However, an official of the Canadian Border Services Agency (CBSA) recently described her as "lawless". Katenies has questioned the authority of the Canadian courts, or any colonial courts and border officials, over Onkwehonwe (indigenous peoples) of Turtle Island. Other marchers gathered around the car out of concern for the violent way in which police were intervening. Police began hitting and pushing people indiscriminately. Emma Strople, a 17 year old marcher, was hit in the chest with the end of a night stick and thrown to the ground, by an officer later identified as Doyon. Her ribs were bruised, she was winded, trembling from shock and her knee was cut open enough that the blood seeped through her jeans. Two other women were also injured - one woman's lips and mouth were swollen and bleeding, from being punched in the face by a police officer; another left with cuts on her knee and stomach. On January 3rd, Six Nations Police, in accordance with the demands of the Ontario Provincial Police (OPP), arrested and imprisoned Chris Hill, a 20 year old young Mohawk man of the Wolf Clan from Six Nations of the Grand River Territory, for allegedly "assaulting a police officer with a weapon" on April 20th, 2006 ? the very day that the OPP and the RCMP invaded Douglas Creek Estates and violently attempted to evict the people of Six Nations from their land. That day, the OPP used tazer darts and batons on unarmed people, including women and youth, and arrested 16 people on a day that brought nation-wide attention to the struggle of Six Nations for land rights and autonomy. Since the Haudonausaunee of Six Nations reclaimed Douglas Creek Estates, some 30 indigenous people have been charged by the settler-colony of Canada in relation to the Reclamation. Chris Hill is one of the latest to be charged. Interestingly, the warrant for his arrest in relation to April 20th was issued 6 months later in October of 2006. Since January 3rd, he has been sitting in Barton Street Jail in Hamilton, Ontario where he is locked up for 18 hours a day. Chris Hill was denied bail on the basis of his record of "failure to comply" when he was a young offender. Chris Hill was denied access to legal aid on the basis of him not having a permanent address. His mother, Rhonda Martin, is a mother on assistance who just underwent surgery, and now faces lawyers' fees in the thousands in order to be able to free her son. Chris Hill sits behind bars for having defended his land. The proceedings at the Cayuga courthouse have proven to be extremely lengthy, as nearly all court appearances have resulted in remand after remand. Chris Hill needs moral, political and financial support and solidarity. Please send reading material and write letters of support to Chris Hill for him to receive while he awaits a trial date. The manual will guide Canadian Forces doctrine and training well into the future, according to a draft edition obtained by IPS. A 250-page publication, the field manual outlines the principles and practices of fighting the kind of insurgencies that have come to define warfare for the Western powers in the 21st century, in places like Chechnya, Afghanistan and Iraq. The manual has been two years in development and is scheduled for release later this year. In it, insurgent wars are characterised by their tendency to be local and often popular movements, rather than the traditional military conflicts between states. This type of irregular warfare has confounded U.S. and NATO forces in Iraq and Afghanistan respectively, where growing insurgencies have taken a bloody toll on local populations as well as Western troops, and signs of success are few and far between. The increased prominence of the doctrine was recently on display when Gen. David Petraeus, author of the United States Army and Marine Corp counter-insurgency field manual, took command of U.S. forces in Iraq in early 2007. While perhaps as relevant as ever, counter-insurgency is not new a phenomenon, as the Canadian manual notes up front. Indigenous forces battled the Roman Empire in present-day Germany, Scotland and the Middle East two millennia ago. The British Empire fought insurgencies in 19th-century Afghanistan, as did the French in Algeria after World War Two. The U.S. withdrew from Vietnam in 1975 after a vicious decade-long counter-insurgency war against Vietnamese guerrillas. Maj. Gen. D.J. Lambert, the Canadian director of army doctrine and lead author of the manual, has cited several examples of historic Canadian counter-insurgencies, including battles with George Washington's U.S. forces or the Northwest Rebellion led by Louis Riel and the Metis in 1885. Presently, while Canada's Afghanistan mission dominates the attention and resources of the military, according to the manual, Canadian Forces are actively engaged in various levels of confrontation with at least three ongoing insurgencies -- in Afghanistan, in Haiti, as well as with domestic indigenous organisations in Canada, such as the Mohawk Warrior Society. Despite its "specific and limited aims", the First Nations rebellions in Canada are nevertheless insurgencies because they are animated by the goal of altering political relationships with both the Canadian government and at the local level -- within indigenous reservations themselves -- "through the threat of, or use of, violence", the manual states. In recent years, Canadian Forces have been used by the federal government in high-profile land confrontations with indigenous communities and protestors, including lethal standoffs with the Mohawk community of Kanehsatake in the 1990 Oka Crisis and with the Ojibway community at Ipperwash in 1995. Canadian Forces have been present in the Haitian capital, Port-au-Prince, since before the ouster of popularly-elected President Jean Bertrand Aristide in a military coup in February 2004. According to the draft manual, Canadian Forces have been "conducting COIN [counter-insurgency] operations against the criminally-based insurgency in Haiti since early 2004." Since the attacks on New York and Washington in September 2001, Canadian Forces have played a key combat role in Afghanistan, both in the U.S.