Mais ce processus n'est pas nouveau. Il ne fait pas partie, comme plusieurs le supposent, des nouvelles mesures anti-terroristes introduites ? la suite du 11 septembre 2001. Au contraire, les certificats de s?curit? ?voluent au sein de la Loi sur l'immigration et la protection des r?fugi?s (LIPR) depuis les ann?es 1970 au moins. Sa nouvelle notori?t? est d? en grande partie ? l'instrumentalisation qui est faite de telles mesures dans une ??re de terrorisme?, mais aussi gr?ce ? une campagne publique impliquant les d?tenus des certificats de s?curit? et leurs familles : les ?pouses, soeurs, m?res et enfants de cinq ?supects de terrorisme? qui, en juin 2006, avaient pass? aussi longtemps que six ans en prison sans accusations. Le processus des certificats de s?curit? est mis en branle lorsque le ministre f?d?ral de la Citoyennet? et de l'Immigration et le Solliciteur g?n?ral du Canada, ? la demande des Services canadiens de renseignement et de s?curit? (SCRS), signent un certificat qui ?atteste que (l'individu) est inadmissible pour des raisons de s?curit??. Written and directed by Alexandre Trudeau, Secure Freedom is a one-hour documentary, investigating Canada's use of security certificates. Over the past two years, Trudeau has examined security certificates and how they have taken away the rights and freedoms of several men in Canada, including Hassan Almrei, who has spent more than four years in detention and is now being held in a specially-built federal facility near Kingston. Trudeau: "As I looked deeper into security certificates, I saw myself transformed from journalist to activist and was compelled to show Canadians the injustice being done in a country that prides itself on its human rights record." *AHMAD JABALLAH is the oldest son Mahmoud Jaballah, a torture survivor from Egypt, who was arrested in August 2001 under a "security certificate". He had previously been detained under a security certificate for seven months in 1999. The certificate was thrown out - and then he was re-arrested. The second certificate was thrown out on a technicality. The Federal Court decision upholding his third certificate left him in limbo as it forbade his deportation on the grounds that he would be tortured. Jaballah is waiting for a decision on his application for release on bail from Guantanamo north. Ahmad has worked to free his father since he was 11 years old, in the process losing much of his childhood and his belief in Canada as a country of freedom and justice. *ADIL CHARKAOUI, a permanent resident of Canada, was arrested in May 2003 under a "security certificate" and released under harsh conditions in February 2005. His certificate has not yet been reviewed by the courts. His application for protection was refused, but the government withdrew the decision in embarassment in March 2005. His case has been suspended ever since. Despite the severe conditions, he has nevertheless been able to complete his Masters thesis. His mother, forced to accompany her son everywhere he goes, has been unable to find work or live her own life. Charkaoui awaits the decision of the Supreme Court on his constitutional challenge to the security certificate process, expected as early as late fall 2006. *BETWEEN STATES is an exhibit by Darren Ell which showed at the Dazibao gallery in Monteal between 12 October and 11 November 2006. Its large format portraits of security certificate detainees and non-status migrants were accompanied by a sound track in which the individuals photographed described their situation. "Between States" is Darren Ell's first major solo exhibition. Ell lives in Montreal where he is pursuing an MFA in photography at Concordia University. His photographs and interviews have been published by La Presse, the Toronto Star, the National Post and broadcast on CBC-Radio-Canada and elsewhere. ==> BACKGROUND: Security certificates in Canada In the past few years, the security certificate process has been transformed from a relatively obscure piece of legislation into a headline story, tested in public discussion, media, the courts, and Parliament. Yet it is not new. It is not, as many people assume, part of the new anti-terror package introduced after September 2001. Rather, it has been an evolving part of Canadian immigration law since at least the 1970's. Its newfound notariety has much to do with the political instrumentalisation of such measures in an 'age of terrorism', but it also owes a debt to a public campaign involving the security certificate detainees and their families: the wives, sisters, mothers and children of five 'suspected terrorists' who, as of June 2006, had spent as long as six years in prison without charge. The security certificate process is set in motion when the Federal Minister of Citizenship and Immigration and the Solicitor-General of Canada, on the request of the Canadian Security Intelligence Service (CSIS), sign a certificate "attesting that (the individual) is inadmissable on security grounds". In the case of refugees, this automatically entails detention without bail until the certificate undergoes a judicial review; a process which can take years. In the case of Permanent Residents, a separate arrest warrant must be issued before detention, and detention reviews are provided for every six months. The inadmissability claim is reviewed by a Federal Court judge in a process that has been widely criticised for failing to meet international standards of a fair trial. Some key criticisms: ? the process applies only to those without full citizenship in Canada and thus does not meet standards for equality of treatment; ? the standard of proof the judge is required to use in assessing the validity of the allegations is "reasonable grounds to believe", which sets the bar low relative to the criminal law standard of "beyond all reasonable doubt", and certainly relative to what is at stake for the individual; ? precise allegations and information provided to the judge to support the allegations are withheld from the detainee and his lawyer; ? closed hearings between the judge and the Ministers can be held at any time; ? key terms (such as "national security", "terrorism" and "membership") are undefined; ? the standard of evidence is low, with hearsay and other questionable information admissable; and ? if the judge upholds the certificate, there is no appeal. The certificate then becomes a deportation order. Though the government's position is that it has the right to deport people on security grounds even if they face torture, the fact that all current detainees face a substantial risk of torture has delayed their deportation. In practice, this has translated to indefinite detention under a continued threat of deportation to torture. Refugees can be subjected to similar treatment under section 86 of the Immigration Act. Bachan Singh Sogi, for example, was deported on 1 July 2006, after spending almost four years in prison without charge under secret evidence by virtue of section 86. The deportation was carried out on the grounds of national security, and went ahead despite a positive assessment of "risk of torture" and "risk to life or risk of cruel and unusual treatment or punishment" by an Immigration Canada risk assessment