matiquement d?sign? comme ? les droits des femmes ?. Cette rh?torique d?shumanise syst?matiquement les cultures musulmanes, afin de justifier l'intol?rance au sein de ce ? chez nous?. Nous rejetons l'id?e que les femmes de foi aient besoin d'?tre sauv?es de leurs cultures fondamentalement oppressives et r?trogrades. Moreover, it completely ignores the fact that racism and white supremacy were intrinsically tied to the creation of both Canada and Quebec, and throughout their histories, have been instrumental in defining who "belongs" and who does not. The Bouchard-Taylor Commission was created in the context of xenophobia during an election campaign and has provided an uncontested platform for racism, Islamophobia and anti-Semitism. Opportunistic politicians and corporate media have appealed to public fears and prejudices, and manipulated false controversies over religious practices and cultural differences to create a generalized hysteria, with little to no basis in fact. In its very framework it creates a binary of 'us' vs. 'them'; the 'us' being made up of white people of European descent, and the 'them' being whichever non-white immigrant group is currently under the spotlight. The supposed "debate" has made open bigotry publicly acceptable, using simplistic caricatures that render our communities homogenous, uncontested and monolithic. While we reject this offensive portrayal of our communities, we assert the diversity of our cultures and traditions as well as our multiple identities. Insidiously, so-called progressives and feminists have used the Commission platform to promote their own sophisticated brand of racism, one that refuses to acknowledge the oppressions within Western society, and unquestioningly considers Quebec to be "pluralistic, democratic and egalitarian". While using rhetoric rooted in Islamophobia and sexism to justify war abroad, as is the case in the on-going military occupation of Afghanistan, Quebec has embraced the framework around the "rights of women" and the systematic dehumanization of Muslim cultures to justify intolerance chez nous. We reject the notion that women of faith need to be saved from their inherently oppressive and backward cultures, and instead we support the women who are on the frontlines of their own struggles for liberation, and subjects, not objects or victims, of their own transformation. As the Bouchard-Taylor Commission begins its public hearings in Montreal, we are organizing to openly and publicly reject the commission process and framework. To engage the Commission process is to validate its fundamentally racist premise, which is to stand judgment of immigrant communities. This Commission, sanctioned by the state, is a process of submission, whereby minority populations are forced to justify their very existence in Quebec. The way this debate is framed ignores all the current intolerance and injustice faced by many migrant communities in Quebec, while forcing them to defend themselves as "good Quebecois". We declare: Ni patrie, ni ?tat; ni Qu?bec, ni Canada! We refuse to submit to any form of nationalism. Instead, we organize by uncompromisingly putting forward a vision of social justice, rooted in day-to-day grassroots struggles. For those who don't remember, it was a protest to denounce the policies of the labor ministers of the G8 countries meeting in Montreal on this day. On the 13th of August 2007 , a class action was authorized by the Quebec Superior Court against the City of Montreal for damages incurred by the persons who were part of the group described above. In short, a class action enables a person who is a part of the group to pursue for damages on behalf of the whole group. In this class action there are two representatives: Francis Dupuis D?ri and Marjolaine Despars. If these two representatives are successful in their class action the whole of the group will benefit from the damages awarded by the Court. There are two main components to a class action. The first, which is a demand to authorize the class action is already over. The second will be the actual Court procedures for the action where it will be decided if the damages must be awarded. Bill C-3 was introduced by the Conservative government in October, as a response to the Supreme Court Charkaoui decision, which struck down the former security certificate regime as a violation of the right to life, liberty and security of the person. The court decision came after years of grassroots campaigning against the measure, in which family members of the detainees played a central role. The colourful march, complete with marching band and bright silk banners, wound through the largely immigrant, Muslim and Arab neighbourhood, chanting, "Dion, Dit Non!". Members of diverse organizations such as the Immigrant Workers Centre, No One is Illegal, the Canadian Muslim Forum, Quebec Solidaire, the NDP, CAIRCAN, Muslim Council of Montreal, the Maori Solidarity Committee, the Ligue des droits et libert?s and the Justice for Mohamed Harkat Committee, as well as Adil Charkaoui himself, successively took the mike to add their voices