Pendant qu'ils organisent des guignol?es, les riches et les poss?dants mangent des repas gastronomiques dans les plus grands restaurants du monde. Le comit? des sans emploi, bien qu'il reconnaisse l'important travail qu'accomplissent les centaines d'organismes communautaires qui distribuent de l'aide alimentaire, refuse d'accepter la charit? comme une solution valable au probl?me de la faim. Food-grab!***** -->Tuesday, December 4, 2007 -->11:30am SHARP! -->1710 Beaudry street (metro Beaudry) Ten years ago, a commando-bouffe ("food grab") hit up the chic restaurant Le Montrealais in the Queen Elizabeth Hotel in Montreal to re-appropriate a whole buffet and share it with more than 100 people who came to support the action. In December 1997, more than 800,000 people were living on welfare in Quebec, and the food banks were overloaded. The Comite des sans emploi organized this action to denounce this situation and to demystify the good consciousness operation of the "guignol?es" (Christmas-time charity collectors) around the holiday season. Today, 10 years later, the problem of hunger in Quebec has not gotten any better: -275,000 families per month accessed food banks, amongst which 1/3 were single-parent families (in Montreal, 84% of these families are lead by women!); -3 million food baskets were distributed and 16 million meals were served per year by 971 community groups; -52% of people who accessed food banks were welfare recipients, 13% were low-income workers, and 4.5% were on employment insurance. These figures come from the Association Quebecoise des Banques Alimentaires et des Moissons (AQBAM), and from Statistics Canada. Hunger is one of the worst symptoms of poverty generated by the capitalist system, a system which produces social and economic inequalities which are necessary for its survival. The political and economic elites sing the mantra that we have to create wealth before it can be distributed, while at the same time telling us that we don't work enough. But nothing could be further from the truth! We work like maniacs and we're still hungry! Those who work today are poorer than in 1997. But in 10 years, the wealth of the 5% of the richest people in the province has risen considerably. Their part of the total wealth has risen from 21% in 1992 to 25% in 2004. While they're organizing charity drives, the rich are eating luxury dinners in the biggest restaurants. The Comite des sans emploi, while recognizing the important work which is accomplished by certain community organizations which distribute food aid, refuses to accept charity as a viable solution to hunger. This charity, which has been literally built into a system, does nothing except put out fires, as well as assuaging the consciousnesses of the rich. We refuse to accept that there are hundreds of thousands of people who are starving to death while others are stuffing their faces full. This popular education initiative aims to build collective knowledge on Canada's role in the Middle East, while creating spaces within the context of Quebec's student movement for developing collective strategies to confront war and racism both at home and abroad. In Palestine, Canada openly supports Israel's colonial military occupation, in Lebanon the Conservative government endorsed the 2006 Israeli attack, labeling the bombardment, in which numerous Canadians died, a 'measured response'. Today in the Middle East Canada is not neutral. Tadamon! Montreal, L'Association pour une Solidarit? Syndicale ?tudiante (ASS?), with the support of the F?d?ration nationale des enseignantes et enseignants du Qu?bec (FNEEQ) and the Quebec Public Interest Research Group (QPIRG) are organizing a series of workshops in November 2007 as the world marks the 60th anniversary of the partition of Palestine, a foundational moment to the ongoing dispossession of the Palestinian people. At a time of war this popular education initiative will attempt breakdown the political, economic and military motivation for Canada's participation in the 'War on Terror', while building solidarity within the Quebec student movement with anti-colonial struggles in the Middle East, which the Canadian state plays a role in suppressing. Canada's political support for Israeli apartheid, silent complicity towards the US-lead military occupation of Iraq and major military role in southern Afghanistan, place the Canadian state on the front-lines of an international war which attacks the self-determination of the people of the Middle East. The unionists remain in custody in a detention facility near Seoul, and face removal. There are more than 200,000 so-called "illegal" or undocumented migrant workers in South Korea, from Bangladesh, Nepal, Pakistan, China, Burma, the