agent. He was released on bail under virtual house arrest in June 2006. * Adil Charkaoui, married with three children, was born in Morocco and came to Canada as a permanent resident with his mother, father and sister in 1995; he was arrested in May 2003 and released under harsh conditions in February 2005. Leila MONDAY 30 _Jorge Alberto Lopez Bernal, a 30 year old nurse, the profesor Fidel Garcia and an approxiamently 14 year old youth, still unidentified, die in the violent police siege in Oaxaca City. Police raid certain homes and detain 50 people who are then transported to the 28th Military Zone. _Aggressions against Oaxaca's Radio Universidad continue. The radio urgently calls for defense in the face of paramilitary and PFP attempts to destroy the radio facilitites and cut the signal. _ A caravan of 6 buses of students from Mexico City headed for Oaxaca is detained by PRIistas in Nochistlan. The students are beaten and atleast 17 people are reported missing, although some reports claim that has been as three entire buses of students are missing. _The detention of at least 23 people by the special operations unit of the PFP this past Sunday has been confirmed. Before being turned into the prosecutor?s office, these people were transported to the 28th military zone. _At one in the afternoon, a large mobilization departs from three different places in the city of Oaxaca (Procuradur?a, IEEPO and Santa Rosa) in order to arrive at the city?s zocalo. The marchers surrounded the police that were guarding access to the central plaza with tanks, clubs, tear gas and assault rifles. Mexico City?s Independent Media Center reports that 20,000 people were present in the march. _A contingent of the APPO installs another encampment in front of the Santo Domingo. _ Three political prisoners, professors Germain Mendoza Nube and Evangelio Mendoze and the biologist Ramiro Aragon, are liberated after almost three months. One other, Cararino Torres, will leave the La Palma prison this coming 21st of November. _In Mexico City there is a march of a thousand people in solidairty with the APPO in front of the Secretary of the Interior (Gobernacion). The three recently liberated political prisoners speak. _Solidarity highway blocades are reported in the Istmo of Tehuantepec, in La Venta, in Ixtepec City and in Boca del Monte. The sixth commision of the EZLN and the Other Campaign block the bridge that links Sonora with the United States. A call is made to close streets, highways and airports all over the country on the 1st of November and to convene an indefinite national strike on the 20th of November in protest against the repression in Oaxaca and calling for the exit of Ulises Ruiz from the position of governor of Oaxaca. _With the exception of the PRI, the remaining sections of the House of Representatives reach an agreement to ask the governor of Oaxaca, Ulises Ruiz, to request resignation or step down from the position, with the objective of recuperating the governability of the state. URO refuses to receive the correspondence from the mentioned office. _Fox declares that the PFP entered the city without fire arms although there are photos of agents with AK-47s and R-15s. _ The APPO decides to end negociations with the Secretary of the Interior (Gobernacion), giving as reasons that the dialogue has not been taken seriously and that the people of Oaxaca are suffering repression at the hands of federal forces. TUESDAY 31 _Atleast 60-70 people are reported detained (without arrest warrants) and others are assaulted. _PRI groups conduct a march in the city of Oaxaca. These are groups that provoke violence and aggression. _The PFP violently lifts barracades (used by the popular movement as a form of pacific resistence) in various parts of the city. There will also be performances, brigades and a march that will cover the university grounds. There are also solidarity actions in the following schools of the National University (UNAM): Colege of Sciences and Humanities (CCH) Sur, Preparatory 6, CCH Naucalpan, and there are solidarity blocades outside of the National School of Professional Studies Aragon. _3,000 teachers of the CNTE (the dissident section of the national teachers union) in Michoacan leave for Oaxaca in order to support Section XXII and the APPO. _The PFP has a road block set up in the highway by the exit to Tlacolula and is turning APPO solidarity groups headed for Oaxaca away from the city. _Those who are still detained in the Miahuatlan jail will be transferred to the city of Mexico. It is unknown if the National Commission of Human Rights will following up on the detensions as there is no official list and the number of the detained is unknown, although there are reports that around 300 are held in Miahuatlan. _The offices of the Mexican League in Defense of Human Rights (LIMEDH) are harrassed. Graffite that says, "The APPO meets here," is painted. _The businesses of Oaxaca's zocalo hold the PFP responsible for the looting of 37 business; what's more, they now can't open their businesses at all given the police violence in the streets. _The teachers union does not recognize the government agreements. There will be no negociation until the political prisoners are liberated, the disappeared persons appear and Ulises Ruiz leaves office and is held responsible for his crimes. WEDNESDAY 1 _A PFP helicopter carries 5 companeros away. What's more, the PFP captures a child of 13, takes him away and beats him. _The PFP displaces the barricade outside of Canal 9 in Oaxaca, enters the offices and loots them. People are reported hurt and 30 are detained. In the areas around canal 9 another 2 companeros are detained and carried away in a van. _It is reported that in Tlaxiaco and Chalistenango there are break-ins in private homes (presumably carried out by PFP), searching for two teachers. Tear gases are first thrown into the houses and then the locks are broken. _The APPO realizes a march in the historic centre from Santo Domingo. The Other Campaign conducts a march in support of the people of Oaxaca in Mexico City and 3 EZLN comandantes participate. _The APPO makes a call to instal real or symbolic barricades throughout Mexico and the world. In the city of Mexico people manifest in various solidarity blocades. There are blocades in the following highways: Picacho-Ajusco and Calzada Ignacio Zaragoza in the south of Mexico City, in the entrance to the Mexico-Puebla highway and in Los Reyes Texcoco. All of the highways that cross through zapatista territory in Chiapas are closed from dawn. All of the highways that arrive to or leave from San Cristobal de las Casas, Ocosingo, Altamirano, Comitan, among others, are blocked by indigenous zapatista communities in the autonomous municipalities. The sixth commission, the other campaign in Ciudad Juarez and the other on the other side block the international border bridge Lerdo (that goes between El Paso, Texas and Ciudad Juarez, Chihuahua) in solidaridy with the dignified peoples of Oaxaca. They finish by mounting a symbolic barricade on the bridge. _A report from Radio Universidad of Oaxaca indicates that an operative of the AFI (Mexican Intelligence) with 100 vans is headed toward ciudad universitaria (CU) in Oaxaca