to the opposition to C-3. The government's proposed bill leaves in place a two-tiered system of justice in which non-citizens are denied the right to a fair trial. It does not meet a single one of the demands of the public campaign: under the new law, the government will still be able to detain non-citizens indefinitely without charge and threaten them with deportation to torture. The new law still denies the detainee access to the information used against them, fails to reject the use of information obtained under torture, permits the use of hearsay (gossip and rumour), and uses a low standard of proof (possibility instead of fact). If the law passes, it will further normalize this treatment, as well as institutionalizing a model (the "special advocate") which can help to legitimize increased use of secrecy in other areas of the legal system. Arriving at Stephane Dion's riding office, a delegation of community leaders presented an open letter to a representative of Dion's. Human rights organizations in Canada, including Amnesty International and the British Columbia Civil Liberties Association, have sued the government in the context of widespread media reports that prisoners captured by Canadian forces were facing torture in Afghan prisons. Last week a major decision was released by Canada's Federal Court, which ruled the lawsuit filed concerning torture in Afghanistan has grounds on which to move forward despite major legal maneuvers from government legal representatives to have the legal challenge thrown out of court. Currently Canada maintains over 2500 troops in Afghanistan, mainly in the southern province of Kandahar, in a military mission that the majority of people in Canada don't support, according to repeated opinion polls. Alex Neve, the Secretary General of Amnesty International in Canada, comments on the current Federal Court case and answers questions from Stefan Christoff... Alex Neve: Amnesty International has had long standing concerns with the approach that Canada has been taking to handling prisoners apprehended by Canadian forces in the context of conflict in Afghanistan. Canada has been deployed in Afghanistan since early 2002 and since then Canada has been taking prisoners. As a human rights organization we want to ensure that Canada is treating those prisoners in a way that is completely consistent with international human rights standards. Initially Canada decided that they would hand all prisoners over to U.S. forces in Afghanistan and Amnesty raised concerns on this matter given that there are many concerns related to U.S. practices in Afghanistan, including the fact that many of those prisoners were going to end up being held in Guantanamo Bay. Amnesty asked Canada to change and revise that practice. After several years the government finally decided to do so, but rather than taking the responsibility of taking the prisoners onto their own shoulders, they decided to turn to another country, this time Afghanistan itself and since the end of 2005 Canada's practice has been to hand the prisoners to Afghan authorities. Our concern is that in Afghan prisons torture is rampant and systematic, in which context in our view it's very likely that a good number of those who are transferred from Canadian custody into the Afghan prison system will therefore end up being tortured. If the risk of torture is a real one, which Amnesty believes it is, it's incumbent upon Canada and it's actually a matter of international legal obligation not to hand the prisoners over and to instead adopt some other approach, some other way of keeping those prisoners in custody that corresponds with international law. Stefan Christoff: Can you address the current legal challenge that Amnesty has launched in Canada, and explain Amnesty's role and specifically the Federal Court decision that was made this past week? Neve: Amnesty tried repeatedly to have this matter addressed through political channels, we repeatedly brought our concerns to the attention of the Minister of National Defense in particular, asking that Canada adopt a new approach, a new strategy and those requests fell on deaf ears. The government refused to revise its policy or practice in any way and in the end Amnesty felt that there was no other option but to turn to the courts for a remedy. Amnesty joined up with the British Colombia Civil Liberties Association, which shared our concerns, and we launched a lawsuit in February of this year in which we are seeking a Federal Court order that the practice of handing prisoners over to Afghan authorities cease. The Canadian government is fighting vigorously against our lawsuit and earlier last month we were in court responding to a government application to try to have our lawsuit summarily dismissed at the outset as being groundless. The government threw every possible argument they could at the court in what really seemed like a desperate effort to try to have the lawsuit thrown out of court before it receives a full hearing. On Monday [November 5], more quickly than expected, the Federal Court decision on that particular