Philippines, Vietnam, Indonesia and elsewhere. They do what are described as the "3-D jobs" ("dirty, difficult and dangerous"). Migrant workers started arriving in South Korea in large numbers just prior to the Seoul Olympics in 1988. La violence politique La constante dans la situation des droits humains au Mexique, au cours des douze derniers mois, est la violence politique. Violence qui se convertit en une mani?re de gouverner. Violence ? laquelle ont recours les structures du pouvoir afin de se maintenir en place. Le fameux contrat social, duquel parlaient avec tant d??loquence des philosophes comme Rousseau, Hobbes ou Locke, s?est rompu. Ce pacte social, qui fait r?f?rence ? l?acceptation hypoth?tique de l??tre humain de renoncer ? ses droits pour les remettre ? des "professionnels" qui se chargeront de la mission de gouverner en son nom, n?est plus pertinent pour une part significative de la population. La crise de l?gitimit? a p?n?tr? toutes les sph?res de la soci?t?. Son apog?e r?cente, plus que son origine, a ?t? la fraude ?lectorale de 2006. Il n?y en a pas encore assez des promesses de toujours; la confiance de gens dans le syst?me ?conomique, les institutions du gouvernement et dans les fonctionnaires est ? questionner. Voici qu?intervient la violence politique, rien de nouveau pour les peuples d?Am?rique Latine, mais accentu?e l?ann?e pass?e au Mexique. Cette violence politique, au contraire de ce qu?on pense fr?quemment, n??mane pas seulement de l?Etat mexicain ou de ses corps r?pressifs, comme la police ou l?arm?e. La violence politique trouve plut?t ses origines dans les plans m?me du syst?me n?olib?ral. Comme le disait si bien Gandhi, la pire violence est la faim et la mis?re. La violence politique ne se trouve pas seulement dans les plans du mod?le ?conomique, mais aussi bien dans la mani?re de r?aliser ces plans. Un exemple indubitable de cela est le fait d?imposer les m?gaprojets d?infrastructure, violant directement les droits collectifs, reconnus internationalement dans des d?clarations comme la Convention 169 du Bureau International du Travail (BIT). Finalement, la violence politique r?side aussi dans le fait d?emp?cher la r?sistance ? ces plans, autrement dit dans la r?pression. Voici la face la plus visible de la violence politique, mais non pour autant la seule(1). Le droit le plus fondamental: le droit ? la vie Au Mexique, les douze derniers mois ont ?t? marqu?s par une augmentation extr?mement pr?occupante de la violation des droits humains. Le contexte des ?lections f?d?rales fortement contest?es en juillet 2006, la d?nonciation de la fraude ?lectorale la mobilisation sociale qui s?en sont suivies, ainsi que la prise de fonction d?un pr?sident vu comme ill?gitime, bien que "l?gal", ont contribu? ? cr?er un climat d?instabilit? politique qui s?est assorti d?une crise ?conomique du pays. La violation des droits ?conomiques, comme la droit ? une vie digne et sans pauvret?, continue de marquer la r?alit? de la majeure partie de la population mexicaine. L?inflexion de la croissance ?conomique du pays (? la derni?re position en comparaison des r?sultats des pays d?Am?rique Latine [3,2% contre 5% en 2007(2)]), est le r?sultat des profits concentr?s entre les mains d?une minorit?, sans que se fasse la redistribution correspondant de ces b?n?fices au sein de la population. Le fait que l?homme le plus riche du monde soit mexicain et qu?en m?me temps 50% de la population vit dans la pauvret?(3) illustre cette absurde r?alit?. Ainsi, le mexicain Carlos Slim, gr?ce ? ses monopoles, est pass? du rang de troisi?me homme le plus riche du monde (avec une fortune de 30 milliards de dollar en mars 2006) ? la premi?re place avec 59 milliards de dollar en ao?t 2007(4). Selon les donn?es de l?Institut National de Statistiques, G?ographie et Informatique (INEGI), un cinqui?me de la population mexicaine concentre 52,7% des revenus totaux g?n?r?s par la soci?t?. Le pouvoir d?achat des salaires mexicains persiste dans sa tendance ? la baisse depuis l?entr?e du Mexique dans le syst?me ?conomique n?olib?ral, avec le pr?sident Miguel de la Madrid. De 1980 ? 