City. Today a search warrent agains the University of Oaxaca was issued, with the pretext of an arms search. IT is feared that this is a pretext to assault Radio Universidad of Oaxaca. (CU is the area of Oaxaca city where the university is located. The radio is located inside the university grounds.) On the 1st and 2nd of november the days of the death are celebrated in Mexico. This year the days arrive in the middle of government terror in the state of Oaxaca. In spite of this, the people of Oaxaca and of all of Mexico are preparting to celebrate the day of the dead. The social movement will remember the deaths of Pasta de Conchos, Sicartsa, the women assasinated in Juarez, the fallen in Atenco and those who have died in Oaxaca during the reign of Ulises Ruiz. November 2 _Radio Universidad of Oaxaca is on the air at: http://icecast.v2v.cc:8000/appo1.mp3 _At 8 in the morning the PFP avances upon the University of Oaxaca and begins firing at the radio and the university campus. Helicopters fly over and descend upon the radio university. At 9 in the morning 2 military convoys arrive as well as another convoy of PFP with (traxcavos) to help in the displacement of the radio. Throughout the morning police and tanks continue arriving. The Federal Preventative Police violently attack the people, throwing tear gas/gas bombs at the people that work inside of Radio Universidad of Oaxaca. Tear gas is also thrown from the helicopters. At 11:40 in the morning 18 people had already been detaining, including a student leader of the movement, two minors and a profesor of the University of Oaxaca. _The people form a human Ca?n in the area immediately around Radio Universidad. The radio calls out to neighbors to come out into the streets and give flowers to the military who are also in the areas around CU with their fire arms. The radio underscores that this is a peaceful resistance. They do not want deaths or injured people. _At ten in the morning the PFP severely attacks the population in the cross of five men where the barricade is located. In some areas of the city it is reported that the PRIistas are firing into the air, hoping to discourage people from leaving in the streets in solidarity with Radio Universidad de Oaxaca. _Medical help is sought. Many people are hurt as the PFP is using tear gas, a non-lethal arm, as a lethal weapon, firing it directly into people?s bodies at point blank range. The hospitals do not want to receive the injured people of the social movement. _Two of those detained were liberated. Vargas, the PFP official, was the one who had apprehended these people. I would like to find out what my husband has ever done to deserve being in prison under the term of 'terrorist suspect'." *ADIL CHARKAOUI, a permanent resident of Canada, was arrested in May 2003 under a "security certificate" and released under harsh conditions in February 2005. Despite the conditions, which constrain the entire family, Charkaoui has nevertheless been able to complete his Masters thesis. "Between States" is Darren Ell's first major solo exhibition. Ell lives in Montreal where he is pursuing an MFA in photography at Concordia University. His photographs and interviews have been published by La Presse, the Toronto Star, the National Post and broadcast on CBC-Radio-Canada and elsewhere. ==> BACKGROUND: Security certificates in Canada In the past few years, the security certificate process has been transformed from a relatively obscure piece of legislation into a headline story, tested in public discussion, media, the courts, and Parliament. Yet it is not new. It is not, as many people assume, part of the new anti-terror package introduced after September 2001. Rather, it has been an evolving part of Canadian immigration law since at least the 1970's. Its newfound notariety has much to do with the political instrumentalisation of such measures in an 'age of terrorism', but it also owes a debt to a public campaign involving the security certificate detainees and their families: the wives, sisters, mothers and children of five 'suspected terrorists' who, as of June 2006, had spent as long as six years in prison without charge. The security certificate process is set in motion when the Federal Minister of Citizenship and Immigration and the Solicitor-General of Canada, on the request of the Canadian Security Intelligence Service (CSIS), sign a certificate "attesting that (the individual) is inadmissable on security grounds". In the case of refugees, this automatically entails detention without bail until the certificate undergoes a judicial review; a process which can take years. In the case of Permanent Residents, a separate arrest warrant must be issued before detention, and detention reviews are provided for every six months. The inadmissability claim is reviewed by a Federal Court judge in a process that has been widely criticised for failing to meet international standards of a fair trial. Some key criticisms: ? the process applies only to those without full citizenship in Canada and thus does not meet standards for equality of treatment; ? the standard of proof the judge is required to use in assessing the validity of the allegations is "reasonable grounds to believe", which sets the bar low relative to the criminal law standard of "beyond all reasonable doubt", and certainly relative to what is at stake for the individual; ? precise allegations and information provided to the judge to support the allegations are withheld from the detainee and his lawyer; ? closed hearings between the judge and the Ministers can be held at any time; ? key terms (such as "national security", "terrorism" and "membership") are undefined; ? the standard of evidence is low, with hearsay and other questionable information admissable; and ? if the judge upholds the certificate, there is no appeal. The certificate then becomes a deportation order. Though the government's position is that it has the right to deport people on security grounds even if they face torture, the fact that all current detainees face a substantial risk of torture has delayed their deportation. In practice, this has translated to indefinite detention under a continued threat of deportation to torture. Refugees can be subjected to similar treatment under section 86 of the Immigration Act. Bachan Singh Sogi, for example, was deported on 1 July 2006, after spending almost four years in prison without charge under secret evidence by virtue of section 86. The deportation was carried out on the grounds of national security, and went ahead despite a positive assessment of "risk of torture" and "risk to life or risk of cruel and unusual treatment or punishment" by an Immigration Canada risk assessment agent. I would like to find out what my husband has ever done to deserve being in prison under the term of 'terrorist suspect'." *ADIL CHARKAOUI, a permanent resident of Canada, was arrested in May 2003 under a "security certificate" and released under harsh conditions in February 2005. Despite the conditions, which constrain the entire family, Charkaoui has nevertheless been able to complete his Masters thesis. His photographs and interviews have been published by La Presse, the Toronto Star, the National Post and broadcast on