-led Operation Enduring Freedom and the recent NATO mission to quell the growing uprising against the Western-backed government of Hamid Karzai. Today in Afghanistan, Canadian Forces from the Royal Canadian Regiment in Gagetown, New Brunswick are engaged in NATO's first major offensive of the season against what are broadly labeled Taliban insurgents. Code named Operation Achilles, the mission is characterised by NATO and Canadian officials as a pre-emptive attack on Taliban forces in Helmand Province who are reportedly preparing to launch a "spring offensive" against the presence of foreign troops. Maj. Gen. Ton van Loon, NATO's commander in Southern Afghanistan, said in a statement this week that Operation Achilles is the largest combined NATO-Afghan mission to date, involving 4,500 NATO troops and upwards of 1,000 Afghan National Army forces at its peak. Meanwhile, an Afghanistan-focused policy group, the Senlis Council, released the "alarming" results of a survey this week which polled 17,000 people in southern and eastern Afghanistan. The survey showed that one-half of respondents believe the Western-led war will fail to defeat the Taliban, and 87 percent of respondents believed that the tactics used by the Western forces in dealing with the insurgency were "not right". "The results from the survey are extremely alarming because they indicate that the international community is in serious trouble in Afghanistan," Senlis Council president Norine MacDonald said in a statement Monday. "A return of the Taliban into power would have grave consequences for both the people of Afghanistan and for global security." The counter-insurgency manual is one part of a significant modernising and restructuring of the Canadian Forces that the DND is billing as an effort to create a more effective force in fighting for Canada's "national interests" in the post-Cold War global order. But the changes are not only doctrinal; the intensity of the combat in Afghanistan is something Canadians haven't seen since at least the 1950s, when Canadian Forces fought in Korea. "It is a fascinating time to be a Canadian soldier," Lt. Gen. Andrew Leslie, head of the army, told journalists at a recent policy briefing at the Fraser Institute, a conservative research institute in Vancouver. "We are no longer a blunt instrument relegated solely to watching from the sidelines or inter-positioning ourselves between two formerly warring factions," Leslie said. Canadian generals such as Leslie, Chief of Staff Rick Hillier and retired Maj. Gen. Louis MacKenzie have been outspoken critics of the accuracy and utility of the long-fostered national self-image of the Canadian military as a neutral middle-power and "blue-helmeted" peacekeeper. While the Canadian Forces commitment in Afghanistan is currently slated to end in February 2009, "Let's not kid ourselves," Gen. Leslie said. Mahjoub, Mona El Fouli (son ?pouse) et leurs deux enfants seront soumis ? la surveillance constante et intrusive de l'?tat. Mahjoub ne pourra jamais se trouver seul. Au domicile familial, Mme. El Fouli et son fils a?n? seront forc?s de jouer un r?le de gardien de prison. Tous les visiteurs devront ?tre autoris?s par l'Agence des services frontaliers du Canada (ASFC). Les policiers devront ?tre admis en tous temps, sans mandat. Pas d'Internet, pas de t?l?phone cellulaire, pas de communications par t?l?phone, sauf sur une ligne sp?ciale sous surveillance continue. Hundreds of people took to the streets and seventy-five organizations - a broad spectrum of networks such as ?chec ? la guerre, Solidarity across Borders, International Civil Liberties Monitoring Group, TCRI, AQOCI and NEFAC as well as major unions, student organizations, feminist groups, radical collectives, church-based organizations, community organizations, federal politicians, political parties, human rights organizations and many more (full list below) - supported the rally, with its five demands: 1. close "Guantanamo North"; 2. abolish security certificates; 3. free the security certificate detainees or provide them with a fair trial; 4. end deportation proceedings against the five; and 5. end deportations to torture. The rally took place on the second anniversary of the release from prison of Adil Charkaoui, who was subject to almost two years of arbitrary detention, and is now indefinitely subject to severe conditions in the name of "national security". It was Federal Court judge Andrew MacKay who first asked, in the course of one of Mahmoud Jaballah's hearings, if we had our own version of Guantanamo Bay here in Canada. Indeed we do: a place where law is suspended, where people are held in total uncertainty, threatened with torture, on the basis of racist profiling rather than anything they have done. Canada's Guantanamo took on physical form when a new