2007, l?inflation a ?t? quatre fois sup?rieure ? l?augmentation du salaire minimum(5). Cette perte significative de pouvoir d?achat s?est accentu?e cette ann?e ; pendant que le salaire minimum n?augmentait que de 4% pour 2007, durant les neuf premiers mois du nouveau gouvernement du PAN (Partido de Acci?n Nacional, parti du pr?sident, ndt), le prix moyen du panier de biens de base ("la canasta b?sica") s?est ?lev? de 34,17%, selon une mesure du Procureur F?d?ral pour le Consommateur et le Minist?re de l?Economie. Ainsi, le prix de la tortilla a connu une augmentation de plus de 60% en janvier 2007(6). Cette augmentation exponentielle ?tait ? pr?voir ?tant donn? l?abandon de la cha?ne de transformation depuis le ma?s ? la tortilla aux libres forces du march?, ? travers l?ouverture commerciale, le retrait des subventions ? l?agriculture et la privatisation des fonctions de la Conasupo d?sormais aux mains des entreprises multinationales comme Maseca, Cargill, ADM et Minsa(7). Ces derni?res ont profit? du pr?texte de l?augmentation de la demande en ma?s pour la production de biocombustible pour augmenter les prix de la tortilla, diminuer le prix d?achat aux producteurs et argumenter en faveur de la n?cessit? de l?galiser les productions transg?niques, pour ainsi pouvoir ?tre comp?titif sur le march? international(8). L?accentuation de la crise ?conomique des familles mexicaines est clairement illustr?e par l?augmentation constante de l?immigration, de mexicains et mexicaines qui se d?placent de leurs communaut?s pour subvenir ? leurs besoins et ? ceux des leurs. Les chiffres officiels du total des ?migrants, ? cause de leur nature "clandestine", sont vari?s. La Banque du Mexique estime ? 583 mille le nombre d??migrants en 2006(9); alors que le Conseil National de Population (Conapo) ?tablit que pour 2005, on a d?j? d?pass? les 600 mille(10), et ajoute qu?"actuellement, la perte de population caus?e par la migration est plus importante que celle due ? la mortalit?"(11). Fin 2006, la Conapo a affirm? que le chiffre de la migration mexicaine augmenterait de 40% en 2007(12). Confirmant cette r?alit? brute, le Fond de Population des Nations Unies (UNFPA pour le sigle en anglais) a r?cemment reconnu le Mexique comme la nation qui conna?t le plus fort indice migratoire du monde. Autrement dit, le Mexique, avec une population totale de 105 millions, d?passe l?Inde (1,100 millions) et la Chine (1,300 millions) pour le nombre net, et non proportionnel, de personnes qui se voient forcer ? migrer pour survivre. Avec le mur de la fronti?re que les Etats-Unis continuent de construire, alors que les d?bats sur une suppos?e "r?forme migratoire" se prolongent, les migrant(e)s doivent traverser des zones extr?mement dangereuses, et les chiffres de morts ? la fronti?re continuent de cro?tre. Depuis le d?but de 2007, pour le moins 224 migrants mexicains sont morts sur les rives du fleuve Rio Bravo et dans le d?sert de l?Arizona, r?gions rattach?es aux consulats mexicains de Brownsville, Texas et Tucson, Arizona, selon leurs consuls respectifs. La majorit? de ces morts sont des chiapan?ques(13). Pendant ce temps, le gouvernement de Calderon se propose de continuer l?expropriation de terres et de territoires autochtones et paysans avec les m?gaprojets du Plan Puebla-Panama (PPP). La relance de ce plan d?infrastructure en avril 2007 s?est fait dans un contexte de fortes violations des droits de l?homme, donnant ainsi le ton des temps ? venir sous le gouvernement de droite de Calderon. Cette r?pression qui vise ? prot?ger les m?gaprojets dans le contexte de relance du PPP a inclus, par exemple, la d?tention ill?gale de Rodolfo Ch?vez Galindo, conseiller du Conseil des Ejidos et Communaut?s Oppos?s au barrage de la Parota (CECOP); la r?pression et la d?tention s?lective de jeunes anarcho-punks pendant la marche contre la Mine San Xavier, dans l?Etat du San Luis Potosi; et l??tablissement d?un d?tachement de la Police F?d?rale Pr?ventive (PFP) ? Juchitan, Oaxaca, pour pr?server les int?r?ts du couloir ?olien de l?Isthme de Tehuantepec. La normalisation de la violence "Quand je passe avec mes s?urs et que les soldats sont en train de se baigner, ils nous crient de les regarder, et nous invitent ? venir nous baigner avec eux (-), nous partons en courant" - Leticia, 12 ans. (14) Cette recrudescence des violations des droits humains s?est caract?ris?e par une violence politique qui a p?n?tr? toutes les sph?res de la vie politique et sociale du pays, nous menant sur le chemin de la normalisation de la violence. Cherchant ? se l?gitimer comme pr?sident du Mexique, Felipe Calderon dirige l?arm?e mexicaine vers une guerre ouverte contre le narcotrafic. Produit de cette croisade, nous pouvons voir le d?ploiement de troupes militaires sur tout le territoire national. Comme on le sait bien au Chiapas, la pr?sence de forces militaires dans les communaut?s est la cause de graves violations des droits humains. Cette op?ration militaire n?est pas une exception. En plus d??tre un ?chec total, puisque la violence due ? la vente de drogue au d?tail s?est envol?e comme jamais et que les flux de drogue vers les Etats-Unis augmente de fa?on continue, ce d?ploiement militaire confirme une fois de plus les s?v?res violations des droits humains commises par l?arm?e(15). Ces violations incluent l?assassinat de civiles, comme celui qui a eu lieu le 1er juin de cette ann?e, quand des ?l?ments de l?arm?e ont ouvert le feu sur un v?hicule qui suppos?ment r?sistait ? un contr?le ? un poste militaire au Sinaloa, tuant ainsi deux femmes et trois enfants(16). Nous avons ?t? t?moins aussi de tortures physiques et d?abus sexuels dont ont souffert des personnes d?tenues arbitrairement, comme dans le cas de quatre mineures, d?tenues en mai, dans l??tat du Michoac?n, et qui ont ?t? viol?es par des militaires. Produit de cette militarisation, la violence contre les femmes s?est accentu?e. Pour ce dernier type de violation des droits humains, nous nous limitons ? citer l?exemple de cette indig?ne nahua de 73 ans, Ernestina Ascenci?n Rosario, qui a ?t? viol?e sauvagement, tortur?e et assassin?e par des militaires dans la Sierra de Zongolica, ?tat de Veracruz. R?cemment, l?ombudsman de la Commission Nationale des Droits Humains (CNDH), Jos? Lu?s Soberanes, a ?mis une recommandation qui cl?t le dossier, et dans laquelle il r?it?re la version - cr??e par diverses institutions du gouvernement au niveau f?d?ral, de l?Etat et municipal - comme quoi "il n?y aurait pas eu de violation sexuelle et que son d?c?s ne serait pas d? ? un homicide". Selon la CNDH, la mort de cette autochtone, qui a eu lieu le 26 f?vrier dernier, a ?t? caus?e par une "an?mie aigu?"(17). Comme le mentionne Eugenia Guti?rrez, "Dans un pays o? la Commission Nationale des Droits Humains falsifie ses propres enqu?tes et remplace le terme "homicide" par celui de "gastrite", et o? le diagnostic du m?decin l?giste est ?mis depuis Los Pinos (palais pr?sidentiel, ndt), il serait dangereusement na?f d?esp?rer que les instances de procuration la justice fasse correctement son travail"(18). En plus du travail que fait la CNDH pour arranger la r?alit? afin que le gouvernement puisse se montrer sous son meilleur jour devant la communaut? internationale, les soldats coupables de ces violations sont jug?s au sein de la juridiction militaire, perp?tuant ainsi l?impunit? de ces aberrations. Cette campagne militaire de Calderon met en p?ril l?int?grit? de l?arm?e comme institution. On a justifi? le recours ? l?arm?e dans cette op?ration avec l?argument que la majorit? des institutions polici?res au Mexique est li?e au narcotrafic. N?anmoins, charger les forces arm?es de missions polici?res n?est pas seulement une violation directe de la Constitution Mexicaine(19), mais cela expose l?arm?e ? la "contamination" par le narcotrafic (? supposer qu?elle ne l?est pas d?j?). Comme le signale ? juste titre l?anthropologue Gilberto Lopez y Rivas, "? travers de la suppos?e lutte contre le narcotrafic et le terrorisme, Calderon approfondie le processus de militarisation croissant et de modernisation des forces arm?es, dans le but de les rendre plus appliqu?es dans la r?pression et la contre insurrection"(20). Dans ce sens, nous assistons ? la cr?ation de groupes d??lite de forces arm?es, comme le Corps de Forces d?Appui F?d?ral, regroupement sp?cial d?intervention qui est sous les ordres directs de l?Ex?cutif et qui a comme mission d?appuyer la "restauration de l?ordre et de la s?curit? publique"(21). De la m?me mani?re, le gouvernement de Calderon cherche ? consolider l?appareil r?pressif de l?Etat avec de nouveaux organismes comme le "Groupe Central de Surveillance de la Subversion", auquel participent le Minist?re de la D?fense Nationale (Sedena), le Procureur G?n?ral de la R?publique (PGR), le Minist?re de la S?curit? Publique (SSP) et le Centre de Recherche et de S?curit? Nationale (Cisen)(22). Selon le premier Rapport d?activit? du Secr?taire de Gouvernement, Francisco Ramirez Acu?a, ces groupes de coordination travaillent depuis d?cembre 2006 dans la d?nomm?e "Agence Nationale des Risques" pour entreprendre "des actions dissuasives et correctives face [-] ? l?activit? de groupes subversifs au Mexique, comme de leurs organisations de fa?ade". De m?me, le rapport fait ressortir que "on a fait le registre et le suivi de manifestations li?es au terrorisme international, au trafic de personnes et ? la corruption: surveillance des flux migratoires et permanence du syst?me d?alerte face aux menaces terroristes avec intention d?intrusion sur le territoire national"(23). La ASPAN et la s?curit? impos?e Cette situation de pratiques anti-constitutionnelles dans l?arm?e, qui m?ne ? des violations des droits humains, menace de s?accentuer avec l?annonce r?cente de nouvelles formes de collaboration entre Washington et le gouvernement mexicain, sous pr?texte de lutte contre le narcotrafic et le "terrorisme". Cette ann?e, les n?gociations autour du Partenariat nord-am?ricain pour la s?curit? et la prosp?rit? (PSP, connu comme l?ASPAN au Mexique) se sont renforc?es suite ? plusieurs r?unions des ex?cutifs du Mexique et du Canada avec George W. Bush. Au