CBC-Radio-Canada and elsewhere. ==> BACKGROUND: Security certificates in Canada In the past few years, the security certificate process has been transformed from a relatively obscure piece of legislation into a headline story, tested in public discussion, media, the courts, and Parliament. Yet it is not new. It is not, as many people assume, part of the new anti-terror package introduced after September 2001. Rather, it has been an evolving part of Canadian immigration law since at least the 1970's. Its newfound notariety has much to do with the political instrumentalisation of such measures in an 'age of terrorism', but it also owes a debt to a public campaign involving the security certificate detainees and their families: the wives, sisters, mothers and children of five 'suspected terrorists' who, as of June 2006, had spent as long as six years in prison without charge. The security certificate process is set in motion when the Federal Minister of Citizenship and Immigration and the Solicitor-General of Canada, on the request of the Canadian Security Intelligence Service (CSIS), sign a certificate "attesting that (the individual) is inadmissable on security grounds". In the case of refugees, this automatically entails detention without bail until the certificate undergoes a judicial review; a process which can take years. In the case of Permanent Residents, a separate arrest warrant must be issued before detention, and detention reviews are provided for every six months. The inadmissability claim is reviewed by a Federal Court judge in a process that has been widely criticised for failing to meet international standards of a fair trial. Some key criticisms: ? the process applies only to those without full citizenship in Canada and thus does not meet standards for equality of treatment; ? the standard of proof the judge is required to use in assessing the validity of the allegations is "reasonable grounds to believe", which sets the bar low relative to the criminal law standard of "beyond all reasonable doubt", and certainly relative to what is at stake for the individual; ? precise allegations and information provided to the judge to support the allegations are withheld from the detainee and his lawyer; ? closed hearings between the judge and the Ministers can be held at any time; ? key terms (such as "national security", "terrorism" and "membership") are undefined; ? the standard of evidence is low, with hearsay and other questionable information admissable; and ? if the judge upholds the certificate, there is no appeal. The certificate then becomes a deportation order. Though the government's position is that it has the right to deport people on security grounds even if they face torture, the fact that all current detainees face a substantial risk of torture has delayed their deportation. In practice, this has translated to indefinite detention under a continued threat of deportation to torture. Refugees can be subjected to similar treatment under section 86 of the Immigration Act. Bachan Singh Sogi, for example, was deported on 1 July 2006, after spending almost four years in prison without charge under secret evidence by virtue of section 86. The deportation was carried out on the grounds of national security, and went ahead despite a positive assessment of "risk of torture" and "risk to life or risk of cruel and unusual treatment or punishment" by an Immigration Canada risk assessment agent. Her passionate speeches and writings were able to rally together thousands at a time in open opposition to the war, and her political agitation eventually led to her deportation to Russia in 1919. But what were the political, revolutionary ideals behind Goldman's anti-war organizing? What did Goldman and the anarchist movement have to offer to the anti-war movement? This workshop will explore the anarchism of Emma Goldman, and her critiques of war on the basis of class, feminism, and free expression. More importantly, what lessons can be drawn for anti-war organizing today? In the context of current wars to 'liberate women', Block the Empire will draw from Emma Goldman and beyond to build a strong pro-feminist, anti-racist, and anti-authoritarian movement against all wars, both at home and abroad. Ses photographies et entrevues ont ?t? publi?es dans La Presse, le Toronto Star, le National Post et diffus?es sur les ondes de la CBC. ==> INFORMATION G?N?RALE : Les certificats de s?curit? au Canada Depuis quelques ann?es, le processus des certificats de s?curit? s'est transfom? : d'une loi relativement obscure, ils a fait les manchettes, a fait l'objet d'un d?bat public dans les m?dias, les tribunaux et le Parlement. Mais ce processus n'est pas nouveau. Il ne fait pas partie, comme plusieurs le supposent, des nouvelles mesures anti-terroristes introduites ? la suite du 11 septembre 2001. Au contraire, les certificats de s?curit? ?voluent au sein de la Loi sur l'immigration et la protection des r?fugi?s (LIPR) depuis les ann?es 1970 au moins. Sa nouvelle notori?t? est d? en grande partie ? l'instrumentalisation qui est faite de telles mesures dans une "?re de terrorisme", mais aussi gr?ce ? une campagne publique impliquant les d?tenus des certificats de s?curit? et leurs familles : les ?pouses, soeurs, m?res et enfants de cinq "supects de terrorisme" qui, en juin 2006, avaient pass? aussi longtemps que six ans en prison sans accusations. Le processus des certificats de s?curit? est mis en branle lorsque le ministre f?d?ral de la Citoyennet? et de l'Immigration et le Solliciteur g?n?ral du Canada, ? la demande des Services canadiens de renseignement et de s?curit? (SCRS), signent un certificat qui "atteste que (l'individu) est inadmissible pour des raisons de s?curit?". Dans le cas des r?fugi?s, cela entra?ne automatiquement l'emprisonnement sans possibilit? de libert? conditionnelle tant que le certificat n'aura pas ?t? soumis ? une r?vision judiciaire; un processus qui peut prendre des ann?es. Dans le cas des r?sidents permanents, un mandat d'arrestation doit ?tre ?mis avant l'emprisonnement et une r?vision de la d?tention doit avoir lieu tous les six mois. La pr?tention d'inadmissibilit? est r?vis?e par un juge de la Cour f?d?rale dans le cadre d'un processsus qui a ?t? largement critiqu? pour son incapacit? ? satisfaire les normes internationales d'un proc?s juste et ?quitable. Les principales critiques : - le processus s'applique seulement aux personnes qui n'ont pas la citoyennet? canadienne, ce qui ne satisfait pas aux normes en mati?re d'?galit? de traitement; - le niveau de la preuve que le juge est tenu d'utiliser dans son ?valuation de la validit? des all?gations est "des motifs raisonnables de croire", ce qui place la barre tr?s basse comparativement au niveau de la preuve en droit criminel qui est "au-del? de tout doute raisonnable", et surtout comparativement ? ce qui est en jeu pour la personne d?tenue; - les all?gations pr?cises et une grande partie de l'information fournie au juge afin d'appuyer les all?gations sont cach?es au d?tenu et ? son avocat; - des audiences ? huis clos peuvent avoir lieu ? tout moment entre le juge et les ministres; - des termes-cl?s (comme "s?curit? nationale", "terrorisme", "appartenance ?") ne sont pas d?finis; - le niveau de la preuve est bas et le ou?