prison opened in Kingston, Ontario in April 2006. A six-cell portable set up in the parking lot of the high security Millhaven Penitentiary, the Kingston Immigration Holding Centre (KIHC) was built specifically for security certificate detainees. Four non-citizens detained indefinitely without charge or trial on secret information were moved into this Guantanamo North in April 2006: - Mohammad Mahjoub, an Egyptian refugee and father of two, detained without charge since June 2000. - Mahmoud Jaballah, an Egyptian refugee and father of six, who was held 9 months in 1999, released, re-arrested in August 2001 on the same basis and held without charge ever since. - Hassan Almrei, a Syrian refugee held without charge since October 2001. - Mohamed Harkat, an Algerian refugee and married man, held without charge since December 2002. Moved to house arrest in July 2006. Guantanamo North represents a multi-million dollar investment into a legal black hole for immigrants; it is the physical embodiment of unjust immigration security measures. The security certificate process violates principles that are supposed to be basic to Canada's political system: presumption of innocence, right to a fair trial, right to liberty, right to protection from torture, and the right to equal treatment. Whether it consigns them to the Kingston prison or to house arrest, the security certificate process tramples on the humanity, dignity and liberty of these men and their families, keeping them in a nightmare of uncertainty and irrationality, subjecting them to highly publicized, vague allegations they are left powerless to challenge, indefinitely. Further background on Guantanamo North and the recent hungerstrikes: www.homesnotbombs.ca/Reality%20Check.pdf. *SUPREME COURT VICTORY The Supreme Court of Canada ruled on 23 February 2007 that the security certificate process was unconstitutional, re-affirming that the right to a fair trial applies to everyone in Canada. This was a real victory and attests to the power of public mobilization to create a climate in which courts - which had previously upheld the legislation - cannot ignore injustices. However, the Supreme Court gave the government another year before the law (sections 33 and 77 to 85 of the Immigration and Refugee Protection Act (IRPA)) falls. Thus, for at least one more year, the "secret trial five" and their families will be in the position of having to remain in prison or under house arrest, by virtue of a law that has now been recognized by Canada's own court system as illegal! It is more true than ever to say that the detainees and their families are trapped in a place with no law. The Harper government's response to the victory was predictable: they announced plans to introduce new security certificate legislation. The most likely scenario is that they will try to push through a new law modelled on a system in place in the UK. In this system, a security-cleared lawyer has access to the secret evidence and is mandated to act as an advocate on behalf of the detainee. This 'special advocate' system is very far from abolition, and it is very far from a fair trial. In fact, the special advocate model fails entirely to address several core problems with the security certificate process: - It continues a two-tier system of justice in which the freedom of non-citizens can be infringed more easily than that of citizens; - It doesn't address the fact certificates are based on vague and broad allegations aimed at capturing people on the basis of their profiles rather than any tangible acts that they may have committed or plan to commit; - It does nothing to reverse the burden of proof, which falls squarely on the shoulders of the detainee; and - It leaves in place the possibility of indefinite detention or indefinite house arrest. Furthermore, the proposed reform does not even adequately resolve the one aspect of the security certificate regime that it purports to address - the secrecy of the evidence - because it: - does not allow for a proper defence, as the advocates are not allowed to divulge the secret information to the detainees; - does not permit legal counsel of one's choice - instead, the advocate is appointed by the government, which is not even neutral, but one of the parties in the case; and - prevents the advocates from speaking out if they become aware that secret evidence was unlawfully obtained (for example, obtained under torture). In many ways, the introduction of a special advocate would only worsen the situation by providing a veneer of legality to a process that remains fundamentally unjust. *HOUSE ARREST: THE NEW GUANTANAMO A week before the Supreme court victory, a Federal Court ordered that Mohammad Mahjoub should be transferred to house arrest. The conditions that are imposed on him and his family are horrific. Mahjoub, Mona El Fouli (his wife), and their two children will be under constant, intrusive surveillance by the state. Mahjoub will never be allowed to be alone. At home, El Fouli or her oldest son will be forced to play jail guard. All visitors will have to be screened and approved by the Canadian Border Services Agency (CBSA). Police are to be allowed access at any time, without warrant. No internet, no cell phone, no telephone except a specially installed line under surveillance. Mahjoub will only be allowed to go out three times a week, with prior approval by the CBSA, for a maximum of four hours at a time. The crowning humiliation is the GPS-tracking bracelet. In