cours de ces r?unions s?est r?v?l?e la v?ritable nature de cette "alliance", dont les accords sont confidentiels. L?ASPAN se pr?sente maintenant comme un trait? de libre commerce approfondi, puisqu?il ajoute aux accords commerciaux n?olib?raux l?aspect s?curitaire pour les grandes corporations multinationales. Cette "s?curit?" des int?r?ts ?conomiques inclue la consolidation des forces r?pressives, mais aussi l?acc?s s?curis? aux ressources ?nerg?tiques et naturelles du Mexique et du Canada. C?est dans ce contexte que s?est faite l?annonce du plan de coop?ration bilat?rale Etats-Unis - Mexique, baptis? "Initiative M?rida" (que certains analystes appellent d?j? "Plan Mexico"). Ce nouveau plan reprend le mod?le du "Plan Colombie", ? savoir une politique contre insurrectionnelle dessin?e par Washington et qui a impliqu?, entre autre, l?envoi de 4,3 milliards de dollar au gouvernement colombien depuis son lancement en 2000, dont 76% ont ?t? destin?s ? l?arm?e(24). De la m?me mani?re que le pr?sageait le Plan Colombie, les fonctionnaires insistent aujourd?hui sur le fait qu?il n?y aura pas d?ing?rence sur le territoire de la part des soldats am?ricains. Ils assurent que le quasi milliard et demi de dollar pr?vu pour les trois premi?res ann?es du plan se limitera ? la livraison de mat?riel militaire (a?ronefs pour transporter les groupes d??lite), ? la technologie d?espionnage et de vigilance et ? d?autres types d?entra?nement(25). N?anmoins, la pr?sence de personnel militaire am?ricain et de "contractuels militaires" (lire ?mercenaires?) sur le territoire colombien est bien connue, et nous pouvons nous attendre ? la m?me chose pour le Mexique. Ainsi, il est important de reconna?tre que les forces polici?res et militaires des Etats-Unis op?rent d?j? au Mexique, non seulement de mani?re clandestine, comme elles l?ont toujours fait, mais bien ouvertement avec des programmes de "formation" ? destination des forces mexicaines. Par exemple, en faisant le suivi de l?entra?nement offert aux effectifs du Minist?re de la S?curit? Publique (SSP) et de l?Agence Etatique d?Investigations (AEI) du Chiapas par le FBI, en f?vrier 2007(26), en ao?t il y a eu une visite du FBI et de la DEA pour former les niveaux sup?rieurs et interm?diaires de commandement de la police municipale et de l??tat du Chiapas(27). De plus, recevoir de nouveaux ?quipements et technologies militaires implique aussi de recevoir une formation pour son utilisation de la part des entreprises du complexe militaro-industriel qui les fabrique, ainsi que de "contractuels priv?s" comme Halliburton, Lockheed Martin, SNC Lavallin ou Blackwater. Comme le signale ? juste titre l?analyste Miguel Tinker Salas, travailler avec ces arm?es priv?es sp?cialis?es en tactique de contre insurrection a la m?me fonction au bout du compte: soumettre le Mexique aux plans de s?curit? du Pentagone. Dans cette premi?re partie, nous avons analys? la violence politique contenue dans les plans du mod?le n?olib?ral et dans la mani?re de mettre en place ces plans. Dans la seconde partie de ce bulletin, nous analyserons la face la plus visible de cette violence politique: la r?pression. The move has prevented Canada Border Services Agency from deporting Singh who showed up inside the cab. The deportation, scheduled last Monday, which coincides with International Human Rights Day, prevented border and immigration agents from taking custody of him. Border authorities concluded that it would be too risky for its agents to walk out to a waiting taxi in which the elderly man was sitting. As many as 2,000 protesters, mostly members of an Abbotsford-area Sikh temple, rallied in support of Singh. "For safety and security reasons Mr. Singh's removal has been delayed," Derek Mellon, a CBSA spokesman said, adding that the agency wouldn't discuss publicly any future attempts it may make to remove him. Singh's reprieve became known a couple hours before, after CBSA officials told Vancouver International Airport's operations centre that they'd bent to the will of protesters and temporarily lifted the deportation order. The decision was made shortly before a Cathay Pacific flight to Hong Kong was supposed to take off with Singh on board. But in effect, Singh's removal was all but impossible after his taxi was surrounded by people who refused to let him be taken into YVR's international terminal. CBSA told leaders of the protest that they wouldn't go out to the taxi and retrieve Singh because they believed people would get violent, according to one of the leaders. Harsha Walia, a protest leader, said CBSA was trying to cast Singh's supporters as violent but she admitted that if officers were to try to get to him they would face angry crowds. The drama started when the South Asian-Canadian