-dire ainsi que de l'information douteuse sont pris en compte; - si le juge maintient le certificat, il n'y a pas de possibilit? d'appel. Le certificat de s?curit? devient alors un avis de d?portation. Alors que la position du gouvernement est qu'il a le droit de d?porter des personnes pour des raisons de s?curit? m?me si elles risquent la torture, le fait que tous les d?tenus actuels font face ? un risque ?lev? de torture a retard? leur d?portation. Dans la pratique, cela s'est traduit par la d?tention ind?finie et la menace constante d'une d?portation vers la torture. Les r?fugi?s peuvent ?tre soumis ? un traitement similaire en vertu de la section 86 de la Loi sur l'immigration. Bachan Singh Sogi, par exemple, a ?t? d?port? le 1er juillet 2006, apr?s avoir pass? pr?s de quatre ans en prison sans accusations et sur la base de preuves secr?tes, en vertu de cette section de la loi. La d?portation a ?t? effectu?e pour des raisons de s?curit? nationale et a eu lieu malgr? une ?valuation positive par un agent d'?valuation des risques d'Immigration Canada de "risque de torture" et de "risque de traitement ou ch?timent cruel et inusit?". **En libert? conditionelle : - Mohamed Harkat, mari?, n? en Alg?rie, a ?t? accept? comme r?fugi? au Canada avant d'?tre arr?t? en d?cembre 2002. Over the past two years, Trudeau has examined security certificates and how they have taken away the rights and freedoms of several men in Canada, including Hassan Almrei, who has spent more than four years in detention and is now being held in a specially-built federal facility near Kingston. Trudeau: "As I looked deeper into security certificates, I saw myself transformed from journalist to activist and was compelled to show Canadians the injustice being done in a country that prides itself on its human rights record." *AHMAD JABALLAH is the oldest son Mahmoud Jaballah, a torture survivor from Egypt. As Ahmad explained to the People's Commission, "We came here thinking that this country respects people's rights, that it does not judge people or discriminate against people based on their colour, race or religion." His father was first arrested under a "security certificate" in 1999, released and then re-arrested, under the same evidence, in 2001. Ahmad has worked to free his father since he was 11 years old, in the process losing much of his childhood and shaking his belief in Canada as a country of freedom and justice. *MONA EL FOULI has been tirelessly campaigning on behalf of her husband Mohammad Mahjoub since his arrest under a security certificate in June 2000. As she says, "He is my husband and the father of my (two) kids. And I should fight for his rights. There isn't any evidence that he has ever done anything that would ever make me think of leaving him. ... I would like to find out what my husband has ever done to deserve being in prison under the term of 'terrorist suspect'." *ADIL CHARKAOUI, a permanent resident of Canada, was arrested in May 2003 under a "security certificate" and released under harsh conditions in February 2005. Despite the conditions, which constrain the entire family, Charkaoui has nevertheless been able to complete his Masters thesis. His photographs and interviews have been published by La Presse, the Toronto Star, the National Post and broadcast on CBC-Radio-Canada and elsewhere. ==> BACKGROUND: Security certificates in Canada In the past few years, the security certificate process has been transformed from a relatively obscure piece of legislation into a headline story, tested in public discussion, media, the courts, and Parliament. Yet it is not new. It is not, as many people assume, part of the new anti-terror package introduced after September 2001. Rather, it has been an evolving part of Canadian immigration law since at least the 1970's. Its newfound notariety has much to do with the political instrumentalisation of such measures in an 'age of terrorism', but it also owes a debt to a public campaign involving the security certificate detainees and their families: the wives, sisters, mothers and children of five 'suspected terrorists' who, as of June 2006, had spent as long as six years in prison without charge. The security certificate process is set in motion when the Federal Minister of Citizenship and Immigration and the Solicitor-General of Canada, on the request of the Canadian Security Intelligence Service (CSIS), sign a certificate "attesting that (the individual) is inadmissable on security grounds". In the case of refugees, this automatically entails detention without bail until the certificate undergoes a judicial review; a process which can take years. In the case of Permanent Residents, a separate arrest warrant must be issued before detention, and detention reviews are provided for every six months. The inadmissability claim is reviewed by a Federal Court judge in a process that has been widely criticised for failing to meet international standards of a fair trial. Some key criticisms: ? the process applies only to those without full citizenship in Canada and thus does not meet standards for equality of treatment; ? the standard of proof the judge is required to use in assessing the validity of the allegations is "reasonable grounds to believe", which sets the bar low relative to the criminal law standard of "beyond all reasonable doubt", and certainly relative to what is at stake for the individual; ? precise allegations and information provided to the judge to support the allegations are withheld from the detainee and his lawyer; ? closed hearings between the judge and the Ministers can be held at any time; ? key terms (such as "national security", "terrorism" and "membership") are undefined; ? the standard of evidence is low, with hearsay and other questionable information admissable; and ? if the judge upholds the certificate, there is no appeal. The certificate then becomes a deportation order. Though the government's position is that it has the right to deport people on security grounds even if they face torture, the fact that all current detainees face a substantial risk of torture has delayed their deportation. In practice, this has translated to indefinite detention under a continued threat of deportation to torture. Refugees can be subjected to similar treatment under section 86 of the Immigration Act. Bachan Singh Sogi, for example, was deported on 1 July 2006, after spending almost four years in prison without charge under secret evidence by virtue of section 86. The deportation was carried out on the grounds of national security, and went ahead despite a positive assessment of "risk of torture" and "risk to life or risk of cruel and unusual treatment or punishment" by an Immigration Canada risk assessment agent. Out under conditions: * Mohamed Harkat, married, born in Algeria, was accepted as convention refugee in Canada before being arrested in December 2002. His certificate was upheld in 2005. One member of Block the Empire, Jaggi Singh, was arrested as he sat in the conference room waiting for Harper's talk to begin. Members of BLEM asserted that it was a public talk and they had the right to be there, despite the security guards telling them the event was 'invitation