Charkaoui : La GRC ouvrir une enquête au sujet fuite d'un document secret

Montréal, 3 juillet 2007 - La Coalition Justice pour Adil Charkaoui a
accueilli favorablement la décision du gouvernement de demander à la GRC d'
entamer une enquête de la GRC au sujet de la fuite d'un document secret dans
le dossier Charkaoui. La décision de demander une enquête policière a été
annoncée dans une lettre reçue par les avocates de Charkaoui vendredi passé.
La lettre signale également l'ouverture d'une enquête administrative, ainsi
qu'une évaluation de l'impact de ces événements sur les procédures devant la
cour.

La Coalition avait demandé une commission d'enquête sur la source de la
fuite d'allégations secrètes contre Charkaoui dévoilées par le journal La
Presse le 22 juin.

La Coalition demande également la tenue d'une enquête publique sur les
agissements du Service canadien du renseignement de sécurité (SCRS) dans l'
affaire Charkaoui, et au ministre de réviser et de retirer sans délai le
certificat déposé contre Charkaoui.

« Cette fuite n'est pas arrivée par hasard. Nous voulons savoir qui l'a
provoquée, qui a confirmé l'authenticité du document secret et pourquoi.
D'ailleurs, ce n'est pas la première fois qu'un tel coup bas est utilisé. C'
est pourquoi nous demandons une commission d'enquête publique sur les
agissements du SCRS dans le dossier Charkaoui", a dit Mary Foster, membre de
la Coalition justice pour Adil Charkaoui.

"Lorsque le Journal de Montréal a révélé en avril dernier que Ressam avait
retiré ses allégations contre Charkaoui, la Coalition, soutenue par des
groupes de défense des libertés civiles, groupes communautaires et des
membres de tous les partis d'opposition du Parlement, a demandé qu'une
révision révision juste et transparente du certificat de sécurité qui a été
signé contre Adil Charkaoui soit menée. La Coalition demandait aux ministres
responsables de retirer le certificat de sécurité contre Charkaoui, de lever
toutes les restrictions auxquelles il est soumis et de laver son nom de tout
soupçon suite à cette révision. Ce denier abus qui rappelle fortement la
fuite d'informations secrètes révélées par Juliet O'Neill, journaliste au
Ottawa Citizen, dans l'affaire Maher Arar, et qui fait suite à une série d'
embarras pour le gouvernement dans le dossier secret de Charkaoui, prouve
encore davantage la nécessité de procéder à une révision du certificat", a

La fuite vient au moment où Charkaoui se prépare à contester les activités
du SCRS à la Cour suprême par rapport à la destruction de preuves dans son
dossier. L'appel sera entendu par la Cour suprême en janvier 2008.

En février 2007, la Cour suprême du Canada a reconnu que le processus des
certificats de sécurité était inconstitutionnel. La Cour a donné un an au
gouvernement avant que la loi - sections 34, et 77 à 85 de la Loi sur l'
immigration et la protection des réfugiés - ne tombe. La Coalition s'est
jointe à d'autres organisations pour demander au gouvernement de s'abstenir
d'introduire une nouvelle loi des certificats de sécurité. En attendant,
Adil Charkaoui, comme Mohamed Harkat, Mahmoud Jaballah et Mohammad Mahjoub
sont libérés sous de sévères conditions ou en détention à résidence et
demeurent sous la menace constante d'une déportation. Hassan Almrei est
toujours détenu dans la prison "Guantanamo Nord" à Kingston.

RCMP to open inquiry into leak of secret document in Charkaoui case

Montreal, 3 July 2007 - The Coalition Justice for Adil Charkaoui is pleased
by the government's decision to ask the RCMP to open inquiry into the leak
of secret information in Charkaoui's file. The decision to ask the RCMP to
open the investigation was announced in a letter received by Charkaoui's
lawyers this
past Friday. The letter also stated that an administrative inquiry would
take place, along with an assessment of the impact of the incident on court
proceedings.

The Coalition demanded a police investigation into the source of the leak
when the Montreal newspaper La Presse printed allegations from a secret
document on 22 June.

The Coalition is also calling for a public inquiry into the actions of the
Canadian Security Intelligence Service (CSIS) in Charkaoui's case, and for
the Minister to review and withdraw the certificate issued against Charkaoui
without delay.

"The leak didn't happen by accident. We want to know who leaked it, who
confirmed the authenticity of the secret document and why. At the same time,
this is not the first time that dirty tricks have been played. That is why
we are now calling for a public inquiry into the actions of CSIS in
Charkaoui's file," said Mary Foster, member of the Coalition Justice for
Adil Charkaoui.

"When it was revealed by the Journal de Montréal in April that Ahmed Ressam
retracted his allegations against Charkaoui, the Coalition, supported by
civil liberties groups, community organizations and members of Parliament
from all opposition parties, called for a fair and transparent review of
Charkaoui's security certificate. The Coalition asked the Ministers
responsible to withdraw the security certificate against Charkaoui, drop all
the conditions against him and clear his name of all suspicions subsequent
to that review. This latest abuse, which strongly recalls the leak of secret
information to Ottawa Citizen reporter Juliet O'Neill in Maher Arar's case,
and which comes after a long string of embarassments for the government in
Charkaoui's unravelling file, makes the need for the Minister to take this
step all the more apparent," added Foster. (For background, see

The leak came as Charkaoui prepares for a second Supreme Court hearing, this
time on the grounds that CSIS destroyed evidence in the file. The Supreme
Court will hear the appeal in January 2008.

The Supreme Court of Canada recognized that the security certificate process
is unconstitutional in February 2007. The Court gave the government one year
before the law - sections 34, and 77 to 85 of the Immigration and Refugee
Protection Act -- falls. The Coalition has joined other organizations in
calling on the government to refrain from introducing new security
certificate legislation. In the meantime, Charkaoui, as well as Mohamed
Harkat, Mahmoud Jaballah and Mohammad Mahjoub remain under severe conditions
or house arrest as well as continued threat of deportation, while Hassan
Almrei remains in "Guantanamo north" prison in Kingston.