application came out and the government's application was unequivocally rejected on every count. It's a very strong judgment that underscores that the issues we have brought forward are important issues that are perfectly appropriate for a court to be looking at. Issues that are far from groundless and do involve very critical human rights concerns and on that basis the Federal Court has ruled that the case can go ahead and we look forward to a full hearing being set in the next two to three months, we hope. Christoff: Could you explain the details within the reports, the information that Amnesty International has received from the ground in Afghanistan regarding the situation of Afghan prisoners. Earlier this year there was a breaking story that was published in the Globe and Mail, written by Graeme Smith, detailing accounts of torture. Can you talk about the information that you have received that lead you to take action on this issue? Neve: Sadly there is nothing new about the proposition that torture is systematic and widespread in Afghanistan. This is not something that has suddenly emerged since the 2001 war and the new government; it is a long-standing concern and reality in the Afghan prison system, an issue that Amnesty International has documented and reported on publicly for many, many years. The particular concerns as to what happens to battle field prisoners who end up in Afghan prisons is a new issue. It's been very difficult to get clear information as to what is happening to those prisoners. From a Canadian perspective the government for instance refuses to identify who those prisoners are, refuses to give their names or any details. Also Canada refuses to allow them to have any access to lawyers, which makes it very difficult to do any specific research. Amnesty very much welcomed the great work that the Globe and Mail was able to do in terms of getting access to some of the prisoners after they had been released from Afghan prisons. In the course of that work the Globe and Mail documented some very serious and disturbing allegations of torture. Now, they haven't been proven but they are very detailed allegations that are certainly credible and consistent with other information that is available to us with regard to the practice of torture in Afghanistan and therefore is something that the government should be taking very seriously. Sadly instead, at every turn, from responding to questions in the House of Commons, or the kinds of arguments that the government lawyers have been advancing in court, instead the line that has been taken has been to try to diminish and dismiss out of hand these allegations because they come from "Taliban fighters" and therefore aren't worthy of consideration. The protesters proceeded back to the main lobby of the Congress Center, where security had earlier said the protest could continue unimpeded. But, after an eviction order, protesters began to leave. Without provocation, police targeted individuals for arrest. During the police attack, uniformed officers pushed and punched protesters, and used batons; several police had also drawn their taser guns. The protesters included small children, as well as elders, who were pushed. Ironically, one officer, who didn't have ID, identified himself as "Stante". When asked if he was Giovanni Stante, the officer said "yes". Giovanni Stante was implicated in the murder of Jean-Pierre Lizotte in 1999. St-Laurent (corner of St-Viateur) $5-10 or pay what you can ** :::::::::::::::::::::::::: --Featuring: A screening of ?Raise the Rates?, with an introduction from the film-maker, Liisa Schofield **Film synopsis Following the Ontario Coalition Against Poverty's (OCAP) campaign to raise social assistance rates in Ontario in 2005-2006, this documentary features first-hand accounts of 5 women involved in the campaign as well as footage from special diet clinics, demonstrations, and occupations. From powerful voices of people directly affected by the welfare system comes a demand to raise the rates, and a determination to fight back. (25 mins, en with fr subtitles, 2006) --Presentations afterwards from members of the Ontario Coalition Against Poverty (www.ocap.ca) and the Comit? des sans-emploi Montr?al Centre on building direct action campaigns against hunger and poverty from the ground up. If they don?t give you work, ask for bread. If they don?t give you work or bread, then TAKE the bread.? Now, 114 years later in Montreal, these words still resonate. Join us for an evening of discussion on anti-poverty struggles in Montreal and Toronto. While many politicians, community organizations, social workers, and charity organizations tell us to take the fight against poverty through ?legal channels?, ?respectable? organizations, and ?civilized protest?, we?re still fighting to put food on the table, and often not succeeding. We will be talking about grassroots, radical campaigns against hunger and poverty, which have challenged the notion of charity, and have built real relationships of solidarity, where struggle is rooted in the communities which are the most affected.