only'. As members of BLEM were aggressively removed from the room by police, one member of BLEM was sexually harassed by a cop, who said "we should go out for a beer some time", as he pushed her back repeatedly. Friday, November 24, 2006 -- Canadian Prime Minister Steven Harper is sneaking into Montreal today -- a city where his party has little to no support or respect -- for a scripted public relations event at the Montreal General Hospital, stacked with eager young Conservatives from McGill. We're here to disrupt Prime Minister Harper and to expose his far right-wing agenda. Real democracy means getting in the face of decision-makers, not sitting politely while we're fed empty sound bites and stage-managed photo ops while surrounded by cops and security guards. Why are we here? Here are just some of the reasons: Canada out of Kandahar, Bush out of Baghdad! Steven Harper is an ideological soul mate of George Bush, and an unabashed defender of Bush's disastrous "war on terror". Canadian troops are currently in Afghanistan to allow more US troops to occupy and kill in Iraq. Bush and Harper have put forward a false choice between supporting Western soldiers or the Taliban, and would have us believe that their brand of Christian corporate free-market fundamentalism is supposed to be the basis for the liberation of average Afghanis. The killing of civilians is not "justified and measured" This summer, when the Israeli Defence Forces brutally attacked civilians and the infrastructure of Lebanon, in acts widely recognized as war crimes, Steven Harper expressed his unconditional support for Israel. Even after an entire Montreal-based family were massacred in their home in southern Lebanon, Harper continued to describe the Israeli invasion as "justified and measured". The Harper government has also continued to side with the continued Israeli occupation of Palestinian territories. The anger that brought us out in large numbers on the streets of Montreal this past summer to denounce Steven Harper's complicity in war crimes brings us to confront him personally today. Extinguishing indigenous sovereignty One of Steven Harper's closest advisors, and ideological mentors, is Calgary neo-conservative professor Tom Flanagan. Regarding the rights of indigenous peoples, Flanagan has written the following: "Europeans are, in effect, a new immigrant wave, taking control of land just as earlier aboriginal settlers did. To differentiate the rights of earlier and later immigrants is a form of racism." Equating indigenous persons as "immigrants" is tantamount to extinguishing indigenous rights. The Harper Conservatives stand for assimilation; in the context of continued self-determination struggles at Six Nations, Sun Peaks, Grassy Narrows and elsewhere, the Harper Conservative position is tantamount to continued genocide. The National Insecurity Agenda Not surprisingly, the Conservatives have entrenched the previous Liberal government's national insecurity agenda, promoting fear and paranoia, and using the "war on terror" to justify more repressive police and security measures. Public Security Minister Stockwell Day intends to arm border guards, while Steven Harper self-servingly pronounces on the guilt of suspects in Toronto. The Harper Conservatives create fear to justify their own "law and order" agenda. Continued Deportations and Detentions Under Immigration Minister Monte Solberg and Stockwell Day -- who is responsible for the Canadian Border Services Agency -- the Harper government has accelerated the policy of deportation and detention, entering homes, workplaces, shopping malls, subway stations and even schools to detain migrants. Under the current Conservative government, CBSA officials have entered primary and secondary schools in Toronto on at least two occasions to detain children. In Montreal, deportation agents have raided carwashes to detain workers, as well as entering buses to check IDs and detain individuals. The net effect has been to create fear within immigrant communities. Harper Homophobia The Harper government has decided to re-open the same-sex marriage debate, in a blatant attempt to mimic the US neo-conservative tactic of provoking homophobia to win votes. Re-opening this settled debate also serves to ignore the substantive issues ? such as health care, youth homelessness, etc -- that effect the wider queer community. Environmental Degradation In a clear attempt to appease the oil and gas industry, the Harper government remains in denial about global warming, and continues to promote ecologically destructive policies. Cutbacks to Social Funding The Harper Conservatives -- under the leadership of former Mike Harris thug and now Finance Minister Jim Flaherty -- have deepened Liberal cutbacks to social programs, undermining services to women, the poor, immigrants, indigenous peoples and queers. We're here today as members of diverse anti-war, anti-poverty, anti-oppression and social justice groups in Montreal. Steven Harper and his crew of right-wing men ? Stephen Harper est l'?me soeur id?ologique de George Bush, et un ardent d?fenseur de la d?sastreuse ? guerre au terrorisme ? de Bush. Les soldats canadiens sont en Afghanistan pour que davantage de soldats ?tats-uniens puissent occuper et assassiner en Irak. Ce que Bush et Harper nous proposent, c'est un faux dilemme, soit celui de choisir entre les soldats occidentaux et les Talibans. Ils tentent de nous convaincre que leur fondamentalisme de march? ? la sauce chr?tienne est ? la base de la lib?ration du peuple afghan.Le meurtre de populations civiles n'est jamais une r?ponse ? justifi?e et mesur?e ? Cet ?t?, quand les forces arm?es isra?liennes ont brutalement attaqu? les populations et l'infrastructure civile au Liban (des gestes largement reconnus comme ?tant des crimes de guerre), Stephen Harper a exprim? son appui inconditionnel ? l'?tat isra?lien. M?me apr?s qu'une famille montr?alaise ait ?t? d?cim?e lors d'une attaque contre leur maison dans le Sud-Liban, Harper a continu? de d?crire l'assaut isra?lien comme ?tant ? justifi? et mesur? ?. Le gouvernement Harper a aussi continu? de prendre le parti de l'occupation isra?lienne des territoires palestiniens. La col?re qui nous a fait sortir en grand nombre dans les rues de Montr?al cet ?t? persiste, et c'est ce qui nous a amen? ? venir le confronter personnellement au sujet de sa complicit? dans les crimes de guerre. Les attaques contre la souverainet? des peuples autochtones Un des conseillers les plus proches de Stephen Harper (ainsi qu'un de ses mentors au niveau id?ologique) est le professeur n?o-conservateur Tom Flanagan. Au sujet des droits des peuples autochtones, Flanagan ?crit ceci: ? Les Europ?ens constituaient, en effet, une nouvelle vague d'immigration, qui ont pris possession des terres tout commes l'ont fait des colons autochtones auparavant. Faire une diff?rence entre les vagues plus anciennes et plus r?centes de migration constitue une forme de racisme ?. Consid?rer les autochtones comme des ? immigrant-e-s ? ?quivaut ? nier leurs droits. Les Conservateurs de Harper sont en faveur de l'assimilation des peuples autochtones ; dans le contexte des luttes d'auto-d?termination en cours ? Le Ministre de la S?curit? publique, Stockwell