community flexed its considerable muscles, promising to abandon the Conservatives and boycott any airline that participates in Singh's deportation. And there was even talk of passengers on the flight standing up as conscientious objectors, preventing the aircraft from leaving the gate. The government was seeking to deport Singh, who entered Canada from India in 2003 traveling on phoney documents and later suffered a stroke that left him a quadriplegic. Despite an outpouring of support from Abbotsford's Sikh community, he lost all subsequent appeals to remain in Canada, and the government said he didn't have any "significant ties" to the community. But supporters who surrounded his taxi said he's got an entire community willing to look after him, and one business has even offered to put him on their payroll. Supporters were told that two doctors had certified Sunday night that Singh, who spent the night in Surrey Memorial Hospital, was unfit to fly. Walia said those letters had been delivered to CBSA with no effect. The temple that had offered sanctuary and had put up a $50,000 bond to ensure Singh would be at the airport on deportation day, said it has now stepped out of the picture and he is being looked after by others. Swarn Singh Gill, the president of the Gurdwara Kalgidhar Darbar Sahib Society, said the temple had fulfilled its promise to CBSA to deliver Singh to the airport, but now it was up to others to help the paralysed man. "I talked to CBSA and they agreed we had carried out our promise," Gill said. "It is now for others to decide what happens. If we take him back, we're afraid CBSA will come in the night and say "let's grab that guy when nobody is looking." However, there was no shortage of offers to help. While Gill looked on, a cluster of protesters and leaders of other temples conferred with each other about where Singh should go. "The Abbotsford temple says they don't want to take him back because of CBSA and the police," said Maninder Gill, one of the protest organizers, who owns Radio India. "The community is planning now where we can take him, to one of the temples." Maninder Gill said he had offered to repay the federal government $408,000 it says it has spent on Singh's medical bills, as well as $125,000 a year to ensure that Gill wouldn't be a burden on Canadian taxpayers. The government hasn't responded to his offer, he said. For his part, Singh looked frail and somewhat confused about what was going on around him. Sitting in a wheelchair in the back of the taxi, his legs covered in a blanket, the man looked gaunt and ill. When asked by a reporter what he thought about what was going on, he could barely talk. A translator said Singh was pleased at the support, and did not want to go back to India, where his future is uncertain. Walia, from a group called No One Is Illegal, said CBSA had told her it had released him back to the community pending further arrangements. "They said his deportation has been stayed for now and that they will be in touch with his legal counsel," Walia said. A dozen RCMP officers stood at the rear of the crowd waiting patiently for instructions as YVR management tried unsuccessfully to convince protesters to move aside. Throughout the day protesters, many who carried placards, chanted slogans against the federal Conservative government, which they accused of cruel behaviour for insisting Singh return to India where they say he would die without medical treatment. "Is the Canadian government going to continue with an unjust deportation or are they going to hear us?" asked Walia. "We will boycott any airline that takes him back," said Harpal Nagra, another protest organizer, to cheers from the crowd. It was the federal government that got the roughest treatment, as protesters roared thunderously when Nagra said they should all vote for someone else in the next federal election. "It will be known as Violation of International Human Rights Day after this, if they take him," said Hajap Grewal, one of Singh's supporters. Singh's arrival was carefully orchestrated. The temple that sheltered him delivered him to the airport, but refused to help him in, saying it was the responsibility of CBSA and its medical team. "We delivered him to the airport at 11:30 as CBSA told us to, but they have to go and get him with their medical team," said Surdev Singh Jatana, the general-secretary of the Gurdwara. "He's got the support of the entire community." Airport security managed to reroute people arriving at the departure terminals but the upper level road remained blocked by protesters right until Singh's taxi left for a trip back to Abbotsford. It remains unclear who is looking after him. When the protest started, security turned around dozens of cars, buses