effect, Mahjoub and El Fouli's home is being transformed into a prison, and El Fouli is forced to become a prison guard, while herself placed under scrutiny and surveillance. Two weeks after the Supreme court decision, Mahmoud Jaballah was ordered released under a similar package of conditions. Mahjoub and Jaballah are currently waiting to be transferred to house arrest in the coming weeks. Almrei remains in Guantanamo North, and has not asked for release on such conditions. Mohamed Harkat and Sophie Lamarche have already been living this situation since July 2006. The Charkaoui family find the conditions under which Adil was released to be humiliating, a constant, wearying source of stress and fear, an enormous constraint on their ability to enjoy their leisure time, to work, to practice their religion, to live and flourish. How much more impossible the restrictions which have been imposed on the other families. The danger is that this new form of detention - with its intrusive surveillance, arbitrary constraints on liberty, and indefinite nature - may become normalized in Canadian society. *WHERE NOW FOR THE CAMPAIGN TO ABOLISH SECURITY CERTIFICATES There is much to do over the next months, as the government moves to introduce new legislation and the security certificate detainees and their families remain in prison or under heavy surveillance and severe restriction of their liberty. Five cells are empty in Guantanamo North, which some in the government may be tempted to fill. The Coalition will continue its campaign to close Guantanamo North, abolish the security certificate, free the five, end deportations to torture, and end the racist scapegoating of the Muslim and Arab communities in Canada. That day, the OPP used tazer darts and batons on unarmed people, including women and youth, and arrested 16 people on a day that brought nation-wide attention to the struggle of Six Nations for land rights and autonomy. Since the Haudonausaunee of Six Nations reclaimed Douglas Creek Estates, some 30 indigenous people have been charged by the settler-colony of Canada in relation to the Reclamation. Chris Hill is one of the latest to be charged. Interestingly, the warrant for his arrest in relation to April 20th was issued 6 months later in October of 2006. Since January 3rd, he has been sitting in Barton Street Jail in Hamilton, Ontario where he is locked up for 18 hours a day. Chris Hill was denied bail on the basis of his record of "failure to comply" when he was a young offender. Chris Hill was denied access to legal aid on the basis of him not having a permanent address. His mother, Rhonda Martin, is a mother on assistance who just underwent surgery, and now faces lawyers' fees in the thousands in order to be able to free her son. Chris Hill sits behind bars for having defended his land. The proceedings at the Cayuga courthouse have proven to be extremely lengthy, as nearly all court appearances have resulted in remand after remand. The contingent stopped at the Canadian forces recruiting station to highlight ongoing anti-recruiting efforts by local student and unemployed workers organizations, as well as at Chapters Books, where the current boycott of the Chapters-Indigo chain, for their connections to Israeli apartheid, was highlighted by speakers from Tadamon Montreal and the International Solidarity Movement (for more info about the boycott campaign, consult: http://www.caiaweb.org/node/137 ). WHY WE'RE PROTESTING ... Conservative Minister of National Defence, Gordon O'Connor, is speaking this April 3, 2007 at the posh Queen Elizabeth Hotel, sponsored by Montreal's Council on Foreign Relations (CORIM), as well as several war-profiteering corporations. O'Connor is in Montreal as part of an ongoing Conservative public relations campaign to sell the Afghan mission to the Canadian public. O'Connor himself used to work for multi-national public relations firm Hill & Knowlton, the same firm that fabricated atrocities in the lead-up to the attack on Iraq in 1990. O'Connor recently described Canada's presence in Afghanistan as "retribution" for the death of Canadians at the World Trade Center on 9-11. He misled the public about the treatment of Afghan prisoners who face torture and death. He is a former General who prior to joining cabinet in 2006 spent eight years as a paid lobbyist for the military industry. Canadian troops are in Afghanistan to allow more American troops to be in Iraq. Gordon O'Connor, along with Stephen Harper, Stockwell Day, Michael Fortier and others in the Conservative cabinet, are the main Canadian apologists for George Bush's "War on Terror". They hide their true agenda behind the language of "development" and "democracy" (and strategically exploit compliant government-funded "NGOs"). A Minister of Defence who justifies Canada's role in Afghanistan in the language of revenge, who is in the pay of military contractors, and who speaks to an audience of war-profiteering businessmen and politicians at a pretentious hotel, deserves to be actively protested and disrupted. WHO IS SPONSORING O'CONNOR'S SPEECH? The main sponsors of Gordon O'Connor's $90/plate lunchtime speech are several companies that profit from war; they include the following Quebec-based companies (all citations are from their public documents and websites): -- SNC-LAVALIN (455 Ren?-L?vesque Blvd. West), who until 2006 sold bullets to the American military for use in Iraq, and who maintain many military contracts thru various subsidiaries.