Day, a l'intention d'armer les agents frontaliers, tandis que Stephen Harper se permet de se prononcer sur la culpabilit? de suspects ? Toronto. Despite heavy RCMP and Montreal police presence, demonstrators we able to let themselves in to the room where Stephen Harper was speaking, before being kicked out by security. One member of Block the Empire, Jaggi Singh, was arrested as he sat in the conference room waiting for Harper's talk to begin. Members of BLEM asserted that it was a public talk and they had the right to be there, despite the security guards telling them the event was 'invitation only'. As members of BLEM were aggressively removed from the room by police, one member of BLEM was sexually harassed by a cop, who said "we should go out for a beer some time", as he pushed her back repeatedly. Friday, November 24, 2006 -- Canadian Prime Minister Steven Harper is sneaking into Montreal today -- a city where his party has little to no support or respect -- for a scripted public relations event at the Montreal General Hospital, stacked with eager young Conservatives from McGill. We're here to disrupt Prime Minister Harper and to expose his far right-wing agenda. Real democracy means getting in the face of decision-makers, not sitting politely while we're fed empty sound bites and stage-managed photo ops while surrounded by cops and security guards. Why are we here? Here are just some of the reasons: Canada out of Kandahar, Bush out of Baghdad! Steven Harper is an ideological soul mate of George Bush, and an unabashed defender of Bush's disastrous "war on terror". Canadian troops are currently in Afghanistan to allow more US troops to occupy and kill in Iraq. Bush and Harper have put forward a false choice between supporting Western soldiers or the Taliban, and would have us believe that their brand of Christian corporate free-market fundamentalism is supposed to be the basis for the liberation of average Afghanis. The killing of civilians is not "justified and measured" This summer, when the Israeli Defence Forces brutally attacked civilians and the infrastructure of Lebanon, in acts widely recognized as war crimes, Steven Harper expressed his unconditional support for Israel. Even after an entire Montreal-based family were massacred in their home in southern Lebanon, Harper continued to describe the Israeli invasion as "justified and measured". The Harper government has also continued to side with the continued Israeli occupation of Palestinian territories. The anger that brought us out in large numbers on the streets of Montreal this past summer to denounce Steven Harper's complicity in war crimes brings us to confront him personally today. Extinguishing indigenous sovereignty One of Steven Harper's closest advisors, and ideological mentors, is Calgary neo-conservative professor Tom Flanagan. Regarding the rights of indigenous peoples, Flanagan has written the following: "Europeans are, in effect, a new immigrant wave, taking control of land just as earlier aboriginal settlers did. To differentiate the rights of earlier and later immigrants is a form of racism." Equating indigenous persons as "immigrants" is tantamount to extinguishing indigenous rights. The Harper Conservatives stand for assimilation; in the context of continued self-determination struggles at Six Nations, Sun Peaks, Grassy Narrows and elsewhere, the Harper Conservative position is tantamount to continued genocide. The National Insecurity Agenda Not surprisingly, the Conservatives have entrenched the previous Liberal government's national insecurity agenda, promoting fear and paranoia, and using the "war on terror" to justify more repressive police and security measures. Public Security Minister Stockwell Day intends to arm border guards, while Steven Harper self-servingly pronounces on the guilt of suspects in Toronto. The Harper Conservatives create fear to justify their own "law and order" agenda. Continued Deportations and Detentions Under Immigration Minister Monte Solberg and Stockwell Day -- who is responsible for the Canadian Border Services Agency -- the Harper government has accelerated the policy of deportation and detention, entering homes, workplaces, shopping malls, subway stations and even schools to detain migrants. Under the current Conservative government, CBSA officials have entered primary and secondary schools in Toronto on at least two occasions to detain children. In Montreal, deportation agents have raided carwashes to detain workers, as well as entering buses to check IDs and detain individuals. The net effect has been to create fear within immigrant communities. Harper Homophobia The Harper government has decided to re-open the same-sex marriage debate, in a blatant attempt to mimic the US neo-conservative tactic of provoking homophobia to win votes. Re-opening this settled debate also serves to ignore the substantive issues ? such as health care, youth homelessness, etc -- that effect the wider queer community. Environmental Degradation In a clear attempt to appease the oil and gas industry, the Harper government remains in denial about global warming, and continues to promote ecologically destructive policies. Cutbacks to Social Funding The Harper Conservatives -- under the leadership of former Mike Harris thug and now Finance Minister Jim Flaherty -- have deepened Liberal cutbacks to social programs, undermining services to women, the poor, immigrants, indigenous peoples and queers. We're here today as members of diverse anti-war, anti-poverty, anti-oppression and social justice groups in Montreal. Steven Harper and his crew of right-wing men ? Stockwell Day, Monte Solberg, Vic Toews, Michel Fortier, Jim Prentice, Jim Flaherty, Tom Flanagan and others ? need to understand that they will not pass through Montreal without a confrontation and disruption. A large number of people are reported detained in various parts of the city. Two deaths are the result of the confrontation. (as of 9:33) The federal police began, around 5pm, to attack the members of the APPO that were peacefully demonstration in the areas around the zocalo. These aggressions caused the conflict that is still continuing between the police and the members of the APPO and its supporters. The streets of the historic center area battle ground and the federal police began to discharge fire arms against the protesters about an hour ago. The ministerial police of the state of Oaxaca and the federal preventative forces are investigating in order to apprehend in some part of the city, such as in el Llano, Crespo street and the market Central de Abastos as well as in other parts. Approximately 40 people are reported detained, 20 of them women. There are various injured people, one of whom is gravely hurt. Up until now we have the information that two compa?eros have lost their lives due to the aggressions, although their identities have not been confirmed. At the moment the offices of exterior relations (immigration) that are located in Pino Suarez and the offices of the police that are located in Juarez Avenue are on fire. The federal preventative police together with the state police have unleashed an offensive against the social movement of Oaxaca. The confrontations