and taxis stuck behind the crowd and diverted all other arrivals to the Level 2 one floor below. YVR officials said no flights were delayed because of the protest. The crowds had thinned out by 2:00 p.m., when airport officials announced the temporary stay of the deportation order. Five-hundred protesters and supporters stood by as the flight that Singh was to leave on closed its check-in. The flight, scheduled to leave at 2:30 p.m., left on time. The deportation of a paralyzed Indian refugee last Dec 10 has drawn strong protest from Indo-Canadian communities and supporters who have failed to convince the Canadian government for his release on humanitarian grounds Laibar Singh, 48, was deported Monday by the Canada Border Services Agency but his supporters, including community groups, politicians and the Hospital Employees Union, described the deportation as a death sentence. Singh entered Canada in November 2003 on a fake passport. Brain aneurysm struck Singh when he was working as a labourer in the Lower Mainland until he became a paraplegic. "The community at large is very concerned," said Surdev Singh Jatana, a member of the Abbotsford Sahib Kalgidhar Darbar temple where Singh took sanctuary before he was to be deported. The Indo-Canadian communities have strongly requested the government but failed to give Singh a chance to have a better life than no life in India."His applications for refugee status, a judicial review of his failed claim and an exemption on humanitarian and compassionate grounds have all been refused. Singh, was ordered deported in June, a day before his first removal order, set for July 8, he was whisked to sanctuary at the Abbotsford temple. He remained there until when he was taken to hospital after developing an infection. Nine police officers and border guards later arrested him before he could return to the temple. Supporters, who included Liberal MP Sukh Dhaliwal and Jane Dyson of the B.C. Coalition for People with Disabilities, said Singh should be allowed to stay in Canada pending review of his deportation order on humanitarian grounds. NDP MLA Harry Bains and several members of various ethnic and community groups expressed support to Singh. "We have been very explicit in saying there has been immense and overwhelming support for him," says Singh's lawyer, Zool Suleman. "To vacillate in the face of so much outpouring of support of this man seems to be a rejection of [the government's] responsibility. Update and January 25-26 Days of Action to End Secret Trials in Canada UPDATE AND CALL TO ACTION The final Parliamentary vote on the "new" security certificate process, Bill C-3, expected to take place earlier this week, was postponed at the 11th hour, and will not be considered until the week of January 28, 2008. Congratulations to everyone who marched, participated in community delegations, sent emails or phoned MPs - together, we have won the first round in the fight against new security certificate legislation! But there is still much to do. PUBLIC OUTRAGE STALLS THE BILL! After the Conservatives made a major point of trying to ram the bill through the House before the holiday break, one might conclude that their apparent reticence to put the bill to a final vote was in part due to public outrage and pressure and perhaps what the polls were telling the government (the Conservative Party, it was revealed yesterday, has spent $31 million on polling since coming to office, an average of two polls per business day while in office). MPs' offices were reportedly fielding 'dozens and dozens' of calls last week from people all across the country, coming on the heels of several months of popular action against the new legislation. The conclusion of most major Canadian legal associations, civil society groups, and advocates that the bill would not even pass a Charter challenge may also have left the Conservatives (and their Liberal supporters) with cold feet. NEW BILL ALMOST A MIRROR OF THE OLD LAW C-3, like the old security certificate section of the Immigration and Refugee Protection Act, will still allow for continued use of arbitrary arrest, indefinite detention without charge on secret suspicions, and deportation to torture. It addresses none of the core demands of the public campaign. The minority Harper government took almost eight full months to come up with C-3. In a vote supported by both the Bloc and the Liberals, Parliament handed the bill to the "Public Safety" committee for a review that lasted only two and a half weeks. Only as a result of public protest were the hearings slightly opened up, but, in the end, there was not enough time to seriously ask why the law was necessary, or explore the outstanding submissions of groups calling for abolition