have arrived to the area around ADO (a bus station) and the hospital IMSS which is located in the street Ninos Heroes. The APPO has information that because of these recent events the Mexican Army is in Maximum Alert. Santo Domingo, headquarters of the APPO's planton ( camps in the city's center ) has been removed by the federal police after being taken over by them. Faced with this offensive against the people and in order to avoid more bloodshed the APPO has decided to retreat. Mexico, 25 november 2006. Today was the seventh megamarch in the city of Oaxaca, a gigantic demonstration in which dozens of thousands of people participated, all demanding the exit of Oaxaca?s governor Ulises Ruiz, under whose administration innumerable social organizers have been murdered, others have been disappeared, paramilitary groups have conducted bloody operations, demonstrators have been repressed by public forces (police) and states of siege have been established against rural populations, among other violations. The demonstration?s other main demand was the exit of the Federal Preventative Forces from Oaxaca, the return of all of the disappeared persons and the liberation of all political prisoners. In Mexico any meeting of unarmed people that seeks to petition the government cannot be declared illegal, and so to carry out this demonstration was a constitutional right. When the march ended, the people formed a symbolic human circle around the center of Oaxaca, which since October 29th has been under a violent and bloody attack by the federal preventative police. When this civic and peaceful protest was carried out, the federal preventative police began to throw objects at the demonstrators and later teargas, so much that a cloud of teargas had formed all around the city of Oaxaca, causing itching and irritation inside of the lungs of the habitants of the city. In the previous days the federal forces had taken the roofs of the buildings in the city center, from which they threw teargas onto the demonstrators today. Following that, the federal police charged the people, with more teargas while firing firearms, joined by paramilitaries with large firearms dressed as civilians who operated in cars and motorcycles in various parts of the city. At the moment various people have been reported seriously injured, their number still is not confirmed, as well as innumerable injuries due to the impact of teargas grenades launched with cannons, as well as injuries due to firearms. Various confirmed deaths due to firearms have also been reported. At the moment the Federal Preventative Police have thousands of demonstrators surrounded in the Santo Domingo plaza and are advancing while detaining them. They are reported to be torturing those who are detained, as well as a group of 20 to 30 detained who were piled up, just as in Atenco and then they sprayed teargas, when they were already under control and in the custody of federal forces. Additionally houses are being searched and illegal detentions are being carried out. The federal police attacked various civil buildings, among those are the office of exterior relations, the state legislative palace, the ADO bus station, and other civil buildings. In the previous days the Federal Preventative Police have entered the city of Oaxaca in a state of siege and a military take-over. When doing this dozens of disappearances have occurred, hundreds of injured, various demonstrators have been killed. The federal forces as well as the paramilitary groups had arrived at the time that there were reports of torture, violent threats, and death threats, including threats to throw detained demonstrators from helicopters. There are reports that some of these demonstrators actually were thrown from helicopters. Later the Federal Preventative Police have remained in the zocalo of Oaxaca as well as in other areas of the city, where searches of businesses have been reported as well as harassments and sexual assaults against women who passed through the area. Shootings by non-lethal weapons used in a lethal manner carried out by the PFP have also been reported, as well as the kidnapping of children of three years of age taken by men dressed in black and taken in helicopters. The Federal Preventative Police made world fame in an assault against the National Autonomous University of Mexico in 2000, when they victimized with torture and sexual assault the students who were striking against the privatization of the university. In May of this year the same PFP violently assaulted the people of San Salvador Atenco, leaving a number of people dead, gravely injured, disappeared, and 45 women sexually violated. Oaxaca Radio Universidad is calling for protests in solidarity in Mexico and throughout the world against the massacre in Oaxaca for tomorrow. Her passionate speeches and writings were able to rally together thousands at a time in open opposition to the war, and her political agitation eventually led to her deportation to Russia in 1919. But what were the political, revolutionary ideals behind Goldman's anti-war organizing? What did Goldman and the anarchist movement have to offer to the anti-war movement? This workshop will explore the anarchism of Emma Goldman, and her critiques of war on the basis of class, feminism, and free expression. More importantly, what lessons can be drawn for anti-war organizing today? In the context of current wars to 'liberate women', Block the Empire will draw from Emma Goldman and beyond to build a strong pro-feminist, anti-racist, and anti-authoritarian movement against all wars, both at home and abroad. Each workshop will be followed by an open discussion. This workshop will be facilitated by Louise-Caroline Bergeron and Aaron Lakoff of Block the Empire Montreal (BLEM). Since June 1, 2006, over 300 Palestinian civilians, including 89 children and 25 women, have been killed by the Israeli military. During the month of November alone, over 80 Palestinians have been killed in the town of Beit Hanoun in the northern Gaza Strip. Two women were killed protesting in front of a mosque that was later destroyed, and 19 women, children and men were killed by Israeli artillery while asleep in their house. The Gaza Strip is surrounded by a massive electric fence with all entry and exit controlled by the Israeli military. Palestinians in the area have literally been confined to an open-air prison as Israel imposes a policy of enforced starvation on the population. According to the World Bank, unemployment levels reached 40% in the first quarter of 2006 and over 80% of the population are living below the poverty line. But here in Canada, Prime Minister Harper and Foreign Minister Peter McKay have repeatedly refused to raise any condemnation of Israel's actions or to take any measures to prevent the continued killing of Palestinian civilians and the destruction of Palestinian livelihood. Instead, Harper and his cabinet speak of the 'shared values' of Israel and Canada, or the 'measured response' of the Israeli war machine. Come out on Dec. 2nd to demand an immediate end to Canadian government support for Israel's apartheid policies in the West Bank and Gaza Strip. Come out and let the people of Gaza know - they don?t stand alone!