of the security certificate. Before passing it back to Parliament for third reading, the committee made three token amendments which did not change the fundamentally flawed nature of the bill. Parliament will not open again until January 29. If Bill C-3 then passes Parliament, it will go on to Senate, where it will pass through the same process - first reading, second reading, hearings in a committee, and then third reading and the final vote. Regardless of whether the new law is ready, the Supreme Court's suspended decision will finally go into effect on 23 February and the old security certificate process will die. NEXT STEPS: THE FEAR FACTOR AND A CAUTION AGAINST C-3 "FIX-IT"s After six years of public campaigning to end secret trials and two-tier justice, during which the Supreme court declared the security certificate process to be unconstitutional, the detainees and their families are now facing new legislation which, if implemented, will only prolong the extended suffering they have already experienced, and ramp up the fear that they will be deported to torture. Given that the Conservatives may now have awakened to the fact that it is untenable to pass a law that has already been evaluated as unconstitutional by so many individuals and groups, they may try to tinker with it and add a few more pieces of window-dressing related to the "special" advocate. It is important to resist attempts to "fix" what is a fundamentally flawed and unfair law. Adding in "protections" will help get the bill through the House, but do nothing to help those who are subjected to this draconian process. In calling and lobbying MPs, it is important to reject the notion that "special" advocates will save the day. Discredited in the UK, the special advocate system not only sets a dangerous precedent that opens the door to further secrecy in a variety of government proceedings, it also fails to meet the basic challenge the Supreme Court of Canada launched last February when it declared the security certificate process unconstitutional: How does one meet a case that one does not know? MPs and "special" advocate supporters may bring in the fear factor that, should the law expire, chaos will erupt and the "security" of Canadians will be at risk. This is total nonsense. If those subject to the security certificate are suddenly free from detention or without the draconian restrictions that keep them and their families under house arrest, the government can do what it should have done all along, and what it would have done if they had happened to be citizens: if there is a case against them, charge them under the Criminal Code, allow them to see the case against them, and provide them with a fair and open trial. C-3, however fixed, will only continue two-tier justice in Canada, and continue to subject some people to indefinite detention under threat of deportation to torture. JANUARY IS THE MONTH! Over the next month and a half, it is vital that we put greater pressure on the MPs - particularly Liberals - who will be voting at the end of January, as well as make a popular approach to the unelected Senate. Friday, December 21 12:00 noon to 1:00 pm The Israeli Consulate Peel & Rene Levesque Since Monday, December 17, in a series of air strikes that are continuing, Israel killed 24 and wounded dozens of residents of the Gaza strip leaving some of them with severed limbs. Israeli air strikes in the past also bombed crowded streets and markets in Gaza -- Gaza is the most densely populated place on earth -- resulting in many civilian casualties. Israel's policy of extra judicial assassinations is illegal under international law, and is a violation of the Fourth Geneva Convention, to which Israel is a signatory. It would be naive to accept the Israeli claim that this is in retaliation against the homemade shells fired from Gaza across the border into Israel. A truce arranged by Hamas and adhered to by all Palestinian resistance factions in Gaza last year did not result in any lessening of Israeli attacks. In fact, Israeli assaults and invasions into Gaza increased after Hamas declared the ceasefire. The Palestinian people in Gaza live under complete Israeli control of all their borders: land, sea and air space. They have been imprisoned inside Gaza with nearly no entry or exit allowed for anyone, even the severely ill, since June. Gravely ill people, including children have died because they were not allowed to leave for medical care which they cannot find locally due to the Israeli embargo. Even prior to that, restrictions were in place which allowed very few people to go in or out. Let's not forget what is entirely eclipsed in the mainstream media which is the ever deteriorating humanitarian situation in the Gaza Strip.
